Privacy Policy

We understand that protecting your personal information is important. This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or otherwise collected by us, offline or online, including through our services and website (Services). In this Privacy Policy we, us or our means Raisely Pty Ltd ABN 49 124 507 062.

Individuals located in the European Union (EU) may also have rights under the General Data Protection Regulation 2016/679 (GDPR) and individuals located in the United Kingdom (UK) may have rights under the General Data Protection Regulation (EU) 2016/679) (UK GDPR) and the Data Protection Act 2018 (DPA 2018) (together, the GDPR). Appendix 1 outlines the details of the additional rights of individuals located in the EU and UK as well as information on how we process the personal information of individuals located in the EU and UK where we are a controller, or when we have agreed to act as a processor in accordance with the GDPR.

Personal information

The types of personal information we collect about our customers who use Raisely include:

  • your name;
  • the name of your organisation and your job title;
  • your contact details, including email address, mailing address, street address and/or telephone number;
  • your payment details (through our third party payment processor – we do not have access to payment details stored by the payment processor);
  • details of products and Services we have provided to you and/or that you have enquired about, and our response to you;
  • your preferences and/or opinions;
  • profile data including your username and password for support requests you have made, content you post, send receive and share through our platform/Services, information you have shared with our social media platforms, feedback and survey responses;
  • interaction data including information you provide to us when you participate in any interactive features of our Services, including webinars, surveys, contests, promotions, activities or events;
  • marketing and communications data including your preferences in receiving marketing from us and our third parties and your communication preferences; and
  • any other personal information requested by us and/or provided by you or a third party.

When using our website, the types of personal information we may collect about you include:

  • your browser session and geo-location data, device and network information, computer identifiers, IP address, access logs, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour;
  • information about your access and use of our Services, including through the use of Internet cookies, your communications with our online Services, the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider; and
  • additional personal information that you provide to us, directly or indirectly, through your use of our Services, associated applications, associated social media platforms and/or accounts from which you permit us to collect information.

Where you are a donor, website visitor or newsletter subscriber to one of our customers who uses Raisely, we may receive the following information about you:

  • your name;
  • your contact details, including email address, mailing address, street address and/or telephone number;
  • your payment details (through our third party payment processor);
  • your age and/or date of birth;
  • your preferences and/or opinions;
  • details of products and Services we have provided to you and/or that you have enquired about, and our response to you;
  • any donation or contribution made by you to our customers;
  • if you make a donation to one of our customers using social media platforms including Facebook, this may include your name, email address, profile picture and any other personal information you choose to share; and
  • your browser session and geo-location data, device and network information, computer identifiers, IP address, access logs, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour.

We may collect personal information directly from you or from third parties.

Collection and use of personal information

We may collect, hold, use and disclose personal information for the following purposes:

  • to enable you to access and use our Services, associated applications and associated social media platforms;
  • to contact and communicate with you;
  • for internal record keeping, administrative purposes, invoicing and billing purposes;
  • for analytics, market research and business development, including to operate and improve our Services, associated applications and associated social media platforms;
  • to run promotions, competitions and/or offer additional benefits to you;
  • if you are our client, to send you promotional information about our products and Services and information that we consider may be of interest to you;
  • to comply with our legal obligations and resolve any disputes that we may have;
  • if you have applied for employment with us, to consider your employment application; and
  • if otherwise required or authorised by law;

(collectively, Our Purposes).

Unsolicited Personal Information

Unsolicited personal information is personal information that we receive from you but have not requested or taken active steps to collect.

Unsolicited information obtained by us will only be held, used and/or disclosed if it is considered personal information that we could have collected in the course of our normal collection processes for Our Purposes (as set out above). This information will be held, used and or disclosed in accordance with this Privacy Policy.

If the unsolicited information is not reasonably necessary or related to the performance of Our Purposes, we will destroy or de-identify your personal information as soon as reasonably practicable if it is lawful to do so.

Disclosure of personal information to third parties

We may disclose personal information to:

  • third party service providers for the purpose of enabling them to provide their services, including (without limitation) software tool providers, CRM tool providers, error reporting tool providers, customer support and messaging providers, IT service providers, data storage, web-hosting and server providers, debt collectors, maintenance or problem-solving providers, marketing or advertising providers, professional advisors and payment systems operators;
  • our employees, contractors and/or related entities;
  • our existing or potential agents or business partners;
  • sponsors or promoters of any promotions or competition we run;
  • anyone to whom our business or assets (or any part of them) are, or may (in good faith) be, transferred;
  • if you are our client, courts, tribunals and regulatory authorities, in the event you fail to pay for goods or Services we have provided to you;
  • courts, tribunals, regulatory authorities and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
  • third parties, including agents or sub-contractors, who assist us in providing information, products, services or direct marketing to you. This may include parties located, or that store data, overseas; and
  • third parties to collect and process data, such as Google Analytics. This may include parties that store data overseas.

