This is regarding allocation of cadres to the candidates who have been allocated
to the Indian Police Service on the basis of Civil Service Examination 2008.
2. The cadre allocation is to be made in accordance with the new cadre allocation
policy notified by DOPT vide O.M. dated 10.4.08 (Flag ‘A’). The number of vacancies
to be filled through Civil Services Examination 2008 has been determined as 130 in
consultation with the States. These vacancies have also been distributed category wise
on the basis of 200 point running vacancy based roaster. The category and cadre wise
distribution of these vacancies between outsider and insider in the ratio of 2:1 has been
carried out as per 30 point vacancy roster and reserved roster. The details of each cadre
regarding outsider/insider distribution of the 130 vacancies have been tabulated below:-

3. In accordance with Para 5, 7 (d) and 8 (ii) the 24 State cadres for the purpose of
cadre allocation have been arranged in alphabetical order. The alphabetical order
followed for cadre allocation of IPS is same as the one followed by DoP&T for IAS
(Flag-‘B’). While processing the cadre allocation it has been observed that though the
candidates are supposed to fill one preference of State/Cadre in one block of the
prescribed form yet (i) 08 candidates for outsider vacancies have given more than one
preference (Flag-‘C’) within one block and (ii) one candidate for home State has ticked
in the block in affirmative (Yes) whereas written by hand in negative (No). Such cases
may be dealt in following ways:-
(i) (a) All the preferences may be treated as ‘Nil’ as the form of
preference has been filled wrongly.
(b) More than one States preferred in a block be treated as
‘cancelled’ and rest of the States written in each block be counted for the
purpose of cadre allocation.
(c) More than one State preferred in one block be considered
alphabetically while making cadre allocation.
(ii) (a) The preference of home state be taken as negative because the
candidate has written “No” for that.
(b) The candidate while preferring cadres for outsider vacancies has
written his home State as first preference therefore at two places he has
given preference for allocation to the ‘home State’. The preference for
the home State may therefore be taken as ‘Yes’.
Taking a liberal view in the above scenarios, the exercise of allocation of cadres
has been based for outsider vacancies as per above (i) (c) and for insider vacancy as per
(ii) (b). Such cases have been discussed below:-
(1) Sh Sharanappa S.D. belonging to the State of Karnataka (Rank No 86)
while giving preference for home State has ticked on ‘Yes’ but written
‘No’ in hand in the form of UPSC main examination against column No
20 (b). In the preference form, for outsider vacancy he has written 1st
option as Karnaktaka (Home State). Presuming that the candidate has
written ‘No’ in the column 20 (b) inadvertently, his preference for
Karnataka as his home state has been accepted.
(2) Shri Kamble Amit Tukaram (Rank No. 491) has given preference 3 as
Chattisgarh and Madhya Pradesh. He is getting Chattisgarh as
preference No.3
4. Out of the 130 candidates allocated to the Indian Police Service by the DOP&T
(Flag-‘D’). 8 candidates have not joined the service and therefore, their names are not
considered for cadre allocation. Their offers of appointment have been cancelled (Flag-
‘E’). The remaining 122 shall be allotted to Home State/Cadre or any other State/Cadre
on the basis of merit, preference and vacancy available at their turn in the cadres. All
the candidates but for Ms. Priyanka, SC (Rank 508) have given preferences. Ms.
Priyanka has given her option only for the Home State and not for the outsider vacancy.
The details regarding Home States/other cadres and preferences thereof are placed at
(Flag-‘F’).
5. The cadre allocation is being made for the first time as per new Cadre Allocation
Policy of DoP&T dated 10.04.2008 in reference to the candidates selected on the basis
of CSE 2008. The cadre allocation broadly involves two stages (a) filling up of insider
vacancies with the candidates who have opted for the Home States, (b) filling up of
outsider vacancies with candidates as per their merit and preferences. In the first step
the cadre allocation process is to be initiated by making cadre allocation to the available
candidates belonging to various categories on the insider vacancies. In the second step
the general OBC category candidates are to be given benefit under Para-9. In the third
step the general insider vacancies which could not be filled due to non-availability of
general candidates are to be filled in accordance with Para 7 (d). In the fourth step the
insider SC vacancies which could not be filled due to non-availability of the SC
category candidates are to be filled by exchange as stipulated in Para 7 (a). In the fifth
step insider ST vacancies are to be filled by exchange as stipulated in Para 7 (b). In the
sixth step the insider OBC category candidates are to be exchanged and filled as per
Para 7 (c). After completion of this exercise, the remaining unfilled insider vacancies
are to be converted into outsider vacancies as per Para-8 (iii). The outsider vacancies
are to be filled as per merit and preferences of the candidates. Lastly, the candidates
who have not given any preference for outsider vacancies are to be allocated cadres in
accordance with Para 5.
