RESUMO: Neste estudo, refletimos sobre a disciplina prevista no art. 1068.º do Código Civil, na redação que lhe foi dada pela Lei n.º 6/2006, de 27 de Fevereiro e que se manteve inalterada a partir de então, sobrevivendo incólume à reforma produzida pela Lei n.º 31/2012, de 14 de agosto. Tendo representado uma alteração (pelo menos em parte) em relação ao regime anteriormente vigente importa averiguar em que termos o regime de bens acarreta a comunicabilidade da posição contratual de arrendatário. Na nossa reflexão teremos presente que a previsão normativa em análise se situa num ponto de interseção entre duas áreas jurídicas: a do direito do arrendamento e a do direito da família. Tomando em consideração contributos dos dois domínios, averiguaremos em que medida a solução serve, devidamente, os interesses familiares, à luz das tendências evolutivas que se vêm produzindo no direito da família.

Moral uprightness is reffering to the whole ensemble of certainties, motivations and habits that have a firm ground in solid principles, norms and rules, historically and socialy determined, which are governing the way people are interacting and relate to each other, having as foundation one’s conscience and public opinion. In this article, following a short introduction, integrity is presented as a core moral value, seen from both an individual and public perspective, and also from that of the freedom of conscience. It also emphasizes some principles that should secure the moral uprightness in our post modern society.
As far as the religious standpoint is concerned, the author stresses the fact the moral uprightness and freedom of conscience are both divine blessings, sacred gifts given for keeping in proper balance one’s self, necessary for having harmonious and fair associations with thouse that we live with and to grow lovesome liaisons with both other people and God.

The regulation of land mafia eradication in Indonesia in positive law applicable in Indonesia has been regulated in the codification of Criminal Law, Civil Law, and Administrative Law, where all of them also apply procedural law in the framework of legal efforts in the settlement of land mafia eradication in Indonesia, both non-litigation/Alternative Dispute Resolution (ADR) settlement efforts involving mediators, adjudicators, conciliators, and arbitrators, as well as litigation involving parties/law enforcement agencies ranging from the police, prosecutors, to the court. In the level of practice on the legal consequences of the prevention and eradication of land mafia in Indonesia, in this case there is a significant positive legal effect on the legal efforts to prevent and eradicate the land mafia in Indonesia although it must continue to be improved both in terms of more specific laws and regulations, or in the spirit of law enforcement and land administration bureaucracy/land policy officials.

This article examines the interpretation of nature from the perspective of Francis Bacon (1561-1626), highlighting how his ideas influenced the development of modern science. Francis Bacon proposed a revolutionary approach to scientific and philosophical investigation, emphasizing empirical observation and controlled experimentation. His main work, Novum Organum, published in 1620, introduced the inductive method as a means of discovering truths about nature, criticizing the Aristotelian deductive approach. Furthermore, Bacon emphasized the importance of experimentation as a way to avoid biases and distortions in human thought, introducing the theory of idols to explain the pitfalls of thinking. His contributions to modern science include the promotion of the scientific method and the valuing of experimentation as pathways to seeking truth. It is concluded that the philosopher left an indelible mark on the history of science, reminding us of the importance of empirical observation, experimentation, and the systematization of knowledge, which ultimately influenced the development of science in the following centuries.

Parte de debates iniciados em sala de aula, particularmente, na disciplina Pensamento Científico e Biblioteconomia, ofertada no Curso de Biblioteconomia da Universidade Federal de Pernambuco. Tem como objetivo identificar e analisar o estado da arte sobre o empirismo e o racionalismo no debate científico biblioteconômico brasileiro. Considera como pressuposto observado em sala de aula de que grande parte dos estudantes, ao entrar na Universidade, tem dificuldades ou resistência com relação ao debate sobre as formas de pensar empiricista e racionalista. A metodologia utilizada foi exploratória, quanto ao objeto da pesquisa, e o procedimento utilizado foi o bibliográfico com revisão de artigos recuperados da Base de Dados Referenciais de Artigos de Periódicos em Ciência da Informação. O debate proposto está dividido em quatro seções: uma introdução seguida pela revisão bibliográfica sobre dois proeminentes pensadores do empirismo e do racionalismo (Francis Bacon e René Descartes, respectivamente); uma terceira seção em que é comentada o estado da arte sobre essas correntes de pensamento na biblioteconomia brasileira; e, enfim, são feitas algumas considerações finais. Aponta, ainda, como consideração final que este escrito pode contribuir como material didático para uso dos neófitos estudantes universitários.