Google Analytics: We may enable Google Analytics Advertising Features including Remarketing Features, Advertising Reporting Features, Demographics and Interest Reports, Store Visits, Google Display Network Impression reporting. We and third-party vendors may use first-party identifier. To learn more about limiting ad tracking using this identifier, visit the settings menu on your device. cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as Google advertising cookies) or other third-party identifiers together. 

You can opt-out of Google Analytics Advertising Features including using a Google Analytics Opt-out Browser add-on found here. To opt-out of personalised ad delivery on the Google content network, please visit Google’s Ads Preferences Manager here or if you wish to opt-out permanently even when all cookies are deleted from your browser you can install their plugin here. To opt out of interest-based ads on mobile devices, please follow these instructions for your mobile device: On android open the Google Settings app on your device and select “ads” to control the settings. On iOS devices with iOS 6 and above use Apple’s advertising identifier. To learn more about limiting ad tracking using this identifier, visit the settings menu on your device.

Disclosure Overseas

We may store personal information in Australia, the United Kingdom, or the United States of America. Where we disclose your personal information to the third parties listed above, these third parties may also store, transfer or access personal information overseas. We will only disclose your personal information overseas in accordance with the applicable laws.

Our commitment to you

Your personal information will:

  • be processed lawfully, fairly and in a transparent manner by us;
  • only be collected for the specific purposes we have identified in the ‘collection and use of personal information’ clause above and personal information will not be further processed in a manner that is incompatible with the purposes we have identified;
  • be collected in a way that is adequate, relevant and limited to what is necessary in relation to the purpose for which the personal information is processed;
  • be kept up to date, where it is possible and within our control to do so (please let us know if you would like us to correct any of your personal information);
  • be kept in a form which permits us to identify you, but only for so long as necessary for the purposes for which the personal information was collected; and
  • be processed securely and in a way that protects against unauthorised or unlawful processing and against accidental loss, destruction or damage.

Your rights and controlling your personal information

Your choice: Please read this Privacy Policy carefully. If you provide personal information to us, you understand we will collect, hold, use and disclose your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it may affect our ability to provide our Services to you and your use of our Services.


Information from third parties:
If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.
Anonymity: Where practicable we will give you the option of not identifying yourself or using a pseudonym in your dealings with us.


Restrict and unsubscribe:
To object to processing for direct marketing/unsubscribe from our email database or opt-out of communications (including marketing communications), please contact us using the details below or opt-out using the opt-out facilities provided in the communication.


Access:
You may request access to the personal information that we hold about you. An administrative fee may be payable for the provision of such information. Please note, in some situations, we may be legally permitted to withhold access to your personal information. If we cannot provide access to your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal. If we can provide access to your information in another form that still meets your needs, then we will take reasonable steps to give you such access.


Correction:
If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to promptly correct any information found to be inaccurate, incomplete, irrelevant, misleading or out of date. Please note, in some situations, we may be legally permitted to not correct your personal information. If we cannot correct your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal.


Complaints:
If you wish to make a complaint, please contact us using the details below and provide us with full details of the complaint. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take in response to your complaint. You also have the right to contact the relevant privacy authority.

Storage and security

We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures, to safeguard and secure personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

While we are committed to security, we cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk.

Cookies and web beacons

We may use cookies on our online Services from time to time. Cookies are text files placed in your computer's browser to store your preferences. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they do allow third parties, such as Google and Facebook, to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide our website with personal information, this information may be linked to the data stored in the cookie.

You can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our website.

Links to other websites

Our Services may contain links to other websites. We do not have any control over those websites and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy.

Personal information from social network accounts

If you connect your account with us to a social network account, such as Google, we will collect your personal information from the social network. We will do this in accordance with the privacy settings you have chosen on that social network.


The personal information that we may receive includes your name, email address, profile picture and any other personal information you choose to share.

Amendments

We may, at any time and at our discretion, vary this Privacy Policy. We will notify you if we amend this Privacy Policy, by contacting you through the contact details you have provided to us. Any amended Privacy Policy is effective once we notify you of the change.

