1. Acceptance of Terms
By accessing the website at https://womenhack.com (the “Site”) or attending our events, you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. Equal Opportunity & Platform Inclusivity
2.1 Open Access Policy. While WomenHack’s mission and marketing focus on empowering women and underrepresented groups in technology, WomenHack is an inclusive platform open to all qualified professionals. We do not exclude, discriminate against, or deny services to any Candidate or Employer based on gender, race, ethnicity, age, sexual orientation, religion, or any other characteristic protected by federal or state law.
2.2 No Discriminatory Barriers. Participation in our talent marketplace and events is based on professional qualifications and interest in inclusive workplaces, not on identity.
2.3 Compliance with Law. WomenHack operates in compliance with Title VII of the Civil Rights Act of 1964 and the California Unruh Civil Rights Act.
3. Nature of Services
3.1 Venue Only. WomenHack acts solely as a venue to connect employers (“Employers”) with professionals (“Candidates”). WomenHack is not an employment agency, staffing firm, HR consultant, or employer of any Candidate.
3.2 No Guarantee of Hire. We do not guarantee that any Candidate will receive an interview, job offer, or placement. We do not guarantee that any Employer will find a suitable candidate.
3.3 Automated Matching Disclaimer. The Site may use algorithms and automated tools to suggest connections between Candidates and Employers. These matches are recommendations only. WomenHack does not warrant that these algorithms are free from error or bias. Employers are solely responsible for reviewing qualifications and making independent hiring decisions.
4. User Obligations & Truthfulness
4.1 Accuracy of Information. You are solely responsible for the content, data, and information you upload (“User Content”). You represent and warrant that all User Content (including resumes, job descriptions, and salary ranges) is true, accurate, and current.
4.2 Prohibited Conduct. You agree not to:
- Use the service for any unlawful purpose;
- Harass, stalk, or discriminate against other users;
- Scrape, spider, or crawl the Site without our permission;
- Create multiple accounts to manipulate the matching system;
- Post spam, misleading content, or malicious code;
- Impersonate another person or entity.
5. Fees, Cancellation & Refunds
5.1 Non-Refundable Fees. All Subscription Fees and Event Sponsorship Fees are non-refundable.
5.2 Subscription Changes. Company may change Subscription Fees upon thirty (30) days’ notice. If you do not agree to the change, you must cancel before the new price takes effect.
5.3 Cancellations. You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle. No refunds or credits will be granted for partial months of service.
6. Employer Specific Obligations
6.1 Hiring Responsibility. Employers agree that they are solely responsible for their own hiring decisions, interview processes, and compliance with all applicable employment laws (including EEOC guidelines and Fair Labor Standards Act).
6.2 Indemnification. Employer agrees to indemnify, defend, and hold harmless WomenHack and its officers, directors, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising out of:
- Employer’s use of the Services;
- Employer’s hiring decisions or employment practices (including claims of discrimination, failure to hire, or unfair labor practices);
- Any dispute between Employer and a Candidate.
7. Event Terms & Conditions
7.1 Code of Conduct. WomenHack is committed to a safe, professional environment. We reserve the right to remove any attendee from an event, without refund, who creates a hostile environment, engages in harassment, or violates our policies. This discretion is exercised based on conduct, not identity.
7.2 Media Release. By attending a WomenHack event, you consent to being filmed, photographed, and recorded. You grant WomenHack a worldwide, royalty-free, perpetual license to use your name, likeness, and image in marketing materials. You waive any right to compensation or privacy regarding these images.
7.3 Force Majeure. WomenHack shall not be liable for any failure or delay in performance (including event cancellations) due to causes beyond our reasonable control, including acts of God, war, strikes, pandemics, government orders, or weather. In such cases, we may offer a credit for future services in lieu of a refund.
8. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of WomenHack and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of WomenHack.
9. Disclaimer of Warranties
The materials on WomenHack’s website are provided on an ‘as is’ basis. WomenHack makes no warranties, expressed or implied, and hereby disclaims all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
In no event shall WomenHack be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data or profit). In no event shall WomenHack’s aggregate liability exceed the amount you paid WomenHack, if any, in the past six (6) months.
11. Dispute Resolution (Binding Arbitration & Class Action Waiver)
11.1 Governing Law. These Terms are governed by the laws of the State of California.
11.2 Binding Arbitration. Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in Orange County, California, administered by the American Arbitration Association.
11.3 Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the Dispute between us and you individually. You expressly waive your right to participate in a class action lawsuit or class-wide arbitration.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
