Andrea Mazelliu is a faculty at the Department of Law, University of New York Tirana, and adjunct faculty at the Department of Public Law, University of Tirana. For the period of September 2023 – March 2024, he was a Fellow at the Freedom House, Europe and Eurasia Program focusing on the Moldova Justice Reform project and restricted environment countries. He is pursuing his doctoral studies at the Faculty of Law, University of Tirana, focusing on "Open Governance in Albania and its impact on the integration process." Andrea completed his master’s studies in Law, graduating as Valedictorian of the Class 2016. Beside his academic involvement, he has been involved with various Albanian and international institutions. His research interests encompass the fields of the rule of law and good governance, migration law, justice reform, transparency, the right to information, and public consultation. Andrea is an accomplished professional with comprehensive experience in the EU and Albanian legal and institutional framework.
He has presented at several international conferences, published numerous articles, and organized various academic projects. His most recent articles cover a range of topics, such as the Migration Crisis in the Western Balkans, Individual Constitutional Complaints, Public Consultation in the Western Balkans, Justice Reform, etc.

Ankimi individual kushtetues është një e drejtë e garantuar për çdo individ në Republikën e Shqip... more Ankimi individual kushtetues është një e drejtë e garantuar për çdo individ në Republikën e Shqipërisë si për aktet individuale të nxjerra nga pushteti publik që ka shkelur të drejtat e tij kushtetuese, ku zbatimi i tij do të vinte si rezultat i zbatimit në kundërshtim me kushtetutën, ose nga zbatimi i akteve normative antikushtetuese. Gjithashtu, ankimi kushtetues individual mund të bëhet edhe kundrejt akteve normative kur individi është i prekur drejtpërsëdrejti nga ky akt dhe ka një interes të drejtpërdrejtë. Në këtë mënyrë individët kanë të drejtë t'i drejtohen Gjykatës Kushtetuese (GJK) me anë të mekanizmit "ankim kushtetues individual", sepse i jep individit të drejtën për të garantuar drejtësinë kushtetuese dhe për të paraqitur një ankim më të plotë dhe gjithëpërfshirës dhe në këtë mënyrë garantimin më të plotë të të drejtavë individuale 604. This research paper explores the challenges posed by the influx of migrants leaving the Western B... more This research paper explores the challenges posed by the influx of migrants leaving the Western Balkan region and its impact on the European integration process. The paper investigates the policies and legal dimensions of the issue, examining the strategies and measures of the Western Balkan countries in compliance with their obligation to the European Union (EU). The migration crisis has become a significant challenge for the Western Balkan region and its relationship with the European Union (EU). The paper highlights the complex dynamics of the socio-legal phenomenon that WB countries face in full commitment to the EU's human rights settled standards and Chapter 24 on managing the migration crisis. The migration crisis in Western Balkan countries is highlighted as an important indication of the success of the EU integration process. It recommends the complex dynamics of this issue. This paper examines the implications of the issues for the broader context of the EU enlargement and challenges foreword. The nuances of the migrants and asylum seekers have increasingly important attention from the Western Balkan countries on the check matrices in full compliance with the EU acquis.

The accession to the European Union is a guarantee for the future of Albania. It will provide num... more The accession to the European Union is a guarantee for the future of Albania. It will provide numerous advantages once Albania becomes a full member. The rule of law holds an important place in the sustainability and equity of democratic governance, especially considering the European Union's accession process to the Republic of Albania. The vetting process in Albania is considered a mechanism that will ensure the rule of law in the judicial decision-making process and be an important condition that the country should overtake in ensuring an uncorrupted judiciary system. The justice reform and especially the vetting process is considered to as the main component of the accession talks with the European Union. The reform carries major objectives and benefits whose outcomes hope to quell several issues the candidate country is facing, aspiring to reach the equitable level of changes and proper harmonization on European Union's standards. The evaluation process is based on a three-criteria where temporary vetting organs conduct the investigation for each magistrate. Following this process, the dismissed judges have filed complaints to the European Court of Human Rights based on the right to due process.

The increasing emphasis on openness and transparency of policy making fits into the overall set o... more The increasing emphasis on openness and transparency of policy making fits into the overall set of reforms stemming from the EU accession process of the Western Balkan countries. Such an approach is especially relevant in the context of the requirements related to the public administration reform, good governance, rule of law as well as civil society development. This paper will analyse the legal framework regarding the public consultation, as key to public participation, in the public policy process of the Western Balkan countries in the light to the EU accession and approximation of their legislation with the EU legal standards. The paper will explore if and how such a legal framework has contributed to better public policies in these countries, as well as to their EU integration progress. Even though all the Western Balkan countries are not in the same stage in the accession process, challenges remain similar. The methodology of monitoring and accountability mechanism of the public consultation process is of high relevance for fulfilling this specific requirement. The tools that will be explored through this paper are aimed to contribute into improving the process in the Western Balkan countries.

The signed protocol between the Italian and Albanian governments (hereinafter agreement) on stre... more The signed protocol between the Italian and Albanian governments (hereinafter agreement) on strengthening the collaboration in the field of migration on 3 November 2023, brought turmoil in Albanian, Italian, and EU politics followed by public debate and constitutional challenges of the agreement as is sought to be approved by the parliament of both countries. Even though this is not the first agreement on the offshoring of migrants into a third country, it is crucial to highlight that it represents the first agreement involving an EU candidate country. The agreement entered between the two governments is currently facing legal uncertainty. In order for scholars and legal professionals to assess the constitutionality of the agreement, it is essential to review comparable models that have been contested in courts within either the hosting countries of the migrants or the destination country. This article aims to shed light to the constitutional basis of this protocol and further implications in its implementation.
