Since 2004 I’ve been Research Fellow in the field of Private law (IUS/01) at the University of Brescia – Law Faculty
EDUCATION
In 2004 I took my Ph.D. in Private Law (XVI cicle) at University of Pisa (coordinated by prof. Umberto Breccia). I graduated in Law at Brescia University in 110/110 (cum laude) with honors presenting a dissertation in Private Law about New regulations on Unfair Terms in Consumer Contracts.
RESEARCH ACTIVITY

In November 2009 I've been Visiting Scholar at the Loyola Law School in Los Angeles, CA.
In November 2008 I was invited as a visiting fellow at the The Institute of European and Comparative Law, University of Oxford, Uk, Faculty of Law. On Thursday 27 November 2008 I held a seminar for the Comparative Law Discussion Group on the topic: Full Compensation Principle in European Tort Law.
TEACHING APPOINTMENTS
Since 2007/08 I've been teaching Private Law at Brescia Law School.
Since 2002/03 I’ve been coordinating the Cyber Law course at the Post Graduate School for Legal Professions in the Brescia University. Since academic year 2006/07 I’ve been teaching E-commerce Law in Brescia Law School; since 2003/04 I’ve been teaching Sport and Private Law in University of Brescia Medicine and Surgery Faculty (curriculum in Athletic Training and Sports Medicine)
In the period 2002/03-2005/06 I taught “Information Technology and Law” (Informatica giuridica) at Brescia Law School; from 2000/01 to 2002/03 I taught in a module in the course of “Informatica giuridica”.
PUBLICATIONS
I wrote several articles, comments and essays in law journals about non pecuniary losses, personal injury, distance marketing of consumer financial services
TEACHING INTERESTS
Currently, I give undergraduate lectures in Sport and Law and Cyberlaw dealing principally with digital signatures and electronic document; e-contract, e-privacy; ISP liability, Online Dispute Resolution.
I give tutorials in Privacy and Data Protection and Insurance Law.
RESEARCH INTERESTS
My research interest is focused on Full Compensation Principle in Tort Law, Punitive damages, Peine privée and the Functions of Tort Law.

The progressive paradigm shift from the centralized generation of electricity towards decarbonize... more The progressive paradigm shift from the centralized generation of electricity towards decarbonized and distributed energy systems is deeply changing the way energy is produced, distributed, and consumed. A relevant attention is currently being paid to the development of innovative control strategies for the management of the increasing complexity of power demand and generation patterns. Several research studies investigated this topic, by making use of simulation and emulation environments. However, this model-based approach may present relevant limitations when applied in real operating environments, due to the stochastic nature of real-world use cases. The aim of this study is thus to present a testing infrastructure able to deploy and test innovative Smart Grid and energy concepts in a real environment, by making use of operating energy assets and of real users’ behavior and power demand profiles.

Il sito https://webgate.ec.europa.eu/odr offre uno strumento orientato all’utente per gestire i reclami tra un consumatore (consumer) e un venditore professionale (merchant). I dati e le statistiche di funzionamento confermano che per rendere efficaci queste meritevoli iniziative è necessario promuovere una cultura della mediazione in favore di una “spinta gentile” verso uno sviluppo armonioso e virtuoso del commercio elettronico in Europa

Si sottolineano l'inadeguatezza della tutela formale del Codice Civile rispetto alla tutela contenutistica del Codice del Consumo e le difficoltà applicative legate alle peculiarità della contrattazione online. Dopo aver esaminato alcune tipologie di clausole vessatorie utilizzate in contratti dall'ambito assicurativo sino alle licenze open source, sono analizzati gli strumenti di controllo amministrativo, dalle Camere di Commercio all'Autorità Garante per la Concorrenza, senza trascurare le prospettive europeistiche

La libertà di accesso ai documenti ufficiali attiene al più ampio diritto all’informazione e ne fanno parte a pieno titolo il diritto di informare e lo speculare diritto di “ricevere informazioni”. Dopo aver analizzato l'articolata disciplina del diritto di accesso in Italia, viene fornita una disamina della prassi del Garante. In conclusione, considerata l'esperienza in tema di accesso a documenti UE, registri pubblici e altri casi particolari, viene offerta una panoramica della giurisprudenza delle Corti Europee in tema di accesso ai documenti ufficiali

