Abstract The recent legalization of homosexual “marriage” in Argentina has revealed the difficulties magisterial teaching is bound to face in the public square, difficulties which arise, at least in part, from the fact that the condemnation of this kind of “marriage” not only draws on public reasons concerning the common good, but also on the condemnation of homosexuality itself. The present article proposes a “reconstruction” of the official argument which, while preserving its core, focuses primarily on the defence of (heterosexual) marriage as public institution, with a relative autonomy from moral judgements regarding homosexual behaviour. In this way, the magisterial teaching would become more persuasive, more likely to generate consensus, and would allow a better discernment of the requirements of justice.