Resumo: A despeito de seu vocabulário técnico e argumentos sinuosos, a questão da subjetividade indica uma maneira peculiar pela qual a Filosofia moderna pensa sobre "quem nós somos". Trata-se aqui de recuperar o aspecto intuitivo deste problema. Para tanto, proponho um contraponto entre as filosofias de Descartes e de Henri Bergson. O que as torna mais próximas daquela intuição filosófica quanto à nossa vivência interior é que ambas compartilham a concepção de Filosofia como um modo de vida do qual o discurso teórico é uma parte importante, mas somente uma parte. Por isso, os argumentos e o plano de exposição dessas filosofias serão interpretados à luz da conjuntura existencial na qual foram ensinados. Ao realçar a concepção existencial que subsiste à questão estritamente teórica do sujeito, pretendo indicar como esta pode renovar, no âmbito da Metafísica Contemporânea, o problema filosófico do sentido da vida.

Le présent travail s’efforce de décrire le lien entre création monétaire et question environnementale. On commence par décrire 1°) le lien empirique entre la monnaie endogène (la monnaie essentiellement créée par les opérations de crédit vs la monnaie émise par les Banque centrales) et exploitation désordonnée des ressources renouvelables. On tente de saisir 2°) le lien conceptuel entre monnaie, énergie et climat. On s’attarde sur 3°) le diagnostic de Simone Weil, qui voit dans la pratique du rendement monétaire un principe de déséquilibre économique et humain. On propose enfin 4°) de reconsidérer la nature de la monnaie à partir des catégories juridiques qui la définissent.

Da tempo si discute sulle istanze di recupero della cittadinanza da parte dei discendenti dei cittadini italiani emigrati all'estero negli anni 1860-1920. In particolare, molti ritengono questi richiedenti la cittadinanza come "stranieri" ed il nostro apparato amministrativo e giudiziario si trova in difficoltà a riconoscere queste persone come "connazionali". Ci si chiede come mai un discendente di emigrante, cha ha abbandonato l'Italia circa 150 anni fa, possa oggi proporsi come cittadino italiano e richiedere il riconoscimento della cittadinanza. Per comprendere meglio il fenomeno è necessario fare un passo indietro di oltre un secolo ed andare a studiare i lavori preparatori della legge 555 del 1912. Il tema della cittadinanza non era stato approfondito nel Codice Civile del 1865, perchè all'epoca ancora non si poneva il fenomeno della massiccia emigrazione che coinvolse circa 20 milioni di italiani che, per ragioni storiche e difficoltà sociali, preferirono, o furono costrettti, a recarsi in altri luoghi in cerca di miglior fortuna. Ma dopo quel tragico periodo storico, a cavallo del 1800 e 1920, si poneva il problema degli emigranti "di ritorno", quelli che preferivano rientrare in patria dopo anni di emigrazione e, sopratututto, il problema dei figli degli emigranti. La vita nello Stato estero, difatti, aveva comporato l'acquisizione della cittadinanza del nuovo Stato, iure soli, cioè in base alla permanenza prolungata in quello Stato e, per i figli, il fatto di essere nati nello Stato estero. Questo conflitto normativo tra la vecchia e nuova cittadinanza, nel 1912 aveva posto dei problemi di conflitto internazionale di leggi, che non si riuscviva a risolvere. Oggi la legge sul diritto internazionale ha superato queste situazioni di conflitto, regolandole anche nei particolari, ma all'epoca questa legge non esisteva ed il conflitto doveva essere risolto in qualche modo. La problematica fu risolta con la legge 555 del 1912 che ribadì la prevalenza dello ius sanguinis nella trasmissione della cittadinanza italiana, consentendo così ai discendenti di reciuperare in ogni tempo la cittadinanza del loro ascendente italiano. Come si legge nei lavori preparatori di quella legge, se non si fosse agito in questo modo, i figli dei nostri emigranti non potevano acquisire la cittadinanza del padre, ed il diritto straniero di cittadinanza (ius soli) avrebbe prevalso rispetto allo ius sanguinis italiano. Quindi il criterio di unicità delle leggi regolatrici della cittadinanza italiana, e della famiglia italiana, fu risolto conservando lo ius sanguinis anche per chi, essendo emigrato all'estero, aveva conseguito una nuova cittadinanza (e quindi avrebbe perso la cittadinanza italiana sulla base della legislazione anteriore al 1912).

