Bu calisma okuyucuya, medeniyetlerin besigi unvanini tasiyan Mezopotamya’da ortaya cikan, Kitab-i Mukaddes ogretilerinden ikisinin, komsuluk uzerinden orneklerini sunmayi amaclamaktadir. Konuyla ilgili, prensip ile pratigin, ideal ile uygulamanin tarihsel yansimalarinin tahlili de yapilacaktir. Son tahlilde makale, basarisizligin insanin idealinde degil zaafiyetlerinde oldugunu gostermeyi amaclamaktadir. Zaafiyetlerin giderilmesi ideale ulasmayi mumkun kilacaktir.

In the public administration literature, the debate concerning the representation of minorities in the public bureaucracy continues to attract attention. The idea is that passive representation may lead to active representation with the later helping to develop policies and programs that will benefit minorities. Consequently, a number of governments have been implementing policies to enhance the involvement of minorities in public services. The Ghana government has not been left out in this endeavor. Since 1957, it has continued to institute measures to ensure a fair gender representation in the bureaucracy. This notwithstanding, the upper echelons of the bureaucracy continue to be dominated by males despite the over representation of women at the lower levels. What are the challenges confronting women in the public sector that make it difficult to achieve active representation? In this article, we examine the challenges confronting women to achieve active representation from a representative bureaucracy perspective.

The purpose of this article is to assess the critical components of an internal control system that need to be considered when designing an internal control system at the local sphere of government. This article argues that internal control is deeply rooted in the processes set to provide reasonable assurances that the needs of society will be met effectively while complying with applicable laws. Further, this article maintains that an internal control system comprises of the control environment, risk assessment, control mechanisms, information and communication, and monitoring. To comprehend the importance of an internal control system at the local sphere of government, the Driving Licence Testing Centre of the Madibeng Local Municipality is used as the case under study and specifically the issuing of driving licences. However, the problem is that despite the importance of the components of an internal control system, the effective and efficient application thereof is lacking at the Driving Licence Testing Centre of the Madibeng Local Municipality. A qualitative research design was followed and mixed data gathering instruments were used to answer the research question: 'Which components need to be considered when designing an internal control system for the Driving Licence Testing Centre of the Madibeng Local Municipality?'. In addition to the literature review, the empirical findings validated the components needed to be considered. The article concludes that although the existing internal control system of the Driving Licence Testing Centre of the Madibeng Local Municipality has benefits, it is often faced with challenges and features that may affect it negatively.

Driving Licence Testing Centres located in local and metropolitan municipalities in South Africa generally lack standard operating procedures according to which driving licences are issued. This has serious implications for road safety in general and organisational efficiency in particular. This article aims to design a framework for the development of standard operating procedures according to which driving licences should be issued. The Driving Licence Testing Centre of the Madibeng Local Municipality was used as case study for this purpose. Specific recommendations are presented to the Madibeng Local Municipality on how to effectively design and review standardised procedures. The systems theory and the ADDIE (an acronym for Analyse, Design, Develop, Implement and Evaluate) instructional design model served as theoretical parameters to gain understanding of the nature and application of standard operating procedures in the public sector. A qualitative research design was followed and mixed methods were used to collect data. In addition to the robust literature review, the empirical findings validated the synergy between systems theory and the ADDIE instructional design model for the design of a standard operating procedures framework. The meticulous implementation of this framework could ensure that driving licences are issued as per statutory prescripts and road traffic specifications.