INSIDER VACANCIES
6. As per para 8(i) of Cadre Allocation Policy, “First, all those candidates who
can be allocated against the insider vacancies available in their category would be so
allocated.” Accordingly, out of 42, the following 26 candidates ( 17 General Category,
7 OBC, 1 SC and 1 ST) have been allocated to their Home States:

7. Under Para 9 of the cadre allocation policy, “a reserved category candidate
selected on general standards shall be eligible for allocation against the available
insider unreserved vacancy as per his merit and preference. But if he cannot be
allocated against such vacancy, for he is lower in rank as compared with other
general category candidates, he shall be considered for allocation as per his merit and
preference against the available insider vacancy of his category and in case found
eligible, adjusted by exchanging insider vacancy in his category into insider UR
vacancy and outsider UR vacancy into outsider reserved vacancy of his category. This
is to ensure that such candidate is not placed at disadvantageous position vis-à-vis
other candidates of his category in the merit list below him.” DoP&T have forwarded
lists of the candidates allocated to the Indian Police Service on the basis of CSE 2008.
These lists contain the names of the candidates as per their category e.g. unreserved
OBC, SC and ST. However, the candidates qualifying on the general merit though
belonging to reserved categories are a part of unreserved list. In the OBC category,
there are 3 candidates who have been selected on General merit but only one could be
given the benefit under the para 9 raising the filling of insider vacancies from 26 to 27.
The details of the three OBC candidates qualifying on general merit are as follows:-
(i) Sh Manjunath H (Rank-192), Gen/OBC candidate (Home State –
Karnataka) :- In IPS Cadre of Karnataka, there are two insider general
vacancies. These are getting filled by two insider General candidates
(Rank No 86 and 100). Sh Manjunath H therefore cannot be allocated to
Home State against the insider general vacancy. He can also not be
adjusted on insider OBC vacancy as the same is not available in IPS
cadre of Karnataka. Sh Manjunath H could therefore not be allocated to
his Home State Karnataka. He has been allotted the cadre as an outsider
candidate under para 8 (iii).
(ii) Sh Ajay Kumar Sahni (Rank No 198) Gen/OBC candidate (Home
State –Uttar Pradesh) :- In IPS cadre of Uttar Pradesh, there are two (2)
insider general vacancies and three (3) insider OBC vacancies. Sh Sahni
is not eligible for allocation to his Home State against the insider general
vacancies as the same are being filled by allocating two insider general
candidates having higher ranks ( Rank No 99 and 138). Sh Ajay Kumar
Sahni is eligible for allocation to home state by exchanging insider OBC
vacancy with insider unreserved vacancy and outsider unreserved
vacancy with outsider reserved vacancy of his category in IPS cadre of
Uttar Pradesh. Shri Sahni (Rank No.198) therefore is adjusted in U.P as
per Clause 9 of the cadre allocation policy.
(iii)Sh Rathod Amit Kumar Bharat (Rank No 200) Gen/OBC candidate (Home
State –Maharashtra) :- In IPS cadre of Maharashtra, there is one insider
General vacancy and two insider OBC vacancies. The insider general
vacancy is filled by allocation of Rank No.113 over there. Sh Rathod Amit
Kumar Bharat (Rank No 200) therefore cannot be allocated to his home state
against the insider general vacancy. He could have been adjusted against the
OBC insider vacancy but the same is not possible due to non availability of
General category outsider vacancy to facilitate exchange. Shri Rathod Amit
Kumar therefore is not getting the benefit under Rule 9. The 2 OBC
candidates who are lower in rank than him are getting Home State. Shri
Paraskar Anil Subhash (Rank No.248) and Sh Holkar Prashant Vilasrao
Rank No 279 have therefore been allocated to their home state Maharashtra
as per Rules. Shri Rathod Amit Kumar Bharat and Shri Holkar Prashant
Vilasrao have represented for allocation to the home state. Since as per para
9, the exchange of insider vacancy into insider unreserved vacancy and
outsider unreserved vacancy into outsider reserved vacancy is not possible in
Maharashtra due to non-availability of outsider unreserved vacancy, Shri
Rathod Amit Kumar Bharat (Rank No. 200), an OBC candidate qualified on
general merit is on disadvantageous position in respect of allocation of home
state with reference to the two candidates qualified on OBC category and are
getting their home state. This is against the spirit of the policy. The matter
was therefore referred to DOP&T in file No.I-21023/8/2010-IPS-IV (link
file) for their comments. DOP&T have furnished their advice at flag ‘G’.
