A Desconstrução e Sua Influência No Direito: Uma Relação Complexa

Abstract

The purpose of this dissertation is to elucidate the thought known as deconstruction – from the analysis of certain works by his thinker (the french-algerian philosopher Jacques Derrida) and by the help of texts that contribute to its understanding – to understand its influence and assimilation by law, through the analysis of the texts developed by the american jurist Jack Balkin, as well as by the texts that he develops in company with the lawyer Sanford Levinson, being divided in three sections (that are subdivided into five chapters). The first section deals with deconstruction as a gesture of reading, as thought and thought of the other, through the motives of hospitality. The second section analyzes justice as a motive of deconstruction and its direct influence on the law.
