Título y justificación de la propiedad

2014, Ars Boni et Aequi

The paper proves that one is entitled to have private property due to distributive justice and to the principle of subsidiarity. It refutes the Liberal-Lockean and the Marxist conceptions of the right to property. It demonstrates, in particular, that the evils which Marxist thinkers consider as flowing from private property as their cause would not disappear but, rather, worsen if private property were abolished. It demonstrates that there are a variety of possible just property systems and that the system of “intellectual property” must be submitted to a thorough revision. It holds that private property concerning intellectual rights is contrary to subsidiarity.