(a) Clause 7 (d) of the cadre allocation policy provides, “When no insider
unreserved candidate is available against an Insider Unreserved vacancy,
available in a cadre but insider SC/ST/OBC candidate (s) is/are available,
such senior most ST candidate (failing which such senior Most SC candidate
and such senior most OBC candidate in that order ) shall be adjusted by
shifting out the Unreserved insider vacancy to the next cadre in alphabetical
order having outsider vacancy in that category and bringing in an Outsider
vacancy of that category from that cadre”. Accordingly, in the following
cadres, 5 candidates have been adjusted on the UR/General vacancies due to
non-availability of UR general candidates and availability of reserved category
candidates. Consequently, the number of filled vacancies has risen to 32.
(i) GUJARAT :- There is one insider General vacancy but no insider
general candidate has qualified. No insider ST candidate has also
qualified. However, one SC candidate namely Shri Vaghela Vishal
Kumar Baldevbhai ( Rank No 556) has qualified. He is eligible for
allocation to Gujarat under the above Rule. For adjusting him in Gujarat,
the insider general vacancy of Gujarat has been shifted out to Haryana
and SC outsider vacancy has been brought in from there as an insider SC
vacancy. Shri Vaghela Vishal Kumar Baldevbhai ( Rank No 556), SC
candidate accordingly has been allocated to his Home State, Gujarat.
(ii) KERALA :- There are two insider General vacancies in Kerala but only
one General category candidate has qualified from the State of Kerala.
For the second insider vacancy UR candidate is not available. No insider
ST candidate is also available. However, S.C. candidates have qualified.
The senior most SC candidate is eligible for allocation to his Home State
as per the above rule. For adjusting him, the general insider vacancy of
Kerala has been shifted out to Manipur-Tripura and SC outsider vacancy
has been brought in from there as an insider SC vacancy. Shri T.K Shibu
(Rank No.472) accordingly, has been allocated to his home State, Kerala.
(iii) TAMILNADU :- In the IPS cadre of Tamil Nadu, there are 3 insider
General Category vacancies but insider General Category candidates
have not qualified. No insider ST candidates has also [Link]
insider SC category candidates eligible for allocation to home state are
available. The three general category vacancies have been shifted out,
one to Uttar Pradesh and two to West Bengal. SC outsider vacancy has
been brought in from there as insider SC vacancies to Tamil Nadu.
S/Shri P. Vijay Kumar (Rank No.230), G Dharmarajan (Rank No.509)
and Sibichakravarthi. M.R. (Rank No. 518) have been allocated to their
home State, Tamil Nadu.
8. Clause 7(a) of the cadre allocation policy provides, “when no candidates is
available against an insider SC vacancy in a Cadre, the same shall be filled up by
bringing in the senior most insider officer available in the merit list of ST candidates
(failing which in the merit list of OBC candidates and in the merit list of the
Unreserved candidates in that order) and shifting the SC vacancy of the cadre to the
cadre to which the incoming officer would have been allocated against the available
outsider vacancy in his category (failing which to the next cadre in alphabetical order
in which the outsider vacancy is available).” In order to make adjustments under this
Rule, first the candidates are allocated to the cadres on the vacancies which remain
unfilled after adjusting the candidates as per 8 (i) and 7 (d). The allocation chart of the
remaining 90 (122-26-1-5= 90) candidates after 8(i) and 7 (d) is placed at Flag ‘H’.
The following two cases are getting covered under Para 7(a) of the Cadre Allocation
Policy. Consequently, 34 insider vacancies are getting filled.
(i) BIHAR :- In IPS cadre of Bihar, there is one insider SC vacancy but no
candidate of SC category has qualified. No insider ST candidate has also
qualified. However, OBC candidates are available. Shri Pushkar Anand, the
senior most OBC candidate from Bihar (Rank No 241) is getting allocated to
Chhatisgarh against the outsider OBC vacancy. Under Para 7(a), the insider SC
vacancy of Bihar is shifted out to Chhatisgarh and OBC outsider vacancy has
been brought in from there as insider OBC vacancy. Sh Pushkar Anand (Rank
No.241) accordingly, has been allocated to his home state, Bihar.