O trabalho tem por objeto as metodologias construidas por Bacon e Descartes, ou seja, a epistemologia empirista e a racionalista, no intuito de averiguar a possibilidade de sua utilizacao para o avanco do conhecimento e da pesquisa cientifica do Direito. Nesse sentido, por meio de uma metodologia dedutiva, em primeiro lugar, este artigo centrou-se na investigacao metodologica do empirismo baconiano, visando compreender o conhecimento via experimentacao. Apos, sequencialmente, centrou-se na analise da metodologia cartesiana, para explanar como ocorre o conhecimento racionalista, de carater universal e idealista. Por fim, analisou-se criticamente ambas as epistemologias e os seus criterios de cientificidade, proprios do seculo XVII, assim como se averiguou a possibilidade da utilizacao dos criterios metodologicos e de demarcacao de cientificidade, alem dos metodos de pesquisa, para a pesquisa juridica cientifica contemporânea. The relationship between Church and State is governed by a series of international treaties and laws, assumed and respected by national States by adopting legal rules in accordance with them, based on the principle of fundamental rights and freedoms. In this context, the relationship of collaboration and cooperation between the two jurisdictions, civil and religious, is the subject of extensive research, with a view to better understanding and determining the limits of this relationship, the points of convergence and divergence between them, as well as common aspects of doctrine and judicial practice. The present comparative law study aims, on the basis of national and Community legislation and case law, to analyse the competence and jurisdictional limits of the state and ecclesiastical judiciary. We will take into account the specificities of both legal systems, with regard to the composition of the courts, their competences, identifying procedural forms of intersection of the two jurisdictions (conflicts of jurisdiction), in order to finally propose legislative and complementary solutions that regulate and guarantee the intrinsic collaboration between secular and religious courts, through a knowledge, acceptance and efficient application of the current legal institutions and rules.

Principles represent general rules, basic ideas, having the role to ground and prepare the legal framework for the development of a complex process or the synthesis of a social and juridical experience, assuring a balance and a relation between the rights and obligations of a person, of a society in its entirety. The principles of canon law represent statements applicable to all the canon systems or canon prescriptions. These are applicable to all the autocephalous Orthodox churches, so have a universal character, according to the canon tradition and conscience. The basis of canon law and implicitly of its principles is theology but also the juridical sciences. The fundamental canon principles are principles of organization and administration of the Church, being ordained from the beginning in the light of the Savior Christ, as ontological basis and ground, along with the moral dogmas and values. The fundamental canon principles of the Church are found especially in her universal Constitution, consisting in the collection of the Holy Canons, in the long-lived and constant practice of the church life, become custom of canon law.

Justice in the rule of law is seen from two perspectives: as a system of court bodies and as an activity conducted by competent bodies. By its norms, the civil adjective law sets in detail every phase and stage undergone in the civil lawsuit. Seen in relation to the civil action, the canon action or the church action represents the ensemble of procedural means stipulated by "The Regulations of the disciplinary canon authorities and the court bodies of the Romanian Orthodox Church " regarding the protection of the subjective right of the members of the Church, clergy and laypeople, the compliance with the discipline rules, the internal canon order and the moral-clerical values, according to the directions of the Holy Canons and the canon tradition, the State, for the organization and functioning of the Romanian Orthodox Church, the application of its regulations, the decisions of the Holy Synod, the orders and the resolutions of the church authorities. The judicial power carries out their activity in line with some democratic principles intended to contribute to achieving an impartial and equitable justice. Since the very beginning of Christianity the church judgment has been attributed to the church canon authority, which is not a purely human authority, as is the case of the civil authority, but an authority of divine nature. The church and the human judgment is achieved andfinds its meaning in the Universal judgment, which is the confrontation of history and man with God’s justice at the end of time, when the whole world will be brought under the supreme authority of God and the divine decision, which is full of love andjustice, will apply erga omnes.

