Law on Religion

W prawie kościelnym, podobnie jak i innych porządkach prawnych, oprócz osób fizycznych funkcjonują także osoby prawne. Jest rzeczą zrozumiałą, że te podmioty praw i obowiązków podejmują w systemie różnorakiego rodzaju działania. Wśród nich nie wyklucza się również ich połączenia. Zasygnalizowany problem stanie się przedmiotem zainteresowania w tym opracowaniu. Rozpoczynając namysł nad tym zagadnieniem należy zauważyć, iż w Kodeksie piobenedyktyńskim z 1917 r. 1 nie znalazła się ani jedna regulacja ujmująca kwestię możliwości fuzji tego typu podmiotów. Na konieczność ujęcia tej kwestii w formie normatywnej zwrócono uwagę podczas prac nad rewizją Kodeksu z 1917 r. Postulat tego typu wysunięto na X sesji prac Zespołu Studiów "O osobach prawnych i fizycznych" (Coetus Studii "De personis phisicis et iuridicis") odbywającej się w dniach 13-17 listopada 1972 r. 2 Obecnie zamierzenie to znalazło wyraz w kan. 121 Kodeksu

Articles 3(1) and 3(2) of the Act on Guarantees of Freedom of Conscience and Religion of May 17, 1989, was at the time of its entry into force a fundamental regulation for the freedom to manifest religion or belief. The content of Article 3(1) clearly corresponds to Article 18(3) of the International Covenant on Civil and Political Rights. However, it represents the result of parliamentary work, since the government draft of the above-mentioned law, prepared by the Office for Religious Affairs of the People’s
Republic of Poland, deviated from the solutions adopted in the Covenant. In particular, it did not introduce restrictions on the freedom to manifest religion or belief but provided for the restriction of freedomof conscience and religion. It also referred to the category of the “health” of the individual instead of using the term “public health”, and it referenced the fundamental rights and freedoms of “the individual”, although the Covenant provided for the fundamental rights and freedoms of “other persons”. In the course of the work carried out by the Office for Religious Affairs, at least 11 drafts were prepared, containing versions of the future Articles 3(1) and 3(2) of the 1989 Act that that differed from the final version to varying degrees. Noteworthy are the facts that the provisions were designed largely independently of the provisions of the Covenant; that some of the drafts used the term “personal dignity” of the individual as a premise for restricting the manifestation of religion or belief; and that there were proposals to completely omit “health” as such a premise.

The canonical marriage which cannot be recognised or contracted according to the civil law (Summary)
The title of the article refers to canon 1071 § 1, 2o (the Code of Canon Law 1983), which reads that “Except in a case of necessity, a person is not to assist without the permission of the local ordinary at: ... a marriage which cannot be recognized or celebrated according to the norm of civil law”. The quoted regulation refers to two different situations. The first situation takes place when the canonical marriage cannot be accepted by the law because of the legal system in a given country; the other situation concerns cases when a marriage cannot be contracted according to this law.
With reference to this canon, the author analyses three different models of the marriage law, that is, the system of the obligatory civil marriage, the system of the subsidiary civil marriage and the system of the facultative civil marriage. Next, the author offers an interpretation of canon 1071 § 1, 2o in order to answer the question about the reasons for which the canonical marriage cannot be recognized or contracted in the systems of the civil law listed above. While trying to answer this question, the author points to the differences in the obligatory character of the regulations of the civil law and of the canon law.

W sytuacji cywilno-kanonicznej dwoistości formy zawierania małżeństw w wielu państwach udało się na drodze porozumień konkordatowych wypracować sposoby wzajemnego respektowania tych zakresówregulacji związanych z małżeństwem, które obie społeczności (polityczna i religijna) były w stanie uznać i które, biorąc pod uwagę służebną funkcję Państwa i Kościoła względem człowieka, temu samemu człowiekowi win- ny służyć. Tym bardziej jeśli człowiek ten zawiera małżeństwo równocze- śnie jako civis i christifidelis. Istnieją także państwa, które nie ratyfikowały umowy konkordatowej, ale w ramach własnego systemu prawnego, uznając i gwarantując prawo do wolności religijnej, uznają cywilnoprawne skutki małżeństw zawartych w formie religijnej.
Niniejsza monografia, zatytułowana Skutki cywilnoprawne małżeństwa ka- nonicznego ze szczególnym uwzględnieniem prawa w Polsce, Słowacji i Republice Czeskiej, dotyka właśnie tej problematyki. Zgodnie ze sformułowaniem za- wartym w tytule, dotyczy ona małżeństwa kanonicznego, a więc tego, które zawierane jest według przepisów prawa właściwego Kościołowi katolic- kiemu. Wspomniane sformułowanie wskazuje ponadto, że podstawowym przedmiotem analizy będzie nie tyle małżeństwo kanoniczne, ile skutki natury cywilnoprawnej, które w związku z zawarciem małżeństwa w for- mie kanonicznej powstają lub też nie powstają na forum cywilnoprawnym zgodnie z istniejącymi w danym państwie przepisami1.
Monografia powstała w ramach projektu, w którym za przedmiot ana- lizy obrano skutki cywilne zawarcia małżeństwa kanonicznego na forum prawa państwowego. Wzięło w nim udział ośmiu Autorów, związanych z uczelniami w Polsce, Słowacji i Republice Czeskiej, zaznajomionych poprzez wykłady, publikacje, pracę w sądach kanonicznych z problema- tyką kanonicznego i cywilnoprawnego wymiaru małżeństwa zawieranego przez osoby podlegające zarówno prawu państwowemu, jak i kościelnemu.Czytając poszczególne rozdziały, dostrzec można w nich specyficzny dla każdego Autora sposób ujmowania problemów, argumentacji, właściwy każdemu styl i język. Jako redaktor postanowiłem zachować te indywidualne cechy poszczególnych tekstów.