(ii) MANIPUR-TRIPURA :- In IPS Cadre of Manipur-Tripura, there is one
insider SC vacancy but no candidate from SC category has qualified. However
one candidate of ST Category has qualified. Shri P. Goulungmuon Singsit (Rank
No. 565), the senior most ST candidate from Manipur is get allocated to
AGMUT against the outsider ST vacancy. Under Para 7(a), the insider SC
vacancy of Manipur-Tripura is shifted out to AGMUT and ST outsider vacancy
has been brought in from there as insider ST vacancy. Sh. P. Goulungmuon
Singsit (Rank No. 565) accordingly, has been allocated to his home state,
Manipur-Tripura.
(iii) It is also to be mentioned that there is only1 insider ST vacancy and it is filled
under 8 (i) and therefore , there is no case under 7 (b).
9. Clause 7(c) of the cadre allocation policy provides, “when no candidates is
available against an insider OBC vacancy in a cadre, the same shall be filled up by
bringing in the senior most insider officer available in the merit list of ST candidates
(failing which in the merit list of SC candidates and in the merit list of the Unreserved
candidates in that order) and shifting the OBC vacancy of the cadre to the cadre to
which the incoming officer would have normally been allocated against the available
outsider vacancy in his category (failing which to the next cadre in alphabetical order
in which the outsider vacancy is available).” . From the allocation chart at flag ‘P’ it
can be seen that Sh. Indrajeet Mahatha get allocated to the IPS cadre of Madhya
Pradesh against the outsider vacancy. He has been allocated to the State of Jharkhand
under Clause 7 (c) of the Policy. In IPS cadre of Jharkhand, there is one insider OBC
vacancy but no candidate from OBC, SC or ST category has qualified. However, Shri
Indrajeet Mahatha (Rank No.111), the senior most general candidate is eligible for
allocation to his Home State under Para 7 (c). The insider OBC vacancy of Jharkhand
is shifted out to Madhya Pradesh and General outsider vacancy has been brought in
from there as insider General vacancy. Shri Indrajeet Mahatha (Rank No.111)
accordingly, has been allocated to his home state, Jharkhand.
10. After making adjustment as indicated above, it is stated that no other candidate
is eligible for allocation of home State against the remaining unfilled insider vacancies.
The allocation chart of 35 insider candidates as discussed in the preceding para is placed
at flag ‘I’. The details regarding 35 insider vacancies have been filled and 07 vacancies
which still remain vacant are tabulated below:-

OUTSIDER VACANCIES
13. Under Rule 8 (ii), “…If an insider vacancy cannot be filled as per para 7
above, it would be converted to outsider vacancy and filled as such, duly accounting
the fact of unfilled insider vacancy in the insider-outsider roster of the relevant
cadre.”Accordingly, the remaining 7 unfilled insider vacancies have been converted
into outsider and added in the rest of outsider vacancies. The outsider vacancies
therefore have risen from 88 to 95. After adjusting 35 insider candidates on the insider
vacancies, the remaining 86 candidates (General-43, OBC-27, SC-11, ST-5) have been
allocated cadres against 86 outsider vacancies on the basis of their merit and preference.
One candidate namely, Ms. Priyanka who had not given any preference has been
allocated to Nagaland cadre on an outsider vacancy in accordance with Para-5 of the
Cadre Allocation Policy.
14. Para 8 (iii) of the Cadre Allocation Policy provides, “finally, all the remaining
candidates will be listed under their respective category in the order of merit and then
allocated to a cadre on the basis of their merit, preference and the outsider vacancies
in their category (including the outsider vacancies resulting from conversion of
insider vacancy, which remain eventually unfilled after the allocation as per clause
(i) and (ii) of Para 8 above) available at their turn in the cadres other than their home
cadre. Notwithstanding this, however, if during the course of allocation against the
outsider vacancies as above a candidate is going to be allocated to his own home
cadre because there are no other vacancies left for allocation other than those in his
home cadre, an ‘exchange’ would be resorted to whereby the allocation of such
candidate would be swapped with the cadre allotted to the first candidate above him in
the list whose home state and allotted cadre are different”. Accordingly, 86 candidates
have been allocated cadres on the outsider vacancies as per their merit and preference.
None of the candidates is getting allocated to his home state. The details regarding the
preference of State cadres of 43 General, 27 OBC, 12 SC and 5 ST candidates allocated
against outsider vacancies may please be perused at flag ‘K’, L, M & N respectively.