The value of education increases in a world marked by signifi cant changes, in a society of multiple individual and social options, in which a series of infl uences, of different natures, make themselves felt. Today, more than ever, education is called to answer the challenges of a world of the societies and individuals in confusion, a world in which milestones and frames of reference are lost, and ethical systems are in crisis. Education needs to build new roads for hope, by training educators as fl exible as possible, skills and behaviours able to deal with the permanent change and make the pupil adapt to uncertainty and complexity. School has the role to decisively contribute to spiritual reconstruction, to the redefi nition of new frames of values. In this context, religious education is a means of promoting human rights, based on the values and attitudes it proposes. The international legislation acknowledges the cults' right to provide religious education to children and young people. All the international documents are a frame of reference for the national policies in the domain of religious training. No uniform solutions are imposed for the religious education from the education systems, on the contrary, is left to the free choice of every nation, according to its specifi c, to realize this so necessary education. The aim of this paper is to present the most important normative aspects concerning religious education, according to the international legislation, European Community or European Union legislation, and the internal legislation of Romania.

The law system represents all the juridical norms, institutions, and branches of law adopted and assured by the State to regulate social relations, well defined in time and space, without being universally valid and without being made uniform. The law is divided into lay or secular and sacred or religious laws. Canon Law designates a law system different from the State or secular law. The science of Canon Law is part of the juridical-theological sciences group, as it has jurisdiction about both legal and theological matters. Canon Law has a fundamental practical relevance regarding the Church mission around the world and the inter-Orthodox relations, on the one hand, and the connection of the Church with the secular power, on the other hand. Canon Law represents a law system complementary to the State system. The relations between the two law systems are complex, and the two have al-ternated in time. Civil Law and Canon Law have supported each other for a long time defending the institutions of family, mar-riage, defending the persons and protecting human dignity. For this reason, the relations existing between the two are conver-gent, complementary and interactive. These two law systems lean on each other for mutual support to help people, as social beings, since the common principle underlying both is human nature, endowed with intelligence and free will.

Lucrarea reprezintă o cercetare situată la graniţa dintre două ştiinţe fundamentale cu profunde implicaţii în viaţa socială și juridică, cu tematizări din câmpul dreptului civil și al dreptului canonic. Demersul comparativ dintre procedura de judecată bisericească și cea civilă, imprimă o valoare specială a lucrării, prin cercetarea datelor și realităților existente, bazându-se pe tradiția canonică și istorico-eclezială a autorității bisericești în exercitarea puterii judecătorești. Ideile ce alcătuiesc corpusul acestui tratat de drept comparat evidențiază conexiunea care există între religie și drept, asemănările dintre normele acestora, dar și specificitățile care determină autonomia fiecăreia dintre ele, prin explicațiile și interpretările autorului asupra legislației românești civile și bisericești, acquis-ului comunitar și a celui eclezial ortodox, jurisprudenței și codurilor de procedură civilă și canonică. Lucrarea oferă cu predilecție noutatea tratării interdependențelor asemănărilor și deosebirilor care există între dreptul canonic și dreptul civil, în general, și aspectele de procedură a soluționării litigiilor, în special, impresionând prin multitudinea și complexitatea informațiilor oferite cititorului atât din perspectiva dreptului bisericesc, cât și din interiorul științei dreptului de stat. Lucrarea întregește și împlinește o lipsă a literaturii juridico-canonice românești, prin necesitatea aprofundării în materie procedurală de înfăptuire a justiției în societatea contemporană atât din perspectiva dreptului laic, cât și a celui bisericesc. Importanța și utilitatea acesteia constă în cunoașterea și aprofundarea relațiilor dintre dreptul sacru și dreptul profan, care au menirea de a ajuta la o eficientă colaborare și apropiere a Bisericii de autoritatea statală.