Although public agencies have existed for several decades, in Serbia, they are new forms of government bodies. The aspiration to modernize the public administration and harmonize it with modern trends can be an opportunity to see the stages of development and models of control and autonomy of the agency from the decades-long development of Swedish public agencies. The example of Croatia will show the potential of the former socialist state for such reforms and how important reforms are on the road to the European Union in the XXI century. Through the analysis of relevant literature and a comparative method, there are presented the reforms of public agencies being implemented in selected countries since their first appearance till nowadays. Çalışmamızın konusunu 6102 sayılı Türk Ticaret Kanunu ile bir yenilik olarak getirilen pay sahibinin genel kurulda kitlesel (toplu) temsilciler aracılığıyla katılması oluşturmaktadır. Çalışmamızda özelikle kitlesel (toplu) temsilcilerden organın temsilcisi ve bağımsız temsilci incelenmiştir. Organın temsilcisi, şirket tarafından önerilen, şirketle herhangi bir şekilde ilişkisi bulunan bir kişidir. Bu kişi, kendisine temsil yetkisi veren pay sahipleri adına genel kurulda oy kullanıp gerekli diğer işlemleri yapabilir. Organın temsilcisinin şirket tarafından esas sözleşme hükmüne göre ilan edilmesi ve internet sitesine konularak pay sahiplerine bildirilmesi zorunludur. Organın temsilcisi tavsiye eden şirketin aynı zamanda bir bağımsız temsilci göstermesi gerekmektedir. Bağımsız temsilcinin, şirketten tamamen bağımsız ve tarafsız diğer bir kişi olması gerekir. Bağımsız temsilci organın temsilcisinin alternatifi ni oluşturur. Organın temsilcisi ve bağımsız temsilci, genel kurulda oylarını hangi yönde kullanacaklarını, gerekçeleriyle birlikte açıklayan bildirgeler yayınlamakla yükümlüdürler. Bu bildirgelerde yer alan bilgiler, pay sahibinin temsilciye talimatı niteliği taşır. Organın temsilcisi ve bağımsız temsilci temsil edecekleri payların sayısını, çeşidini, itibari değerini ve gruplarını şirkete bildirmekle yükümlüdürler.

Kişilerin ve/veya faaliyetlerin kontrol edilmesi ihtiyacından doğan denetim olgusunun geçmişi günümüzden binlerce yıl öncesine kadar geri götürülebilir. Daha çok yönetim bilimine ilişkin bir faaliyet olarak gelişen denetim, yönetimin temel unsurlarından biridir. Hatta diğer tüm unsurlar ancak denetim ile anlam kazanabilmektedir. Denetimin kamuya ilişkin olanının başlangıcı ise demokrasinin doğuşu ile eş zamanlıdır. İngiltere’de Parlamento tarafından, halktan toplanan vergilerin halk adına takip ve kontrol edilmeye başlaması ile birlikte denetim ilk kez bugünkü anlamıyla kamu yönetimi alanında da uygulanmaya başlamıştır. Yönetim biliminde uygulanan denetim teknikleri süreç içerisinde demokratik devlet yönetim sistemlerinin denetimine ilişkin uygulamalara da ışık tutmuş, zamanla denetim kamu yönetiminin önemli bir unsuru haline gelmiştir.

Gelinen noktada kamuda denetimin amacı, toplumsal bir mutabakatla oluşturulan devlet teşkilatının yürütmeye ilişkin organı olan kamu yönetimi içerisindeki faaliyetlerin daha önceden belirlenmiş kurallara, kurumsal hedef ve amaçlara uygun, eksiksiz ve kesintisiz şekilde işlemesini sağlamaktır. Bunun yanında denetim sürecinde elde edilen tespitlere istinaden yapılan geri bildirimler sayesinde varsa aksaklık ve hatalara karşı gerekli tedbirler alınabilmekte, böylece denetim kamu kurumlarının işleyişindeki performansı artırmada etkin bir araç olarak kullanılabilmektedir.

Kamu yönetiminin denetimine ilişkin çok çeşitli modeller bulunmaktadır. Bunlar arasında siyasi, idari ve yargı denetimi adeta klasikleşen denetim türleridir. Ancak 20. yüzyılın son çeyreğinde başlayan kamusal hizmetten kamu işletmeciliğine giden değişim ve dönüşümle birlikte bir yandan mevcut denetim mekanizmaları kendilerini güncellerken diğer yandan daha basit ve pratik, ancak oldukça etkili olabilen yeni denetim modelleri ortaya çıkmıştır. Bunlar her ülkenin kendi kamu yönetimi yapısı içerisinde küçük farklılıklar göstermekle birlikte Türkiye gibi birçok demokratik ülkede yönetimin önemli ve gerekli bir unsuru olarak etkili şekilde uygulama alanı bulabilmektedir. Bu bağlamda Türk kamu yönetiminde klasik denetim mekanizmalarının yanında değişen doktrinlere ve yönetim yapılarına göre ortaya çıkan ve kendisini güncelleyerek varlığını devam ettirmeye çalışan denetim türlerini kapsayan bütüncül bir eser oluşturma gayreti ile hazırlanan bu kitap, on bir bölümden oluşmaktadır.

