Protecting Darjeeling Tea's Identity

- Darjeeling tea is grown in the Darjeeling region of India at elevations between 600-1200 meters under cool, moist climate conditions. 10 million kg are produced annually in India and 40 million kg are sold worldwide. - However, the Darjeeling brand has not been trademarked, allowing other countries like Sri Lanka, Nepal, and Kenya to pass off their inferior quality teas as Darjeeling tea. This causes huge economic losses to Indian Darjeeling tea producers and marketers. - The document argues that registering Darjeeling tea under a geographical indicator in the WTO would help protect the brand for Indian-produced Darjeeling tea only.

and WTO
Prepared By:

Darjeeling Tea
• Grown in Darjeeling at latitude ranging from
600 to 1200 meters
• Requires:
– Cool
– Moist Climate
– Rainfall
– Sloping Terrain
• 10 million kg produced every year and 40
million kg sold worldwide.
Problems
• Not being trademarked many countries taking
undue advantage of Darjeeling
• Huge economic loss to Darjeeling tea
producers and marketers due to other countries
using same brand to sell their inferior quality
tea like Sri Lanka, Nepal, Kenya.
Question 1
• Yes,
– Reasons:
– Indian produced and branded tea since 150 years
– Registered under Geographical indicator in TRIPS
– Could not be produced else where

• Many other countries use name “Darjeeling” to sell their tea across
world.
– Hampers Indian marketers and producers.
– Because of low quality tea sold by other countries in name of Darjeeling, the
reputation and trust over original Darjeeling tea hampers.
• Many countries use name to sell other commodities like
– French Lingerie
– Perfumes
– Coffee
– Soft Drink
» People purchase these commodities because of Darjeeling name.
» But same hampers the Indian market.
• Due to these reasons Darjeeling brand should be used only for
Darjeeling tea in India
Question 2
• Yes, but only Indian produced products:
– Reasons:
• Trust on Darjeeling tea and worldwide recognition will help to sell other
Indian commodities.
• Will increase Indian market
• Will increase Indian trade.
• Not with foreign produced goods:
– Reasons:
• Worldwide recognition of Darjeeling brand increases market share of those
countries
• If poor quality commodities supplied, trust over Darjeeling brand will
hamper.
• Because of poor quality commodity supplied, Indian Darjeeling tea’s
market share would also hamper.
» Thus Darjeeling brand could be used with other commodities
only if same is produced in India.
Question 3
• The detailed plan is as follow:
– Geographical Indicator should be based on the
specific commodity found in the specific place and
no other region or place.
– Ministry of Commerce and Tea Board of India
should trademark brand “Darjeeling” for
Darjeeling tea only