This article propose an explanation about Law that crosses the scales of space, time and complexity to, by uniting the apparently irreconcilable facts of the social and the natural, integrate the perception of a normative network, of a social adaptive strategy, that certainly was created and exists in function of its contributions to survival and reproductive success during the long period of our evolutionary history, that is, to resolve recurrent evolutionary problems in an essentially social species such as ours that otherwise would not have managed to prosper biologically. Human culture, and the law in particular, is a deposit of ethical, juridical and political precepts that include every type of specific order, value, prohibition, taboo and ritual. Since the most remote times, students of law have tried to organize these imperatives in a universal rational, harmonic and defendable system of norms and principles, but nothing like a consensus has been achieved to date. Mathematics and physics are the same for anyone and in any place, but the law (and ethics) still cannot reach a similar and considered equilibrium. Why not? Is this objective illusionary? The practitioners of canon law claim that ecclesial law and civil law are in a relation of analogy, so that both of these juridical systems have common features but differ in aspects of specificity of matter and essence. In this way, civil law becomes a point of reference for the study of ecclesial law and the statement is true as well the other way round However, one can note a modality of identification only for the features of canon law which are equivalent to the features of civil law, canon law constituting a coherent system similarly to the civil law system. Consequently, canon law is a well-deffined juridical system, delimited by its own juridical norms and which regulates both the internal life of the Church and her external life, in relation to other civil and religious institutions. Therefore, by the topic approached in the present article we join this contemporary ‘juridical trend’, which relies on comparative law in order to know and harmonize the international legislation among all the law systems, the basis of dialogue revolving around the guaranteeing of man's fundamental rights and freedoms. Actually, the Church respects and participates in the fight for guaranteeing man’s fundamental rights and freedoms because the Church carries in her being and mission the seal of the universal. Recently, the modern scientific juridical research has shown a real interest in the importance of canon law, the main empirical directions referring to the historical highlighting of canon law, the study of the methods dealing with the relations between the State and the Church, the organisms of ecclesial authority, especially those related to the system of justice, the comparative analysis of canon law, the existence and functionality of the canon law system in various religions of the world.

Inleiding 1 Aanleiding voor het onderzoek De afgelopen jaren heeft Nederland zich binnen de Europese Unie-mede op grond van eigen ervaringen en beleidsinzichten-steeds sterk gemaakt voor de verbetering van de kwaliteit van Europese regelgeving. Dat heeft verschillende resultaten opgeleverd, waaronder bijvoorbeeld de aan het verdrag van Amsterdam gehechte verklaring (nr. 39) inzake de redactionele kwaliteit van communautaire wetgeving en de internationale conferentie 'Quality of European and National Legislation' die door de ministeries van Justitie en Economische Zaken in samenwerking met de Europese Commissie en het T.M.C. Asser Instituut tussen 24 en 27 april in 1997 in Scheveningen werd georganiseerd. Ter bevordering van de kwaliteit van de Europese regelgeving is-mede op Nederlands initiatief-op 22 december 1998 een interinstitutioneel akkoord gesloten tussen de Europese Commissie, de Raad en het Europees Parlement. De desbetreffende richtsnoeren hebben vooralsnog vooral betrekking op de redactionele kwaliteit. De formulering van meer inhoudelijke kwaliteitseisen is-zo wordt o.a. verwoord in de recent uitgebrachte nota Wetgevingskwaliteitsbeleid en wetgevingsvisitatie-naar het oordeel van het kabinet echter ook op Europees niveau noodzakelijk. 1 Het belang van de-inhoudelijk-goede kwaliteit van wetgeving is door zowel andere lidstaten van de EU alsook door de EU Commissie een en ander maal onderschreven. O estudo avalia a existência de certeza no processo científico, pois busca a verdade, contudo, confrontado com o desconhecido, provoca incertezas e dúvidas. Utilizou-se a pesquisa bibliográfica, em que se sistematizou a literatura científica sobre a epistemologia e o conhecimento relacionado ao processo científico e as incertezas que o cercam. O processo científico, embora busque continuamente a verdade, não alcançará a perfeição, porque o pesquisador lida com o desconhecido. A ciência busca permanentemente novos conhecimentos e progride com a crítica aos erros, busca a verdade, contudo estas são provisórias. Concluiu-se que todo o conhecimento científico é incerto.

