State Authority on Bathroom Policies

This bill aims to protect the authority of states and local governments to enact and enforce policies regarding the use of sex-segregated bathrooms and locker rooms in educational institutions based on gender identity. It specifies that it would not be unlawful under federal law, including Title IX, for states or local governments to enact such policies. SECTION 1. SHORT TITLE.

This Act may be cited as the Prohibiting the Usur-

5 pation of Bathroom Laws through Independent Choice

SEC. 2. STATE AND LOCAL AUTHORITY REGARDING SEX-

SEGREGATED

REGATED LOCKER ROOMS OF EDUCATIONAL

INSTITUTIONS.

BATHROOMS

SEX-SEG-

It shall not be unlawful under any Federal law (in-

6 cluding title IX of the Education Amendments of 1972)


7 for a State, or local government of a State, to enact or
8 enforce a policy regarding the use of sex-segregated bath9 rooms, or sex-segregated locker rooms, of educational in10 stitutions on the basis of gender identity. Federal financial
11 assistance may not be reduced or denied on the basis that
12 a State, or local government of a State, enacts or enforces
13 a policy regarding the use of sex-segregated bathrooms,
14 or sex-segregated locker rooms, of an educational institu15 tion on the basis of gender identity.

SEC. 3. DEFINITION.

For purposes of this Act, the term gender identity

18 shall have the meaning given it in section 249 of title 18


19 of the United States Code.