Dobrze pamiętam pierwszy wykład z ks. prof. Sobańskim w Wyższym Śląskim Seminarium Duchownym w Katowicach. Wszedł do sali, przedstawił się i zaczął opowiadać o prawie. Nie wykładał… Wiedział, że to nasz pierwszy kontakt z prawem kanonicznym. Snuł więc opowieść o tym, czym jest prawo kanoniczne w Kościele i dla Kościoła. Po dobrych kilkunastu minutach zdaliśmy sobie sprawę, że, zasłuchani, nie robimy żadnych notatek. A były to czasy, kiedy studenci je robili. Spojrzał na nas i powiedział: widzę, że panowie podążają za moim tokiem myślenia. To dobrze. Bo zaczynając naukę prawa, oprócz zdobycia pewnego quantum wiedzy, trzeba też-jeśli tego jeszcze ktoś nie potrafi-nauczyć się słuchać i usłyszaną treść precyzyjnie, logicznie analizować. Kiedy się go słuchało, zaczynało się postrzegać prawo kanoniczne jego oczyma, nie jako coś obcego w zestawieniu z doświadczeniem

Dnia 1 lutego 2020 r. w Katolickim Uniwersytecie Lubelskim Jana Pawła II odbyła się Międzynarodowa Konferencja Naukowa „Noli metuere et noli timere” połączona z wręczeniem Księgi Jubileuszowej z okazji 30-lecia święceń prezbiteratu ks. dr. hab. Mirosława Sitarza, prof. KUL – prezesa Stowarzyszenia Absolwentów Przyjaciół Wydziału Prawa Katolickiego Uniwersytetu Lubelskiego. Uroczystość została zorganizowana przez Katedrę Kościelnego Prawa Publicznego i Konstytucyjnego KUL oraz SAWP KUL. Opiekę naukową nad konferencją objął Komitet w składzie: ks. prof. dr hab. Józef Krukowski (przewodniczący), o. prof. dr hab. Wiesław Bar, dr hab. Waldemar Bednaruk, prof. KUL, ks. inf. dr Ireneusz Skubiś, dr Agnieszka Romanko (sekretarz). Ciężar organizacji konferencji podjął Komitet w składzie: dr A. Romanko (przewodnicząca), ks. dr hab. Paweł Kaleta, ks. dr Paweł Lewandowski, mgr lic. Agnieszka Smoluchowska.

After a general introduction describing the social and historical background, the book goes on to explain the legal framework in which religion is approached. Coverage proceeds from the principle of religious freedom through the rights and contractual obligations of religious communities; international, transnational, and regional law effects; and the legal parameters affecting the influence of religion in politics and public life. Also covered are legal positions on religion in such specific fields as church financing, labour and employment, and matrimonial and family law.

The present study is dedicated to Rev. Prof. Henryk Misztal, who passed away on November 28, 2020. It aims to commemorate this distinguished scholar, engaged academic, tireless educator, and – moreover – a zealous priest and a good man. Prof. Misztal spent his entire academic career at John Paul II Catholic University of Lublin. For many years, he chaired the Department of Law on Religion and the Department of Canonization Law. He also carried a number of other important academic responsibilities, serving as vice¬dean (1983–1987) and
dean (1987–1989) of the Faculty of Canon Law at the Catholic University of Lublin. His research interests were in the areas of law on religion and canonization law. In both fields, he gained national and international recognition. His publications on law on religion especially highlighted the importance of religious freedom that is every person’s right, whereas as a canonization law expert, he became best known as the author of comprehensive monographs devoted to substantive and procedural law. Over the course of his research, he contributed over 500 different kinds of publications. Prof. Misztal was repeatedly awarded for his research achievements. He received the Knight’s Cross of the Order of Polonia Restituta (2000) and the Medal of the Commission of National Education (2006). In 2018, he was also honoured with the doctorate renewal ceremony at his University. On the Church forum, he was granted the title of Honorary Chaplain of His Holiness (1996). Prof. Misztal’s research activity was constantly inspired by his faith and was inextricably connected with living his priesthood. Only when we are aware of that can we properly understand not only his life choices, but also the deepest sources of the authority that he enjoyed.

THE CONCEPT OF SECULARITY – HISTORICAL, LEGAL AND AXIOLOGICAL-ETYMOLOGICAL ASPECTS
S u m m a r y
Discussions about the meaning of the term secularity are of the key importance for understanding the relationship between religion and state authorities, on the one hand, and an individual's freedom of religion, on the other. What can post-secularism bring to civil society and pluralism, and what is the relationship between the universalist civic and the particular cultural (and religious) pattern within it? Does secularism mean the inevitable and hermetic separation between the state and the church, society and religion or do other legal modalities exist within that same secularity and which are they? Where is in that plurality of relations of the "post-secular" Serbian society at the moment and where should be? In addition to presenting all the differences of European modalities, the author points out that it is necessary to further insist on the nuances of the concept of secularity in our society, since, as currently perceived by the some parts of public, it is quite one-sided and incompatible with European cultural and pluralistic achievements as well as with what is written in the Constitution of the Republic of Serbia and the Law on Churches and Religious Communities.