Electronics in “wearable systems” or “smart textiles” are nowadays mainly realized on traditional interconnection substrates, like rigid Printed Circuit Boards (PCB) or mechanically flexible substrates. The electronic modules are detachable to allow cleaning and washing of the textile. In order to achieve a higher degree of integration and user comfort, IMEC-UGent/CMST developed a technology for flexible and stretchable electronic circuits. The electronic system is completely embedded in an elastomer material like PDMS (silicone), resulting in soft and stretchable electronic modules. The technology uses standard packaged components (IC's) and meander shaped copper tracks, so that stretchable systems with complex functionality can be achieved. În dimensiunea sa religioasă, libertatea reprezintă unul dintre elementele vitale care consolidează identitatea credincioșilor și a concepției lor de viață. Uniunea Europeană prin tratatele, legislația adoptată și jurisprudență, precum și prin protecția instituțiilor sale subliniază importanța majoră pe care o au respectarea drepturilor fundamentale ale omului, convingerile religioase și filosofice în societatea europeană și pune accent pe valorile fundamentale ale pluralismului și toleranței. Uniunea Europeană interzice orice discriminare pe motive precum sexul, rasă, culoare, origine etnică sau socială, caracteristicile genetice, limbă, religie sau convingeri, opinii politice sau de orice altă natură, apartenența la o minoritate națională, averea, nașterea, dizabilități, vârstă sau orientarea sexuală. Dreptul la libertatea religioasă este, în primul rând, un drept care ține de conștiința individuală, ce implică, de asemenea, libertatea de a manifesta o religie, o convingere religioasă sau filosofică, o concepție proprie despre viață. Uniunea Europeană respectă diversitatea culturală, religioasă și lingvistică și nu aduce atingere statutului de care beneficiază, în temeiul dreptului național, bisericile și asociațiile sau comunitățile religioase din statele membre.

O presente artigo tem como finalidade apresentar e refletir sobre possiveis contribuicoes que foram dadas a ciencias, a partir do metodo proposto por francis Bacon. O metodo baconiano proposto no seculo XVII, juntamente com as descoberta de Galileu dao inicio ao que se pode chamar: reformulacao das ciencias. O objetivo do metodo de Bacon era desenraizar do campo das margias e obiscuridade e torna-la em um saber sistematizado, que se controi na pespectiva da colaboracao entre varios pesquisadores;  um saber que era do dominio publico, patrimonio de todos e que se afasta decididamente dos dogmas religiosos. This paper aims to address the problem of the ontology of law investigating the foundation of the systematic nature that belongs to it as a legal system bearer of an "order". For this purpose, taking in a comparative consideration three different models, the positivism, the axiologicalconstitutional one and the classical-metaphysical one, subjects such as the person, the teleological rationality and the natural law are analyzed and discussed in their foundational value and in their specific function.

Resumo: Este texto discute a natureza da indução, a relação entre Big Data e hipótese científica, e a epistemologia da data driven science. Abstract: This text discusses the nature of induction, the relationship between Big Data and scientific hypothesis, and the epistemology of data driven science. INDUÇÃO Na década dos anos 1970, quando houve o boom de pesquisas em Inteligência Artificial, ocorreu uma discussão sobre usar regras de produção ou métodos estatísticos para gerar programas de computador com inteligência suficiente para ajudar nas tomadas de decisão por parte de humanos. O autor deste texto lembra que o professor emérito Helder Coelho, do Departamento de Informática da Universidade de Lisboa, em discussões pessoais, gostava de usar, a esse respeito, a metáfora do "futebol força" e do "futebol técnica". O tema das relações entre dedução e indução aparece como muitas vezes presente na história das ciências ocidentais. O raciocínio indutivo é um método de raciocínio no qual as premissas são vistas como fornecendo alguma evidência para a verdade da conclusão; isso contrasta com o raciocínio dedutivo: embora a conclusão de um argumento dedutivo seja certa, a verdade da conclusão de um argumento indutivo só pode ser provável, com base nas evidências fornecidas 1. Muitos dicionários definem o raciocínio indutivo como a derivação de princípios gerais a partir de observações específicas, embora existam muitos argumentos indutivos que não possuem essa forma. Para uma mudança do particular para o universal, Aristóteles nos anos 300 AC usou a palavra grega epagogé, que corresponde à palavra latina inductio; mas os pirronistas apontaram que a indução não pode justificar a aceitação de afirmações universais como verdadeiras 2. No século 17, Francis Bacon repudiou o valor da mera experiência. Seu método de indutivismo exigia que observações minuciosas e variadas, que descobrissem a estrutura natural do mundo e as relações causais, fossem acopladas à indução enumerativa, a fim de ter conhecimento além do escopo atual da experiência. O indutivismo, portanto, exigia a indução enumerativa como um componente 3. A posição do empirista David Hume no século 18 era que a indução enumerativa não tinha base racional, muito menos lógica, mas, em vez disso, a indução era um costume da mente e uma exigência cotidiana de viver. Para ele, embora observações, como o movimento do Sol, pudessem ser acopladas ao princípio da uniformidade da natureza para produzir conclusões que pareciam certas, o problema da indução surgia do fato de que a uniformidade da natureza não era um princípio logicamente válido. Hume era cético em relação à aplicação da indução enumerativa e da razão para alcançar certeza sobre os não observáveis e, especialmente, a inferência da causalidade pelo fato de que modificar um aspecto de um relacionamento impede ou produz um resultado específico 4 .

