These Terms of Service ("Terms") govern use of the websites, online community, services, and member resources operated by the Klingon Language Institute ("KLI," "we," "us," or "our").
The Klingon Language Institute is a nonprofit organization dedicated to the scholarly study, teaching, development, and promotion of the Klingon language.
Use of the KLI website and membership in the Klingon Language Institute are related but distinct.
A person may be a member of the KLI without maintaining or using an account on the KLI website. Likewise, some portions of the website may be available to registered users who are not paid members of the organization.
These Terms govern use of the website and online services and, where applicable, memberships purchased through the website.
Users may create an account to participate in available areas of the KLI website.
Account holders are responsible for:
Accounts may not be used to impersonate another person, misrepresent an affiliation, disrupt the website, or violate these Terms.
Creating a website account does not, by itself, make a person a paid member of the Klingon Language Institute.
The KLI may offer free Guest accounts.
Guest accounts provide limited access to the website and online community. The features available to Guests may change from time to time.
Guest accounts do not constitute paid membership in the Klingon Language Institute.
The KLI may offer membership for various terms, including:
All paid membership levels currently provide the same general level of member access to online KLI resources. The length of the membership term differs according to the membership purchased.
Member benefits may include access to member-only portions of the website and resources such as courses, electronic publications, magazines, fonts, testing programs, online community permissions, and other materials or services made available by the KLI.
Specific benefits may be added, changed, replaced, or discontinued over time as the organization's programs and resources evolve.
Membership does not guarantee that every current website feature or resource will remain available throughout the membership term.
KLI membership exists independently of the KLI website.
Members may join or renew through methods other than the website, including methods authorized by the KLI such as payment by mail.
A member is not required to maintain an active website account in order to remain a member of the organization.
Likewise, deletion, suspension, or non-use of a website account does not automatically terminate an individual's organizational membership.
Members who joined before the creation of the current website, including lifetime members, retain their membership status according to the KLI's membership records.
Website access associated with membership may require the member to create an account and provide sufficient information for the KLI to match that account with its membership records.
Fixed-term memberships begin when the membership is activated and continue for the period purchased.
Unless expressly stated otherwise at the time of purchase:
KLI memberships do not automatically renew and no additional membership fee will be charged without the member taking affirmative action to renew or purchase another membership.
At the end of a fixed membership term, paid member benefits may end unless the membership is renewed.
Lifetime membership does not expire during the lifetime of the individual member.
Lifetime membership is personal to the member and is not transferable or inheritable unless the KLI expressly provides otherwise.
Membership fees support the activities and programs of the Klingon Language Institute.
Fees paid for one-year memberships are generally nonrefundable once the membership has been activated, except in cases of duplicate charges, payment errors, or other circumstances approved by the KLI.
A person purchasing a membership with a term longer than one year, including a lifetime membership, may request cancellation and a full refund within 30 days of the original purchase date.
After 30 days, membership fees are nonrefundable.
No prorated refund will be provided for unused years or unused portions of a membership after the 30-day refund period.
A member who chooses to stop participating in the KLI, stops using the website, deletes a website account, or otherwise chooses not to use available membership benefits is not entitled to a refund for the unused portion of the membership.
Refund requests should be submitted via the contact us page.
Nothing in this policy limits any refund or cancellation right that cannot legally be waived.
The KLI may offer gift memberships.
A gift membership is intended for another individual and becomes associated with the recipient when activated or recorded by the KLI.
Refund requests for unredeemed gift memberships may be considered according to the refund policy applicable to the membership purchased.
Once a gift membership has been redeemed or assigned to a recipient, any refund request may require the agreement of both the purchaser and the KLI.
Certain materials may be made available only to current KLI members.
Unless otherwise stated, member access is for the member's personal, noncommercial use.
Membership does not transfer ownership of KLI publications, courses, fonts, software, archives, or other intellectual property.
Members may not redistribute, sell, publicly republish, or provide unauthorized access to member-only materials except where expressly permitted by the KLI or by the applicable license governing the material.
Users participating in KLI forums, activity feeds, groups, messages, comments, Discord communities, or other interactive services must behave in a manner consistent with a scholarly and community-oriented organization.
Users may not:
The KLI may moderate, restrict, or remove content and may suspend or terminate website access when reasonably necessary to protect the organization, its users, or its services.
The KLI may suspend or terminate a website account for violation of these Terms, abuse of KLI services, security concerns, or other serious misconduct.
Suspension or termination of a website account does not necessarily terminate the person's membership in the Klingon Language Institute.
Similarly, matters concerning suspension, termination, resignation, or other changes to membership in the organization may be governed separately by the KLI's bylaws, policies, or decisions of its authorized officers or governing body.
Loss of website privileges because of misconduct does not automatically entitle a member to a refund of membership fees.
Users may be able to submit posts, comments, messages, images, files, or other material ("User Content").
Users retain ownership of content they create.
By posting User Content to portions of the site intended to be viewed or shared with others, the user grants the KLI a nonexclusive license to host, store, reproduce, display, and technically process that content as reasonably necessary to operate and provide the website and community services.
Users are responsible for ensuring that they have the right to post the content they submit.
The KLI may remove User Content that violates these Terms or applicable law.
Unless otherwise stated, the KLI owns or has permission to use the content presented through its website, including its original text, publications, course materials, software, graphics, logos, and other materials.
Third-party trademarks, copyrighted works, fictional properties, and other intellectual property remain the property of their respective owners.
The Klingon Language Institute is an independent nonprofit organization. Any appropriate disclaimer concerning Star Trek, Klingon, Paramount, CBS, or other rights holders should be stated here or in the site footer using the wording approved by the KLI.
Nothing in these Terms grants users ownership of any KLI or third-party intellectual property.
The KLI is operated as a nonprofit organization and relies substantially on volunteers and limited organizational resources.
We do not guarantee uninterrupted or error-free access to the website.
The KLI may:
Temporary or permanent changes to a particular website feature do not ordinarily entitle members to a refund.
The website may link to or integrate with services operated by third parties, including payment processors, social platforms, Discord, video services, or other external websites.
Those services are governed by their own terms and privacy practices.
The KLI is not responsible for the operation or content of unaffiliated third-party services.
The KLI's collection and use of personal information is described in its Privacy Policy, which should be read together with these Terms.
The website, community services, educational materials, and other online resources are provided on an "as is" and "as available" basis to the fullest extent permitted by law.
The KLI does not guarantee that the website will always be available, that all information will be error-free, or that particular resources or features will remain available indefinitely.
Nothing provided through the website constitutes professional legal, medical, financial, or other regulated professional advice.
To the fullest extent permitted by applicable law, the Klingon Language Institute and its officers, directors, volunteers, agents, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the website or online services.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
The KLI may update these Terms from time to time.
Material changes affecting existing paid memberships will not retroactively shorten the purchased membership term or eliminate membership status already granted except where required by law or necessary to address serious misconduct.
Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms as they relate to continued website use.
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any legal dispute concerning these Terms will be subject to the jurisdiction of courts with appropriate authority in Kentucky, except where applicable law provides otherwise.
Questions about these Terms, memberships, cancellations, or refunds may submitted via the contact us page.
