
Last Thursday, as reproductive rights advocates across the country were breathing a sigh of relief due to SCOTUS’ belated decision to maintain telehealth access to mifepristone, we got some heartbreaking news in Indiana:
The Indiana Supreme Court refused to hear a legal challenge showing that the so-called health “exception” to Indiana’s abortion ban violates the undisputed right to abortion under the Indiana Constitution when a patient needs an abortion to avoid a serious health risk. Sadly, this concludes the case and marks the end of a 4 year fight to ensure all Hoosiers have access to safe and legal abortion care at home.
Indiana has been largely ignored in the national conversation about abortion access, despite ranking as one of the most restrictive states for abortion.
In 2022, Indiana was the first state to introduce new legislation to ban abortion after the Supreme Court overturned Roe v. Wade. As the home of Indiana’s first and only abortion fund, we quickly took action and joined a lawsuit, alongside our partners at Planned Parenthood and the ACLU of Indiana, to challenge this cruel legislation. And in 2023 we participated in a filing to broaden the scope of the near-total abortion ban’s narrow health or life “exception.”
The Indiana Supreme Court’s decision last week means that many Indiana residents will still be required to leave their homes for the healthcare they need, indefinitely.
While we’re extremely disappointed in the outcome of our court case, we remain steadfast in our commitment to Hoosier abortion access! The All-Options Hoosier Abortion Fund will continue to provide logistical, emotional, and financial support to callers who reach out to us! We serve a pivotal role for pregnant Hoosiers seeking abortion care. The resources we provide are a literal life line for our callers and we are working hard to maintain high levels of abortion funding.
