County Elections in Croatia: On the Path to Genuine Regional Politics

Croatian counties were tailored with little consideration for historical, natural, economic, soci... more Croatian counties were tailored with little consideration for historical, natural, economic, social, and professional criteria. They are rather small in size and population and there are considerable differences between them. Subnational electoral system with proportional representation, blocked lists and five per cent threshold causes deperso- nalisation of local politics. In addition, only few political parties and their political agendas could be identified as regional. Political arena in the counties is still dominated by national parties and their organizational branches while county elections are highly “nationalized” and subordinated to national elections. The analysis of congruence between county and national governments, turnout rates and electoral supply shows “second-orderness” of county elections resulting in voters’ orientation towards national elections and statewide parties. Local Public Services and Austerity Measures in Croatia: Adaptations of the Resilient Social Model Through the Central-Local Power and Blame Games

Local Public Services in Times of Austerity across Mediterranean Europe

An economic crisis hit Croatia in the period 2008–2014, simultaneously with the EU pre-accession ... more An economic crisis hit Croatia in the period 2008–2014, simultaneously with the EU pre-accession process, provoking various austerity measures in the public sector. The influence of the economic crisis on local service delivery in the healthcare, water, and waste sectors is analysed within the neo-institutional theoretical approach. The main Government’s austerity strategy in the three analysed sectors has aimed at efficiency through financial consolidation and institutional rearrangements. A muddling-through adaptation to environmental pressures has enabled the Croatian local governments to remain untouched by structural, territorial, or similar measures. They adapted to the new situation using the welfare needs as a barrier against any serious reform, despite an inclination towards centralization caused by the lack of capacities in the vast majority of them. It is concluded that the concept of resilient local authority opens appropriate research questions in times of crisis and wicked problems that befall local governments.

Istice se decentralizacija kao jedan od temeljnih reformskih procesa u suvremenim politicko-upravljackim sustavima europskih zemalja. No, decentralizacija nije jedini proces koji utjece na formiranje dobrih standarda upravljanja gradovima: nužno je uzeti u obzir i doktrinu dobrog upravljanja, koju podupire Europska unija, niz drugih međunarodnih organizacija, ali i sve veci broj zemalja. U ostvarenju standarda dobrog gradskog upravljanja razmatra se uloga mjesne samouprave u Hrvatskoj, a napose u velikim gradovima i Gradu Zagrebu. Upozorava se da osnivanje preko dvije stotine mjesnih odbora kao zasebnih pravnih osoba vodi prema fragmentaciji Grada Zagreba i bitno otežava ili cak i onemogucuje integrirano gradsko upravljanje i smisleno rjesavanje urbanih i upravljackih problema.

The traditional forms of citizen participation are referendum, citizens’ initiative, deliberative assemblies, sub-municipal governance, and occasional consultative meetings. The main new forms are introduction of the direct election of mayors and recall referendum, strengthening the role of local mayors, and independent actors in local politics. Several governance processes have been common to the countries in South Eastern Europe. The devel... more Several governance processes have been common to the countries in South Eastern Europe. The development administrative education emancipated from traditional legal education is but one of these processes. The slow development of quality administrative education is a result of specific combination of public administrations’ demands on one hand, and supply of universities with regard to administrative education, on the other. Demands are not consolidated because there is still strong politicisation of public administrations. Old state universities are sclerotic, while many small new universities offer rather low quality education, mostly for the private, not for the public sector.

Many countries in Western Europe consolidated their territorial organization in the last few deca... more Many countries in Western Europe consolidated their territorial organization in the last few decades, searching for increased capacities. Great Britain, Germany and Denmark are the examples of such reforms. Certain transitional countries (Czech Republic, Slovakia, Hungary, Slovenia, Croatia, etc.) went in opposite direction, fragmenting the structure of their local governments. In the third group are the countries that mainly retained the structure of their municipalities. They have local units of very different sizes, like France, which has made changes in some other dimensions of its local government system - by introducing regions, fostering intermunicipal cooperation, and by preparing special status of metropolis. Perspektiva Hrvatske da se pridruži Europskoj Uniji namece niz problema u vezi s modernizacijom n... more Perspektiva Hrvatske da se pridruži Europskoj Uniji namece niz problema u vezi s modernizacijom njezine uprave i prihvacanjem upravnih standarda međunarodne zajednice. Na temelju obrade dosadasnjeg razvoja hrvatske javne uprave autor zakljucuje da hrvatska uprava jos nije dostigla ni weberijanska nacela a nije se, dakako, niti približila koncepciji novog javnog menadžmenta. Proces decentralizacije i reforma lokalne samo-uprave nisu sustavno osmisljeni niti provedeni, upravno osoblje nije adekvatno obrazovano. Navedene su autorove koncepcije reforme hrvatske državne uprave (cilj – vrijednosti, mjere – organizacijske, tehnicko-tehnoloske, personalne, faze – policy mjere, normativni okvir, primjena i prilagodba). Predlaže se metodologija izvođenja cijelog projekta (matricna organizacija, ekspertni timovi) te se navode neka podrucja koja bi bila podvrgnuta temeljitoj reformi (strukturni aspekt, funkcionalni aspekt, personalni aspekt).

