Reformasi Penegakan Hukum Perspektif Hukum Progresif

This study aims to find the problem of law enforcement in Indonesia through social analysis and using the progressive legal as a new paradigm in law enforcement in Indonesia. So the assumption used is to make the law a social phenomenon. The formulation of the problem in this research are what the problem in law enforcement against respect for human dignity is, and how the progressive law provide a new paradigm in law enforcement so as not to deviate from the values that live in society. This study uses the socio-legal research method using social approach methods and norma-tive juridical approaches. This article concludes, first, the problem of law enforcement is caused by the strong influence of the positivistic legal paradigm to make values in society hit and ignored; errors in interpreting the law which is interpreted in a letter from the written articles; and the lack of strictness of a provision contained in legislation that opens the gap for the possibility of deviation by the implementers. Second, progressive law can be an alternative as well as a solution in law enforcement that reflects the values of justice in society. With progressive law, actors in law enforcement must have a progressive perspective so that they are not confined to legal formalism in order to uphold the values of justice in society, including through "the law makes happiness", "punishing it reconciles", "seeing the context behind the text"; and "using conscience in law enforcement".

Law enforcement that often miseries and hurts the sense of community justice encourages one of the jurists, Satjipto Rahardjo expresses his idea about the need to involve conscience and morals in punishment. Lahirnya hukum progresif tidak serta merta muncul menjadi produk hukum yang langsung jadi. Satjipto Rahardjo yang merupakan penggagas hukum progresif menyatakan bahwa adanya hukum progresif karena terdapat persoalan ketidakadilan hukum yang hanya berlandaskan pada hukum positivistik semata. Cara-cara berhukum lama itu yang hanya mengandalkan penerapan undang-undang, sudah seharusnya ditinjau kembali. Cara berhukum yang demikian itu dirasa kurang mampu guna memecahkan masalah sosial. Penegakan hukum selama ini sudah dilakukan, akan tetapi belum menyelesaikan masalah sosial. Penelitian ini bertujuan untuk mengkaji lebih lanjut keefektifan hukum progresif dalam penegakan hukum di Indonesia dalam dinamika kehidupan bermasyarakat. Jenis penelitian ini merupakan penelitian yuridis normatif yang menitikberatkan pada peraturan tertulis untuk mencari data sekunder melalui studi literatur. Adapun pendekatan yang digunakan antara lain pendekatan kasus dan pendekatan perundang-undangan. Hasil dari penelitian ini menunjukkan bahwa hukum progresif mampu memperbaiki masalah sosial karena sesungguhnya hukum bertujuan untuk kebaikan manusia. Oleh karena itu, Penulis memandang hukum yang selama ini berlaku perlu ditinjau kembali dengan memperhatikan gagasan hukum progresif yang esensinya tidak dapat dinafikan.

Penegakan hukum yang terjadi di Indonesia tidak mencerminkan nilai keadilan yang diharapkan oleh masyarakat, sehingga lahirlah konsep hukum progresif untuk menyelesaikan masalah tersebut. Penelitian ini mengkaji: Pertama, faktor penyebab penegakan hukum di Indonesia ini tidak mencerminkan nilai keadilan; kedua, peran dari konsep hukum progresif dalam menyelesaikan permasalahan penegakan hukum yang terjadi di Indonesia. Hasil dari penelitian ini menyimpulkan: Pertama, faktor penyebab dari penegakan hukum yang tidak menunjukan nilai keadilan itu adalah (i) aparat penegak hukum yang mengedepankan aspek prosedural, (ii) adanya pendiskriminasian oleh penegak hukum dan (iii) hukum itu seolah bisa dibeli. Pembaharuan hukum pertanahan diharapkan menjembatani regulasi sektor bidang pertanahan. Permasalahan yang dikaji adalah: Bagaimana model pembacaan progresifitas makna reformasi hukum pertanahan. Bagaimana Penataan kembali sistem hukum pertanahan dalam sistem hukum nasional yang konstruktif dan integral. Penelitian menggunakan paradigma constructivist, Metode Pendekatan socio-legal research dengan metode Kualitatif, sepesifikasi penelitian deskriptif analitis. Hasil pembahasan didapati hal berikut: Pertama, wacana pembacaan teks dan politik hukum reformasi hukum pertanahan merupakan keniscayaan penalaran hukum. Kedua, melalui penataan kembali hukum pertanahan perlu mengakomodir kepentingan masyarakat bukan konfigurasi kepentingan peranata global.
