O crime organizado no Brasil e na Itália: análise de decisões

2020, Revista de Informação Legislativa

This article aims to understand how judicial practices in Brazil and Italy perceive organized crime, based on the analysis of decisions made in the both countries. Initially, the concept of organized crime was treated, considering the multiplicity of existing definitions. Subsequently, a qualitative research was carried out, analyzing decisions made in both countries, seeking their meaning for the construction of a comparative analysis that took into account the cultural aspects present. The sentences were submitted to a questionnaire and, later, the answers obtained were compared. Thus, the treatment of organized crime in both countries was treated from the perspective of judicial practice. The comparison between the models showed convergences between what is practiced by organizations in Brazil and Italy, especially in the co-option of state agents, territorial extension of the illicit and the presence of a robust organizational structure for the practice of crimes. https://www12.senado.leg.br/ril/edicoes/57/228/ril_v57_n228_p77