Data Deletion

As an individual you have a right to request Raisely to delete data held on you. If you would like Raisely to delete any personal information stored about you, you should email [email protected] with the following details:

  • Your email addresses (if you have multiple) and your full name
  • What information you'd like removed (or all of it)

Our Data Removal process

Generally Raisely is holding your personal information on behalf of one of our customers.

  1. First, we will verify your request and may request additional information from you to verify your identity – especially if the email address you want removed isn't the one you're emailing from.
  2. Then, we will pass your data deletion request onto any Raisely customer who holds data on you based on your email address with instructions on how they can delete your personal information.
  3. If we do not hear back from a Raisely customer within 14 days, we will process the data deletion request on their behalf and inform them of that decision.

Appendix 1 - Additional Rights for Individuals Located in the EU or UK

Under the GDPR individuals located in the EU and the UK have extra rights which apply to their personal information. Personal information under the GDPR is often referred to as personal data and is defined as information relating to an identified or identifiable natural person (individual).

This Appendix sets out the additional rights we give to individuals located in the EU and the UK, including how we process personal information lawfully, transparently and fairly, and how we work with customers as a processor where asked to do so and where we agree to do so, and how we operate as a controller in certain circumstances. Please read the Privacy Policy above and this Appendix carefully and contact us at the details at the end of the Privacy Policy if you have any questions.

What personal information is relevant?
This Appendix applies to the personal information set out in the Privacy Policy above. This includes any sensitive information also listed in the Privacy Policy above which is known as ‘special categories of data’ under the GDPR.

How we process personal information
If we are acting as a processor, we are handling information solely on the instructions of the controller. If we have agreed to act as a processor and we have received your personal information from one of our charity clients, this charity is in control of that information. To understand how this charity processes your personal information, please contact the charity.

When acting as a controller, we will process your personal information for our legitimate interest to allow you to access and use our website, to send you marketing content we think may be of interest to you, to contact you if you leave your contact details with us or if you otherwise initiate contact with us.

We will rely on performing a contract to process your personal information where we are preparing to enter into a contract with you or we are carrying out our obligations under a contract with you.

We will rely on a legal obligation to process your personal information where we are subject to a legal obligation.

If we need to rely on consent, we will ask for consent to process any of your personal information for that specific purpose before we process your personal information for that reason. If you are under 16 years of age, we will seek your parent or legal guardian’s consent to process your personal information for that specific purpose.

Upon written request, we may provide you with a list of the third parties we use to process your personal information.


Data Retention
We will only retain your personal information for the duration of our processing activities we are carrying out on behalf of the relevant client or as long as necessary for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information, whether we can achieve those purposes through other means and the applicable legal requirements.

In some circumstances we may anonymise your personal information (so that it can no longer be associated with you) for analytics, research or statistical purposes in which case we may use this anonymised information indefinitely without further notice to you.


Data Transfers
The countries to which we send data for the purposes listed above may not have the same data protection laws as the country in which you initially provided the information. If we transfer your personal information to third parties in other countries and if required by the controller: (i) we will perform those transfers in accordance with the requirements of applicable law; and (ii) we will protect the transferred personal information in accordance with the Privacy Policy, as supplemented by this Appendix.


This includes:

  • only transferring your personal information to countries that have been deemed by applicable data protection laws to provide an adequate level of protection for personal information; or
  • including standard contractual clauses in our agreements with third parties that are overseas.

Extra rights for EU individuals
You may request details of the personal information that we hold about you and how we are process it (commonly known as a “data subject request”). You may also have a right in accordance with applicable data protection law to have your personal information rectified or deleted, to restrict our processing of that information, to object to decisions being made based on automated processing where the decision will produce a legal effect or a similarly significant effect on you, to stop unauthorised transfers of your personal information to a third party and, in some circumstances, to have personal information relating to you transferred to you or another organisation.

If your information has been provided to us as a donor or supporter of one of our customers, to exercise any rights you may have under the GDPR, please contact the relevant customer. You may ask them to stop processing your information, restrict the processing of your information, allow you to access, erase or port your information, or rectify any of your information. We will provide reasonable assistance to the controller where we have agreed to act as a processor and where requested to do so.

If you are not happy with how we are processing your personal information, you have the right to make a complaint at any time to the relevant Data Protection Authority based on where you live. We would, however, appreciate the chance to deal with your concerns before you approach the Data Protection Authority, so please contact us in the first instance.
