The freedom of worship in coronavirus times ABSTRACT: The state of emergency by coronavirus drove the italian government to legislate by means of decrees without law, that provided strong limits to constitutional rights as, among others, the freedom of worship. Particularly they banned masses coram populo in the churches and on occasion of funeral service in order to safeguard the health care. This paper aims to demonstrate that the Concordat beetween State and Church, well as the accords with other fellowships, is another matter with regard to a higher collective interest, constitutionally protected, like the halth care. The paper points out, moreover, how the adopted measures are...

Freedom of expression and freedom of religion coexist in an encounter-clash relationship. On the one hand, they are connected by the historical-normative evolution, as can be seen in international Charters and national Constitutions, which makes them topographically close, positivizes them with similar regulative techniques, and influences them about their content. On the other, the conflict is about mutual boundaries. With this essey, I specifically analyze the limits that freedom of religion poses to free expression of thought, in its variations of critique and satire, with reference to the Italian case, but also with a gaze to supranational and foreign legislation and jurisprudence. I then focus on the mutations generated by the growing social multiculturalism, which sometimes leads to questionable positions in contrast with founding principles.

Freedom of Belief, Adequate Food and Ritual Slaughter in Market Requirement. Reflections on the Rejection of the Ordinance Amending Ritual Killing of Animals, adopted by the Brussels Parliament in June 2022. In June 2022 the Parliament of the Brussels Region rejected a proposal for an ordinance aimed at banning the possibility of killing animals according to religious standards, as previously done by the Region of Wallonia and Flanders, similar to how some European countries have done. It is an opportunity to carry out a survey on which countries allow and do not allow ritual slaughter in Europe and the underlying reasons. Thus, a minimum common denominator emerges between the countries that protect this confessional instance of some religious minorities, determined by market reasons. A new configuration of the principle of religious freedom is therefore emerging as the right to access adequate food in line with the confessional dictates of ritual slaughter, according to a particular declination aimed at the economic sustainability of producers and consumers, also in terms of food safety.

The coronavirus pandemic has impacted on all aspects of our lives, affecting various freedoms and rights, including religious freedom. The fundamental core of this freedom, namely the individual, public and collective exercise of worship, which was indeed likened to attending a theatre or cinema performance, was eroded, first by preventing and then restricting religious celebrations. In the absence of a framework law on religious freedom that could constitute the legal basis for an agreed discipline, the stipulation of memoranda of understanding between the Italian government and six religious denominations, following a collective online meeting, appears to suggest a different way of understanding the bilateral system in our pluralist and multicultural society. Parole chiave: libertà religiosa, Chiesa cattolica, pandemia, protocolli di intesa, relazioni tra Stato e confessioni religiose Keywords: religious freedom, Catholic Church, pandemic, memoranda of understanding, relations between State and religions.