Pružanje javnih usluga na jedinstvenom upravnom mjestu (one-stop shop, point of single contact) j... more Pružanje javnih usluga na jedinstvenom upravnom mjestu (one-stop shop, point of single contact) jedan je od elemenata integriranog javnog upravljanja koje je usredotočeno na potrebe građana, poduzetnika i drugih korisnika javnih usluga. Jedinstveno upravno mjesto može se organizirati kao točka fizičkog ili digitalnog kontakta te obuhvatiti manji ili veći broj javnih usluga koje se pružaju građanima ili poduzetnicima bez obzira na nadležnosti i međusobne institucionalne odnose različitih tijela javne uprave. Temeljna ideja preuzeta je iz poslovnog sektora, a polazi od stava da korisnik ne mora znati niti se opterećivati organizacijom i poteškoćama u radu javne uprave: on treba dobiti traženu upravnu uslugu brzo, efikasno, kvalitetno i jeftino. Javna se uprava treba organizirati tako da s korisnicima komunicira, na što jednostavniji način i na jednom fizičkom ili digitalnom mjestu, vanjska jedinica za pružanje usluga (front office), dok se ostali potrebni upravni procesi odvijaju u pozadini, u interakciji tijela javne uprave s različitim ovlastima. The paper presents the current state of the process of agencification in Croatia, pointing out bo... more The paper presents the current state of the process of agencification in Croatia, pointing out both the process and the institutional design. The agency model in Croatia consists of several types of more or less autonomous administrative organizations, situated at different distances from the central government. The most evident pressures for agencification come from decentralization, managerial responses and Europeanization. The reversal of the process in recent years has mostly happened because of the need for rationalization of the public administration system, which is also under pressure because of the economic crisis. The key problems of the agency model are over politicization on the one hand, and insufficient and inadequate control on the other. The adequate legal framework for agencies would enhance institutionalization of the agency model, ensuring effectiveness and legal certainty and maintaining a sufficient level of independence.

Siroj participaciji građana u lokalnoj samoupravi pridaje se sve vise pažnje, ne samo na razini t... more Siroj participaciji građana u lokalnoj samoupravi pridaje se sve vise pažnje, ne samo na razini temeljnih međunarodnih pravnih dokumenata koji uređuju lokalnu samoupravu vec i u zakonodavstvima i praksi mnogih europskih zemalja. U radu se najprije analiziraju i sistematiziraju najcesci oblici participacije građana: skupstina svih građana lokalne jedinice, lokalni referendum, građanska inicijativa, submunicipalna samouprava i mjesni zborovi, opoziv izabranih dužnosnika te sudjelovanje građanskih listi i kandidata građana u lokalnim izborima. Analizira se njihova primjena u nekim europskim zemljama. Na kraju se analizira stanje u Hrvatskoj, s posebnim težistem na analizi zakonskih promjena koje su nastupile od 2013. godine.

The paper presents the current state of the process of agencification in Croatia, pointing out bo... more The paper presents the current state of the process of agencification in Croatia, pointing out both the process and the institutional design. The agency model in Croatia consists of several types of more or less autonomous administrative organizations, situated at different distances from the central government. The most evident pressures for agencification come from decentralization, managerial responses and Europeanization. The reversal of the process in recent years has mostly happened because of the need for rationalization of the public administration system, which is also under pressure because of the economic crisis. The key problems of the agency model are over politicization on the one hand, and insufficient and inadequate control on the other. The adequate legal framework for agencies would enhance institutionalization of the agency model, ensuring effectiveness and legal certainty and maintaining a sufficient level of independence.