15. Para 5 of Cadre Allocation Policy provides, “if a candidate does not give any
preference for any of the cadre (s), it will be presumed that he/she has no specific
preference for those cadres. Accordingly, if he is not allocated to any of the cadre for
which he has indicated preference, he shall be allocated alongwith other such
candidates in the order of rank to any of the remaining cadres, arranged in
alphabetical order, in which there are vacancies in his category after allocation of all
the candidates who can be allocated to cadre in accordance with their preference.”
Ms Prinyanka (Rank No.508), SC candidate has not given any preference for cadres
against outsider vacancies. However, she had opted for the home state. The same could
not be allocated to her as there was no insider SC vacancy in Punjab. After allocating
86 candidates, the SC vacancies are available in Nagaland & West Bengal. Under para
5 above, Ms Priyanka (Rank No.508) has been allocated to the IPS cadre of Nagaland.
The allocation chart of the 87 candidates is placed at flag ‘J’.
16. As may be seen from the above, 122 vacancies (35 insider + 87 outsider) have
been filled (cadrewise details are at Flag-‘P’) and 8 vacancies have remained vacant
due to non availability of 8 candidates who had not joined the Service. The details of

Notes on pp.25-37/N dealing with the cadre allocation of candidates
who have been allocated to the Indian Police Service on the basis of Civil
Services Examination, 2008 may be perused in toto.
2. The number of vacancies and candidates recommended is 130. The
break-up of vacancies available in different cadres and different categories
may be seen in the Table in para-2.
3. The methodology followed has been explained in para-3. Out of 130
candidates allocated to IPS by DoPT (Flag-‘D’), 8 candidates have not
joined the service and therefore they are not considered for cadre
allocation. The names of these candidates may be seen at Flag-‘E’.
4. The step by step procedure followed as per the new Cadre Allocation
Policy of DOP&T, which is being followed for the first time, has been
outlined in para.5 (p.26/N). Accordingly, the procedure followed in
allocating insider vacancies as per para-8(i) of the Cadre Allocation Policy
and the result thereof may be seen in para-6(p.27/N). It may be seen that
out of 42 insider vacancies, 26 candidates (17 General category, 7 OBC
category, 1 SC and 1 ST) have been allocated to their home State as per
para-8(i) of the Cadre Allocation Policy.
5. Under para-9 of the Cadre Allocation Policy, only one candidate
could be given the benefit of being allotted an insider vacancy. It may be
seen that there are 3 candidates belonging to the OBC category who have
been selected on general merit as per policy but only one could be given
the benefit under para-9 of the Cadre Allocation Policy. These 3 candidates
are: (i) Shri Manjunath H, (ii) Shri Ajay Kumar Sahni, and (iii) Shri Rathod
Amit Kumar Bharat. Their cases have been explained in para-7 of the note
on pp.28-29/N. It may be seen that out of these three candidates only Shri
Ajay Kumar Sahni has been allocated to his home cadre as per policy and
Shri Manjunath H and Shri Rathod Amit Kumar Bharat have not been
allotted their home cadre in keeping with the provisions of the Cadre
Allocation Policy. The case of Shri Rathod Amit Kumar Bharat, who is
in a disadvantageous position because of being considered on General
merit instead of OBC category to which he belongs was referred to
DoPT, who have advised as per Flag-‘G’ (linked file) that the cadre
allocation proposed by MHA is as per policy and should be followed.
6. The cadre allocation made as per clause 7 (d) of the Cadre Allocation
Policy has been discussed in para-7(a) on pp.29-30/N. Similarly, the cadre
allocation made as per the provisions of clause 7(a) and 7(c) of the Cadre
Allocation Policy may be seen at para-8 and para-9.
7. The details of the unfilled vacancies of insider candidates may be
seen in para-10, according to which, out of 42 insider vacancies, 35 have
been filled.
8. The procedure according to which the outsider vacancies have been
filled and cadre allocation is made under Rule 8 (ii) and (iii) has been
discussed in para-13, 14 & 15 of the note on pp.32-33/N.
9. As per the above system of cadre allocation 122 vacancies (35
insider + 87 outsider) have been filled and 8 vacancies have remained

10. Accordingly, the cadre allocation of 122 candidates finalized as per
the Cadre Allocation Policy of DoPT as in para-17 (pp.34-37/N) ante is
submitted for approval of HM.