Eserin ilk bölümünde yönetim anlayışında yaşanan gelişmeler dikkate alınmak suretiyle Türkiye’de siyasi denetim merkez ve yerel boyutuyla değerlendirilmektedir. Kamu yönetimi anlayışında yaşanan gelişmeler Türkiye’de iç dinamiklerle birleşerek 21. yüzyılda adeta reform rüzgârlarına dönüşmüş, bu süreçte yerel yönetimler merkezi idare karşısında görev ve yetki açısından oldukça güçlü kurumlar haline gelmiştir. 2018 yılında uygulamaya geçen Cumhurbaşkanlığı hükümet sistemi ise bu dönüşümün önemli bir çıktısı haline gelmiştir. Bu noktadan hareketle ikinci bölümde hükümet sistemindeki değişimle birlikte merkezi idarenin yerel yönetimler üzerindeki vesayet denetimine ilişkin mevcut durum belediyeler özelinde incelenmektedir. Siyasi ve idari denetimin ardından üçüncü bölüm en önemli denetim türlerinden biri olan yargı denetimine ayrılmıştır. Hukuk devleti ilkesinin bir gereği olan ve kökeni Osmanlı Devletine kadar geriye giden yargı denetiminin idareye ilişkin alanını oluşturan idari denetimde görevli mahkemeler ve idari yargılama usulleri, güncel yargı kararlarına da değinilerek bu bölümde ayrıntılı olarak incelenmektedir.

Sayıştay denetimi kimi kaynaklarda siyasi, idari ve yargı denetimi ile birlikte klasik denetim türleri arasında sayılırken kimi kaynaklarda yeni bir denetim türü olarak kabul etmektedir. Asıl ve kesin olan ise Sayıştay denetiminin kamu denetim türleri arasındaki önemidir. Sayıştay denetimine odaklanılan dördüncü bölümde Osmanlı Devletinden bir miras olarak Cumhuriyet’e intikal eden ve 1982 Anayasası’nda bir mahkeme ve yüksek denetim organı olarak yer alan Türk Sayıştay’ının görevleri, fonksiyonları, Anayasa’daki durumu, niteliği, mahkeme olarak nasıl konumlandığı, kapsama alanı, yapılan denetimlerin amacı ve esasları ile raporlama ve yargılama süreçleri ayrıntılı şekilde ele alınmaktadır.

21. yüzyılın çağdaş denetim türlerinden biri de kökeni kimi kaynaklarda İsveç’e kimilerinde ise Osmanlı’ya dayandırılan ve İkinci Dünya Savaşı sonrası dünya genelinde uygulanmaya başlanan ombudsman denetimidir. Beşinci bölümde Kamu Denetçiliği Kurumu ile uyuşmazlıkların çözümünde bir diğer alternatif olan Arabuluculuk Kurumunun gelişimi ve bu iki kurum arasındaki farklar incelenmektedir.

Eserin altıncı bölümünde kamu yönetiminde performans denetiminin gelişimine, farklı ülkelerin bu kapsamdaki tecrübeleri ile performans denetimine ilişkin uygulamada karşılaşılan güçlüklere yer verilmektedir.

Klasik kamu yönetimi anlayışının uzun süre hâkim olduğu Türkiye’de teftiş kurullarının tarihi, özellikle 2000’li yıllarla birlikte yaşadığı dönüşüm ile Cumhurbaşkanlığı hükümet sistemine geçişle birlikte gelinen noktadaki durumu ve geleceği eserin yedinci bölümünde incelenmektedir.

Kamu yönetimi doktrininde yaşanan gelişmelere paralel kamunun özel sektörden örnek aldığı önemli yönetim ve denetim modelleri bulunmaktadır. Bunlardan biri de iç denetimdir. Sekizinci bölümde örnek bir iç denetim uygulaması ile sistemin kamu yönetimindeki yerine ve işleyişine ilişkin değerlendirmeler yapılmaktadır. Bir öz değerlendirme modeli olarak da uygulanan iç kontrol sisteminin kurumsal yönetime sağlayacağı katkılar ise eserin dokuzuncu bölümünde incelenmektedir.

