This article provides an analysis of the ways in which European Union Member States have sought to address the educational needs of elite young sportspersons. Drawing on fieldwork by 25 research teams led by the authors and undertaken on behalf of the European Commission, it reflects the European Union's increasing concern with protection of the rights of young athletes. Our focus in this paper is on higher education and its adaptation to accommodate the delivery of education to elite athletes. The review of policy descriptions undertaken highlighted three principal categories of policy initiative within the university sector namely the development of academic services, elite sporting provision, and post-athletic career preparation. The findings of the study underlined the variability of response in national systems to the demands placed on elite young sportspersons. This has been more broadly linked to the relationship between general welfare ideologies in nation states, and the positions adopted in relation to education of their young athletes. We characterise these positions in a four-fold typology: (i) a state-centric provision backed by legislation, (ii) the state as a facilitator fostering formal agreements between educational and sporting bodies, (iii) National Federations / Sports Institutes as facilitator / mediator engaging directly in negotiation with educational bodies on behalf of the individual athlete, and (iv) a ‘laisser faire' approach where there are no formal structures in place. Crucial to an evaluation of the systems summarised in the typology is an understanding of what these policy systems are seeking to achieve. This may be expressed in terms of a balance between the roles, rights and responsibilities of the main stakeholders including the athlete, the university, the Member State and the European Union.Este artículo analiza los diferentes modos en que los estados miembros de la Unión Europea han intentado solucionar las necesidades educativas de los atletas de élite. Basándose en trabajo de campo realizado por 25 equipos diferentes dirigidos por los autores del artículo y financiado por la Comisión Europea, este artículo refleja la creciente preocupación por la protección de los derechos de los atletas jóvenes en e marco de la Unión Europea. El principal punto de atención del artículo es la enseñanza universitaria y su adaptación a las necesidades de los atletas de élite. El análisis de las distintas políticas de los estados miembros ha subrayado la existencia de tres iniciativas diferentes en el sector universitario: el desarrollo de servicios académicos, la provisión de instalaciones y servicios deportivos de élite y preparación para la vida laboral después de la carrera deportiva. Los resultados del estudio muestran la existencia de una alta heterogeneidad en las respuestas de los distintos sistemas nacionales a las necesidades de sus atletas. En un contexto más amplio, esta amplia gama de políticas puede conectarse a la diversidad en las relaciones existentes entre las distintas ideologías sobre el estado del bienestar en los estados miembros y las políticas adoptadas en relación a la educación de los deportistas de élite. In the form of an essay, the author proposes a review of the reasons behind the recent changes in forestry policy. He identifies two explanatory elements and goes into these in more detail: the loss in cohesion in sectorial forestry logic since the 1980s, and the internal division which has arisen on account of the failure to put through the partial revision of the Federal Forestry Law.

This research examines the impacts of the Swiss reform of the allocation of tasks which was accepted in 2004 and implemented in 2008 to “re-assign” the responsibilities between the federal government and the cantons. The public tasks were redistributed, according to the leading and fundamental principle of subsidiarity. Seven tasks came under exclusive federal responsibility; ten came under the control of the cantons; and twenty-two “common tasks” were allocated to both the Confederation and the cantons. For these common tasks, it wasn’t possible to separate the management and the implementation. In order to deal with nineteen of them, the reform introduced the conventions-programs (CPs), which are public law contracts signed by the Confederation with each canton. These CPs are generally valid for periods of four years (2008-11, 2012-15 and 2016-19, respectively). The third period is currently being prepared. By using the principal-agent theory I examine how contracts can improve political relations between a principal (Confederation) and an agent (canton). I also provide a first qualitative analysis by examining the impacts of these contracts on the vertical cooperation and on the implication of different actors by focusing my study on five CPs - protection of cultural heritage and conservation of historic monuments, encouragement of the integration of foreigners, economic development, protection against noise and protection of the nature and landscape - applied in five cantons, which represents twenty-five cases studies.

Si la Suisse est quelque peu singulière à de nombreux égards, elle n’est pas étrangère à certains blocages et
dysfonctionnements internes relatifs à l’organisation des prestations étatiques, ayant légitimés la prise en
considération de certains courants réformateurs du secteur public. Cette étude se construit autour de la plus
importante réforme effectuée en Suisse: la réforme de la répartition des tâches, votée en 2004 et mise en oeuvre en 2008. Réorganisation fondamentale du fédéralisme, elle est surtout le produit de conflits divergents, de visions qui s’affrontent et de logiques qui se restructurent. Elle bouscule les rapports de pouvoirs entre la Confédération, les cantons et les communes, afin de revitaliser en profondeur le
fédéralisme. Cet article s’intéresse donc, d’une part, à la manière dont la Suisse a fait évoluer son fédéralisme
conformément à son contexte spécifique et, d’autre part, aux répercussions que ces évolutions ont eues sur
l’autonomie des cantons et des communes. Pour ce faire, après avoir brièvement explicité la notion d’autonomie dans le cadre de l’approvisionnement des services publics, nous présentons la réforme de la répartition des tâches, sa genèse, ses spécificités, ses principes, ses influences et ses répercussions
constitutionnelles. Ensuite, nous nous intéressons aux impacts de la réforme sur l’autonomie cantonale et
communale respectivement. Nous mettons enfin les principales tendances en perspective, pour finalement en
tirer des conclusions.

La Confédération et les cantons avaient clarifié les compétences des uns et des autres en 2008. Depuis lors, les conventions-programmes se sont multipliées. Même si les cantons en sont plutôt satisfaits, elles ne vont pas dans le sens d’un désenchevêtrement des tâches ou de leur simplification.

Les conventions-programmes sont apparues dès 2008, dans la foulée
de la réforme de la péréquation financière et de la répartition des tâches, pour partager de manière plus moderne les tâches et leur financement entre la Confédération et les cantons. Malgré quelques dysfonctionnements persistants, ces contrats d’un genre nouveau donnent une dynamique et un cadre plus clairs aux acteurs de l’administration.
