La scure dell'Original intent su cinquant'anni di nodi irrisolti in materia di aborto Valeria Marzocco BEFORE DOBBS. THE AXE OF ORIGINAL INTENT ON FIFTY YEARS OF UNRESOLVED ABORTION ISSUES ABSTRACT: Dobbs v. Jackson marks an Overruling in Supreme Court jurisprudence of historic significance. By denying constitutional relevance to the right to abortion, the Court restores an orginalist reading of the US Constitution and selectively operates on the subject of civil rights, arguably ushering in a season that could have repercussions for reproductive rights and women's freedom to exercise control over their own choices. The qualification of abortion, which had been consolidated with Roe v. Wade and later with Planned Parenthood v. Casey, had been far from without weaknesses. Both the Court's dissenting opinions and legal doctrine had addressed these aspects, focusing on the Penumbra of the Fourteenth Amendment of the US Constitution, reflecting on the appropriateness of anchoring abortion to the equality clause offered by the Thirteenth Amendment, and focusing on the limits of a construction based on the public/private dichotomy. Fifty years of unresolved issues, of which this essay attempts to summarise the main issues.

Who decides on Embryo? The Italian 'Rules Governing Assisted Fertiliza-tion' (L. 40/2004) allows ... more Who decides on Embryo? The Italian 'Rules Governing Assisted Fertiliza-tion' (L. 40/2004) allows clinical and experimental research on a human embryo only under the condition that therapeutic and diagnostic procedures are conducted to protect the health and development of the embryo itself, and excludes experimentation on embryos (art. 13 L. 40/2004). Recently, this article has been offered to the Italian Constitutional Court's consideration (C.C. 84/2016), under the lens of a balancing text between the freedom of research and the protection of human dignity. The legal and philosophical construction of what (or who) an embryo is, in its relation with human dignity, is very interesting to analyze. In this sense, the Italian Constitutional Court's judgment is crucial, because of the particular interpretation of the Aris-totelian argument, often spent in this topic, but even for the boundaries that it poses between law and science in defining the theoretical and legal status of the embryo.

Recently, the scientific debate on the relationship between law and cognitive neurosciences has s... more Recently, the scientific debate on the relationship between law and cognitive neurosciences has sensibly developed, so much that some argues about the necessity to consider this relationship as a new field of legal disciplines. Several are the issues that should be taken into account, such as the value of neuroscientific opinions and reports within the legal proceeding or the evolution of the concept of legal competence. From a philosophical viewpoint, these new scientific developments call for a re-evaluation of the concept of legal personhood and for a reconsideration of traditional concepts, such as the notion of free will. The aim of the paper is to address the ai issues that the e elatio ship et ee la a d eu os iences is raising, offering some possible solution for the integration of neuroscientific concepts in the legal discourse. In consideration of the difficult determination of its legal concept, it is necessary to have a look back to that period, in order to understand both the legacy and promises involved in the protection of human dignity. This means that human dignity allows to investigate the philosophical foundations of contemporary constitutionalism, in relation to the person and his claim to be the source of production and public representation of meanings attributable to the "Self".