"A investigação científica é, com efeito, o melhor método para nos pôr ao corrente de nós mesmos e de nossa ignorância. Ela nos conduz à importante noção de que nós, humanos, somos muito diferentes no tocante à ninharias das quais talvez tenhamos algum conhecimento. Mas em nossa infinita ignorância somos todos iguais." (Popper, 2006, p. 64). Resumo: O objeto do trabalho é o estudo do critério de demarcação e da metodologia propostas pelo Racionalismo Crítico de Karl Popper, e sua utilização na Ciência do Direito. O artigo contém uma extensa descrição da proposta epistemológica popperiana e seus principais fundamentos. Também dedica uma seção especificamente ao problema das Ciências Sociais, na perspectiva do Racionalismo Crítico. A parte final do texto é destinada à ao objetivo central proposto para a pesquisa, qual seja o de verificar a possibilidade da adoção do critério de demarcação pela falseabilidade na Ciência do Direito, da utilização do método de tentativa e erro na pesquisa jurídica, e da localização do Direito nos três mundos de Popper. A conclusão é de que é possível adotar o critério da falseabilidade por teste empírico, como critério de demarcação na Ciência do Direito, considerando essa como uma ciência interdisciplinar de base normativa (jurídica) e social. Essa conclusão também leva à aceitação da possibilidade da utilização do método de tentativa e erro na pesquisa jurídica. Relativamente à teoria dos três mundos proposta por Popper, a conclusão é de que o Direito está situado no mundo 3 e possui uma grande parcela de autonomia em relação aos mundos 1 e 2. This essay seeks to listen to the ‘muta eloquentia’ of visual arts, in a very specific field, namely, the plastic discourse on the eyes, the blindness and the blindfold of justice ‘the most enigmatic feature of justice’ – throughout the last centuries of western art history. Why, over the centuries, has the goddess of justice been so often depicted with eyes open, with eyes closed, with blindfolds, without blindfolds...? What does that mean? What is the reason for these changes? These are the central issues of this text. Images shape powers, knowledge and invisible arguments, making present all which is many times absent above all in those historical times when printed language was still not available to diffuse ideas. Therefore, the immediate objective of this text is to better understand law and better understand the art that speaks of law.

ABSTRACT: In a scenario of steady information exchange, provided by the internet,
the empiric scientific spirit of natural sciences, that characterizes – or should
characterize – our culture since the modernity, seems to be the great absence in the
social media discussions. Instead, what is seen is the sharing of disinformation
occasioned by the lack of dialogue between academy and social media, which
promotes and results in scientific illiteracy, holding back the development of any
culture. The scientific journalism has been made in an unprepared way, not worrying
about scientific accuracy and allowing room for sensationalism, conspiracy theories
and pseudoscience, which are dangerous as they use fallacies, avoiding refutability
in order to claim them as scientific and thus ending up deceiving unsuspecting
people. The social media promotes the scientific illiteracy, which, in turn, allows room
for the pseudoscience to bloom, while the academy stays away and isolates itself
from this scenario, helping to feed it. Theoretically, that would only be solved with a
change in the academy thought, in the awareness-raising of journalism and a better
basic education in general.

Ces dernières années, nous assistons à un regain d'intérêt pour les organisations de l'Economie Sociale et Solidaire (ESS) et plus particulièrement les coopératives comme acteur principal de développement à la fois économique, social et territorial. Delà, ce travail de recherche essaie de mettre en lumière l'état des lieux de la stratégie marketing des coopératives et d'expliquer l'importance de l'introduction de l'innovation au niveau managériale pour un meilleur développement économique et social.