Türkiye’deki bağımsız düzenleyici ve denetleyici kuruluşların varlıkları, etkinlikleri ve yaptırım düzeyleri ise eserin onuncu bölümünde değerlendirilmektedir. Yeni kamu yönetimi anlayışı ile birlikte kamuda etkin olarak kullanılmaya başlanan denetim türlerinden bir diğeri ise kamuoyu denetimidir. Eserin son bölümünde kamuoyunun denetleyici rolüne ve etkilerine açıklık getirilmektedir.

Denetim türlerini farklı açılardan güncel boyutlarıyla ve bütüncül bir şekilde ele alan bu eser, merkezi ve yerel düzeydeki tüm kamu kurum ve kuruluşlarının her kademesinde görevli kamu yöneticilerine, bu alanda akademik çalışmalar yürüten araştırmacılara, pek tabi bu ve benzeri eserlerden elde edecekleri faydalar ile çok daha iyilerini ortaya koyacak olan çok kıymetli öğrencilerimize katkı sunacaktır.

Les premieres lois de decentralisation francaise, parues au debut des annees quatre-vingt, sont ici apprehendees du point de vue de hauts fonctionnaires qui les ont (mal) vecues. Percues comme un desaveu par les ingenieurs des Ponts et Chaussees, elles marquent pour eux − et selon eux − un tournant synonyme de declin, de perte de prestige, et d’incertitudes identitaires. Les formes prises par les recits de ce « desenchantement » viennent neanmoins rappeler la legitimite historique de ce corps et de sa « tutelle », le ministere de l’Equipement. Ces recits agissent comme des (re)activateurs de legitimite face aux potentiels menaces qui pesent sur leur existence. Cette sombre perspective pour le corps est egalement mise en scene par les responsables du ministere a la meme epoque, qui tentent de faire du desarroi de ces agents une ressource mobilisatrice pour l’introduction de reformes manageriales censees sauver le corps du declin.

Dans un contexte de destabilisation du ministere de l'Equipement, une partie des ingenieurs des Ponts et Chaussees considere que servir l'interet general ne passe plus necessairement par le fait de servir l'Etat mais par le fait meme d'etre membre du corps. L'interet general s'apparenterait a une essence, un attribut des ingenieurs du corps dont ils seraient les depositaires, independamment de leur mission de service public. Ces hauts fonctionnaires pronent, en outre, une vision extensive de l'interet general assimilant l'activite des entreprises privees. La recherche du profit devenant compatible avec la poursuite de l'interet general, les ingenieurs des Ponts et Chaussees seraient de fait legitimes pour exercer dans le secteur prive. La eleccion del trabajo de investigacion fue motivada por el interes en conocer la gestion, eficiencia y control del sector publico empresarial en al Comunidad Autonoma de Andalucia desarrollado a partir de la entrada en vigor del Estatuto de Autonomia en 1981. Action publique, communication et management
Plusieurs phases de modernisation de l’action publique se succèdent en France depuis les années 2000. Révision générale des politiques publiques en 2007 puis Modernisation des politiques publiques en 2012, préfigurent une visée managériale d’un modèle sous l’emprise du Nouveau Management Public (NMP) depuis les années 1990.
Un renouvellement des institutions et organismes publics de l’État unitaire en France repose sur la recherche d’une plus grande efficacité et de résultat. L’évolution d’un modèle bureaucratique vers un modèle managérial où la communication convoque des acteurs publics et privés a des enjeux gestionnaires, d’actions et d’accompagnement des changements opérationnels. Cela implique la mise en place d’objectifs, d’indicateurs de performance, d’économies d’échelle, de fusions à l’instar des grandes entreprises et holdings.

У статті розглянуто наявні у зарубіжній науці емпіричні дослідження та методологію визначення ефективності роботи законодавчих органів. Проаналізовано та узагальнено критерії ефективності роботи законодавчих органів. Автор акцентує увагу на принциповій відмінності між поняттями ефективності роботи депутатів та законодавчого органу в цілому.

