Drawing a comparison with international background, it is examined the organization of microcredit service providers as well as user-provider contracting relationship. Provided financial inclusion as rationale of microfinance, the analysis maintains that there is a microcredit standard to deal and it is so heavily characterizing microfinance business that inclusive objective becomes legally relevant in user-provider contractual relationship as well as in corporate structure of service providers.

This chapter takes a normative approach to examining Islamic finance within a non-Islamic setting... more This chapter takes a normative approach to examining Islamic finance within a non-Islamic setting, namely, the European Union (EU). It is, however, far from being an overview of Islamic financial principles or Shari'a - compliant products and activities, nor is it an in-depth analysis of community-based regulation for banking and financial undertakings. What it aims to do is to take the community-based framework as a more workable legal setting than national ones, and by analysing how the accommodation process is carried out, this study challenges the mainstream approach that subsumes Islamic financial undertakings within conventional banking and financial regulation as if Islamic financial undertakings were directly comparable with other socially responsible enterprises or ethical businesses. The main focus is to argue for the normative autonomy of Islamic finance, that is, of Islamic rules applied to the management of money within the EU legal order, analysing the consequent regulatory challenges and opportunities for the European lawmaker

To which extent can money support the community construction process? Thinking of money as a means of community construction, which are the main results achieved at the European Union level? What can we learn from the past?

Information about Islamic finance in European countries is usually provided by professional-style... more Information about Islamic finance in European countries is usually provided by professional-style reports, offering practical data on implementation of standardized products. However, precise developments about material legal provisions applicable to contracts and their actual legal regime are not often detailed. In order to fill this gap, 15 researchers from across Europe contributed to this project. They describe the state of actual Islamic fi nance in 10 European countries, as well as applicable EU law. By combining legal analysis with statistical description of existing practices and social demand, this book provides an exhaustive account of the current potential of Islamic finance in Europe.