Summary: The article discusses the interrogation and quasi-interrogation discourse in the A. P. Chekhov's story «Drama on the Hunt», taking into account the complex composition of the work - a story in the story - and from the position of role-playing strategies of the main characters, the participants of the interrogations.

O trabalho tem por objeto as metodologias construídas por Bacon e Descartes, ou seja, a epistemologia empirista e a racionalista, no intuito de averiguar a possibilidade de sua utilização para o avanço do conhecimento e da pesquisa científica do Direito. Nesse sentido, por meio de uma metodologia dedutiva, em primeiro lugar, este artigo centrou-se na investigação metodológica do empirismo baconiano, visando compreender o conhecimento via experimentação. Após, sequencialmente, centrou-se na análise da metodologia cartesiana, para explanar como ocorre o conhecimento racionalista, de caráter universal e idealista. Por fim, analisou-se criticamente ambas as epistemologias e os seus critérios de cientificidade, próprios do século XVII, assim como se averiguou a possibilidade da utilização dos critérios metodológicos e de demarcação de cientificidade, além dos métodos de pesquisa, para a pesquisa jurídica científica contemporânea. Isto é, se as epistemologias empirista e racionalista permitem, atualmente, a sua utilização como critério de demarcação entre o que é Ciência do Direito e o que não o é, assim como se permitem a sua utilização para a realização de uma pesquisa científica do Direito.

Resumo: O presente artigo trata sobre o racionalismo cartesiano em um contexto histórico, assim como o surgimento das primeiras definições que originaram os conceitos envoltos a esse tema. Marxismul presupune un sistem de idei filozofice, economice,social-politice de orientare materialistă , care susține principiul luptei de clasă în scopul instaurării orînduirii comuniste.[1] În urma revizuirii unor aspecte ale Teoriei lui Karl Marx,V.I. Lenin a concretizat un șir de lucrări cu referire la proprietate,stat și în general despre unele principii de funcționare a economiei socialiste.[2][3] Într-un mod general Marxismul presupune o societate fără clase în care statul va fi un instrument a dictaturii proletariatului.Astăzi rolul statului nu este la fel de esențial în dezvoltarea economiei,întrucît prin reformele sale statul doar poate încuraja spre dezvoltare unele ramuri ale economiei. În Teoria Leninistă statului i se acordă un rol important în dirijarea proceselor economice ,el organizează producția după un plan directiv obligatoriu pentru toate întreprinderile care la rîndul lor erau dirijate prin reprezentanți ai statului.[4] Astfel s-a subapreciat factorul subiectiv în evoluția economică neținîndu-se cont de faptul că resursele economice sunt limitate,iar proprietatea privată nu se poate adapta la noile condiții [5] .Un alt neajuns al influienței statului asupra dezvoltării economiei este centralizarea puternii unei persoane sau a unui grup mărind posibilitatea ca acei invidivizi să facă uz de putere și să urmărească obținerea unor beneficii mai mult personale decît comune.În urma analizei asupra problemelor ce țin de teoria marelui teoretician al marxismului, V.I.Lenin ,pot concluziona faptul că ideiile au un caracter utopic,nu se ține cont de natura adevărată a omului care este una haina,avara,nici nu se i-a în calcul relațile sociale existente în societate.Părerea mea este că omul ca individ nu trebuie să i se ofere prea multă putere în mîinele proprii,dorința de a aculuma cît mai multă forță este o tentație inevitabilă,însă nici liberalizarea excesivă nu este binevenită.Dacă oamenii se v-or simți liberi să facă orice ,v-a apărea riscul anarhismului,optez pentru un echilibru între a conduce și a fi condus.

This article propose an explanation about Law that crosses the scales of space, time and complexity to, by uniting the apparently irreconcilable facts of the social and the natural, integrate the perception of a normative network, of a social adaptive strategy, that certainly was created and exists in function of its contributions to survival and reproductive success during the long period of our evolutionary history, that is, to resolve recurrent evolutionary problems in an essentially social species such as ours that otherwise would not have managed to prosper biologically.