Özet Temsilcilik ve tahkim, yasal değişiklik olmadan kooperatifler yasası ihtiyari hükümleri çerçevesinde ana sözleşmelere konulabilecek kurumlardır. Bakanlıkça hazırlanan tip ana sözleşmelere bu kurumların eklenmesi, faaliyetteki kooperatiflerin ise ana sözleşme değişikliği yoluyla bu kurumları ana sözleşmelerine koymalarında fayda bulunmaktadır. Genel kurul oylamalarındaki sınırlama ve kısıtlamaların giderilebilmesi için ise yasal değişikliğe ihtiyaç vardır. Bu tebliğde kooperatifleri sürdürülebilir kılmak için " temsil ile tahkim " kurumları ele alınmış, kooperatif içi faaliyetlere işlerlik kazandırma, ortaklar arasındaki ilişkileri verimli hale getirme amaçlanmıştır. Hukuk sisteminin her kademesinde yer alan bu iki kurumun kooperatif ana sözleşmelerine konulması ve uygulaması halinde kooperatif içi sorunlar azalacağı gibi kalan az sayıda sorun da tahkim usulüyle kolay bir şekilde çözülecektir.

Bu çalışmanın amacı hak merkezli yenilikçi hukuk düşüncesi çerçevesinde insanlığı dördüncü nesil sanayi dönemi ve bilişim çağı hukuk düzenine taşıyacak kavramları geliştirme olarak belirlenmiştir. Önce doğal hukuk görüşüyle hakkın kaynaklarına inilmiş, bunların yakınlık, komşuluk, emek ve sözleşme ekseninde yer aldığı tespiti yapılmıştır. Günümüz hukukundaki imtiyaz, kuvvet, çıkar, çoğunluk gibi usullere dayanan eksen kaymaları gösterilmiştir. Hukukun bu usullerden arındırılması, doğal eksenine çekilmesi gerektiği üzerinde durulmuştur. İkinci kısımda devlet yerine insan ve insanlık merkeze alınmıştır. İnsan biyolojik, psikolojik, sosyolojik ve politik yönleriyle tanımlanmıştır. İnsanlığın tanımında ise biyolojik evrimle toplumsal evrim ayrımı yapılmış, hak/hukuk düzenleri toplumsal evrimle başlatılmıştır. Hukuk düzenlerinin geçmişi, bugünü ve geleceği bir bütün halinde değerlendirilmiş, insanlık anayasası kavramı geliştirilmiş ve tanımı da verilmiştir. İnsanlık anayasası çalışmalarında bucağın ilk sosyal hücre/ilk siyasal birim kabul edilmesi gerektiği üzerinde durulmuştur. First, the natural resources of the law were taken into consideration, and it was determined that they took place on the axis of kinship (relatives), neighborhood, labor and contract. In today's law, axis shifts based on methods such as privilege, force, interest, majority are shown. It has been emphasized that it is necessary to remove the law from these procedures and to withdraw to its natural axis. In the second part, human being and humanity are taken center instead of the state. Human is defined by biological, psychological, sociological and political aspects. In the definition of humanity, biological evolution and social evolution have been differentiated, and rights / legal systems have been started with social evolution. The concept of the constitution of humanity has been developed and its definition has been given by evaluating the past, present and future of legal orders as a whole. The past, present and future of legal systems are evaluated as a whole, the concept of humanity is developed and its definition is given. It has been emphasized that in the study of the constitution of humanity, it should be accepted as the first social cell / first political unit. In the change of social structure, the proposal was made to move from pilot applications.

Scholars have examined representative bureaucracy as a viable means to make the bureaucracy more responsive to citizens in a democratic society. The theory argues that a diverse public service that mirrors the social demographics of its population in terms of gender, race, and ethnicity (passive representation) is more likely to be responsive to the needs of all citizens (active representation). While a substantial body of empirical research exists, a comparative understanding of the theory is lacking in Africa. This study expands empirical research on the theory to Ghana. It investigates whether passive representation of female teachers makes the education bureaucracy more responsive to girls. The analysis of a nationally representative data set on senior high schools within the 216 districts of Ghana revealed that increasing the presence of female teachers is positively associated with the performance of girls on math and science exit exams.