Siroj participaciji građana u lokalnoj samoupravi pridaje se sve vise pažnje, ne samo na razini t... more Siroj participaciji građana u lokalnoj samoupravi pridaje se sve vise pažnje, ne samo na razini temeljnih međunarodnih pravnih dokumenata koji uređuju lokalnu samoupravu vec i u zakonodavstvima i praksi mnogih europskih zemalja. U radu se najprije analiziraju i sistematiziraju najcesci oblici participacije građana: skupstina svih građana lokalne jedinice, lokalni referendum, građanska inicijativa, submunicipalna samouprava i mjesni zborovi, opoziv izabranih dužnosnika te sudjelovanje građanskih listi i kandidata građana u lokalnim izborima. Analizira se njihova primjena u nekim europskim zemljama. Na kraju se analizira stanje u Hrvatskoj, s posebnim težistem na analizi zakonskih promjena koje su nastupile od 2013. godine.

Vršitelj dužnosti pročelnika upravnog odjela jedinice lokalne samouprave ili gradskog ureda Grada... more Vršitelj dužnosti pročelnika upravnog odjela jedinice lokalne samouprave ili gradskog ureda Grada Zagreba nije reguliran ni jednim zakonom. Neki stručnjaci smatraju da je riječ o pravnoj praznini, odnosno o slučaju podnormiranosti, budući da je institut pročelnika reguliran, kako za ostale jedinice lokalne samouprave tako i za Grad Zagreb, ali zakoni ne propisuju postupanje u slučajevima koji mogu nastati u praksi da primjerice pročelnik umre, nestane, iznenada izgubi zdravstvenu sposobnost za obavljanje službe, zatraži razrješenje, odluči otići u prijevremenu mirovinu i drugim sličnim izvanrednim slučajevima koji se ne mogu unaprijed predvidjeti. Što tada? Kako odmah nadomjestiti pročelnika, kad to zapravo u tim situacijama nije moguće? Bilo bi prikladno da se takav institut regulira zakonom o lokalnoj samoupravi ili lokalnim službenicima, ali zasad to nije slučaj. U praksi se međutim imenovanje vršitelja dužnosti pročelnika upravnih tijela jedinica lokalne i područne (regionalne) samouprave ipak koristi.

This book explains the increasing demand for evaluation as a result of the increasing frequency o... more This book explains the increasing demand for evaluation as a result of the increasing frequency of reforms to local services, influenced by the New Public Management doctrine, the severe austerity policy in many European countries, and the wish to increase quality and reduce costs of public services, especially at the local (sub-national) level. Positioned at the interface of local services and evaluation research, it will enable the utilization of evaluation-generated knowledge in evidence-based policy making by focusing on the lessons learned from evaluation of local service delivery. It encompasses local public and social services (including waste, water, public transport, healthcare, education and eldercare) and examines the hypothesis that there is a North-West–South-East divide in Europe in terms of the evaluation of local service reforms. Particular attention is devoted to the explanatory function of evaluation. Providing fresh insight into the functioning of local government machinery in contemporary Europe, this book will appeal in particular to practitioners and students of local government, public economy, public administration and policy.

To this day, it is widely referred to as Central and Eastern Europe (CEE). This book represents an overview and a reflection of changes in countries that implemented the most profound public administration reforms (PAR) – countries that joined the European Union (EU) between 2004 and 2013.

Contributors to this book are prominent public administration researchers in their respective countries; this allows for in-depth insights both into the history of reforms, as they were experienced and into current topics of PAR as they are debated at the national level. We find that the concept of CEE has lost relevance in public administration research, and we are in need of a more nuanced theory. In the face of mounting challenges to EU integration this book, we believe, will contribute to the search of public governance solutions for the benefit of all Europeans.

This study was prepared in the autumn of 2015, with subsequent assessments of the newest developm... more This study was prepared in the autumn of 2015, with subsequent assessments of the newest developments in the Region until the beginning of April 2016. The expert team of the Institute of Public Administration from Zagreb, Croatia was commissioned to prepare the study. The team consisted of researchers who have substantial experience in supporting, monitoring, assessing, and researching administrative modernization efforts in the Region. They are university professors and lecturers, with experience as international experts for administrative modernization and administrative procedural law development, and scientific research of public administration reforms. The expert team collected an impressive amount of information, data, and legislation from six Western Balkan countries and three countries whose experience seems particularly important for the Western Balkans – Austria, Slovenia, and Croatia, all three now the EU member states. Taking into account that legal remedies are the heart of the system of protecting citizens’ rights in their relations with public administration bodies, the study presents and analyses the development of administrative procedural law framework, discusses widening the concept of protection of citizens’ rights, analyses legal remedies and ex officio interventions into administrative acts, and concludes with alternative dispute resolution mechanisms. Numerous recommendations have been developed from the analysis and presented in the study. The expert team hope that recommendations and lessons learned may significantly contribute to administrative improvements in the Region and beyond.