O presente trabalho de diploma tem como objectivo a identificação e o estudo dos aspectos considerados mais relevantes das Comissões Parlamentares de Inquérito no contexto do ordenamento jurídico Moçambicano, permitindo compreender quais são as normas jurídicas vigentes aplicáveis.
Inseridas no Parlamento, entende-se aqui que as Comissões Parlamentares de Inquérito constituem um instrumento fundamental para o exercício da função fiscalizadora das acções do Governo e da Administração Pública em geral, função atribuída com exclusividade ao Poder Legislativo.
Procura-se identificar os requisitos para instauração das Comissões Parlamentares de Inquérito e, igualmente procura-se conhecer quais são os instrumentos colocados à sua disposição para o cumprimento de sua missão assim como os limites que são impostos à sua actuação, tendo em conta que não há poderes ilimitados no Estado Democrático de Direito.

Les premières lois de décentralisation française, parues au début des années quatre-vingt, sont ici appréhendées du point de vue de hauts fonctionnaires qui les ont (mal) vécues. Perçues comme un désaveu par les ingénieurs des Ponts et Chaussées, elles marquent pour eux −et selon eux− un tournant synonyme de  déclin, de perte de prestige, et d’incertitudes identitaires. Les formes prises par les récits de ce « désenchantement » viennent néanmoins rappeler la légitimité historique de ce corps et de sa « tutelle », le ministère de l’Equipement. Ces récits agissent comme des (ré)activateurs de légitimité face aux potentiels menaces qui pèsent sur leur existence. Cette sombre perspective pour le corps est également mise en scène par les responsables du ministère à la même époque, qui tentent de faire du désarroi de ces agents une ressource mobilisatrice pour l’introduction de réformes managériales censées sauver le corps du déclin.

Çalışmamızın konusunu 6102 sayılı Türk Ticaret Kanunu ile bir yenilik olarak getirilen pay sahibinin genel kurulda kitlesel (toplu) temsilciler aracılığıyla katılması oluşturmaktadır. Çalışmamızda özelikle kitlesel (toplu) temsilcilerden organın temsilcisi ve bağımsız temsilci incelenmiştir. Organın temsilcisi, şirket tarafından önerilen, şirketle herhangi bir şekilde ilişkisi bulunan bir kişidir. Bu kişi, kendisine temsil yetkisi veren pay sahipleri adına genel kurulda oy kullanıp gerekli diğer işlemleri yapabilir. Organın temsilcisinin şirket tarafından esas sözleşme hükmüne göre ilan edilmesi ve internet sitesine konularak pay sahiplerine bildirilmesi zorunludur. Organın temsilcisi tavsiye eden şirketin aynı zamanda bir bağımsız temsilci göstermesi gerekmektedir. Bağımsız temsilcinin, şirketten tamamen bağımsız ve tarafsız diğer bir kişi olması gerekir. Bağımsız temsilci organın temsilcisinin alternatifi ni oluşturur. Organın temsilcisi ve bağımsız temsilci, genel kurulda oylarını hangi yönde kullanacaklarını, gerekçeleriyle birlikte açıklayan bildirgeler yayınlamakla yükümlüdürler. Bu bildirgelerde yer alan bilgiler, pay sahibinin temsilciye talimatı niteliği taşır. Organın temsilcisi ve bağımsız temsilci temsil edecekleri payların sayısını, çeşidini, itibari değerini ve gruplarını şirkete bildirmekle yükümlüdürler. CORPORATE PROXY AND INDEPENDET REPRESENTATIVE TURKISH COMMERCIAL LAW NO. 6102 ARTICLE 428 ABSTRACT As an innovation brought by Turkish Code of Commerce No. 6102, participation of the shareholder in general assembly via a common agent constitutes the subject Corporate proxy is a person who is recommended by company and has a relationship with company in any way. This person may vote and perform necessary transactions in general assembly in the name of the shareholders giving representation power to it. It is obligatory for the corporate representative to be announced by company in accordance with the provisions of master agreement and put on website and notifi ed to shareholders. Company recommending corporate proxy has to show an independent representative also. Independent representative should be entirely independent and neutral person. Independent representative constitutes the alternative of corporate representative. Corporate representative and independent representative are obliged to make declarations stating how the votes are casted in general assembly with related grounds. Information taking place in these declarations has the characteristics of shareholder. Corporate representative and independent representative have to notify the number, type, nominal values and groups of the shares to be represented.