Il notaio dopo aver verificato l'accreditamento, provvide, ma con ritardo, si sosteneva, all'iscrizione ipotecaria, a seguito del quale, si sarebbero verificati danni di cui veniva richiesto il risarcimento. La sentenza annotata conferma l'iter argomentativo seguito dalla Corte d'appello, secondo la quale la responsabilità del notaio era da escludere perché i fatti dannosi lamentati dall'attore si sarebbero comunque verificati ancorché il notaio avesse provveduto il giorno immediatamente successivo alla verifica della disponibilità della somma di cui all'assegno. Cloud Learning Systems and Privacy Regulation in Europe

The aim of my contribution to the ICERI2014 conference will be to analyze the privacy issues in o... more The aim of my contribution to the ICERI2014 conference will be to analyze the privacy issues in online learning systems and discuss them in relation to the legal framework in Europe, taking into account the next step forward. The impact on learning systems of the proposal of new privacy regulation in Europe, along with the adoption of guidelines in cloud systems contracts, should be the core subject of this study. Specific attention will be drawn on the contract and service license agreements between the institution (school or business) and the cloud providers and towards end-user (learners) and the use of privacy policy. From the legal perspective, the intellectual property and privacy issues are the more relevant in this field nowadays: my analysis will the focus on the latter and its relations with security and trust. The increasing demand of online learning systems as school and business tools is allowing service providers to develop sophisticated tools. While the technology is allowing more and more interaction between the pupils and the teacher, many of these aren’t aware of the issues related to security and privacy of their data. Furthermore, trust between co-learners and towards the institution that deliver the online course rely heavily on the security features embedded in the platform. The availability and disclosure of information is also a matter of trust. Anonymity could offer a better privacy protection but could also diminish trust, mostly in collaborative work’s environment. The attribution and control of the identity of the parties involved is also important and will be increasingly complex to deal with the use of mobile devices to access the learning systems. Nowadays are also available webcam or wearable sensor which allows simulated session in specific fields (e.g. health and surgery or aviation learning) and could gather a lot of sensible data, their application in online learning systems would necessitate to specific measures in order to avoid misuse or data-leaking. The competing need of evaluation and tracking of the learner’s activity from one side can be fulfilled building systems privacy-compliant since their first development. In the proposal of regulation from EU, which will replace the Directive 95/46, the EU Commission is willing to embrace the Privacy By Design approach (PBD): the implication on e-learning systems will be discussed in the final paper. The use (and abuse) of cloud computing services is spreading in each sector of economic activity and learning field is no exception. The subtlety and specifications of this technology is particularly relevant since the easiness to interact also on mobile devices. Mobile devices access is a feature that poses many dangers in terms of privacy. The Art. 29 Working Group, gathers the privacy Authorities of the European member states, on Opinion 05/2012 on Cloud Computing published as document WP 196 in early July 2012, discussed the risks of this technology. On June 26, 2014 the EU Commission delivered the Cloud Service Level Agreement Standardisation Guidelines drafted by the Cloud Select Industry Group, which should be helpful to providers and users to fully explain and understand the legal content of their agreements. Technology and digitalization may offer useful tools to open up new perspectives. Digital Citizenship, which is endorsed by institutions such as UNESCO and UN, could overcome inequalities and barriers due to social, environmental, or territorial limitations (inhabitants of rural areas, disabled persons, women, children). Education and training could improve digital skills but also support a more responsible approach to this new framework of social and political relations and to advance a broader access to the network and accessibility to sites and platforms, along with a progressive digitization of public administration. The aim is to develop inclusion through education, to encourage participation and to mitigate the risks of an algorithmic control.

Oggi metà degli abitanti del pianeta vive in città e si stima che nei prossimi 10 anni questa quo... more Oggi metà degli abitanti del pianeta vive in città e si stima che nei prossimi 10 anni questa quota raggiungerà il 75% della popolazione mondiale; tale percentuale è già stata raggiunta in Europa, dove vi sono ben 468 città con almeno 100.000 abitanti. Le città occupano solo il 2% della superficie mondiale ma consumano i tre quarti delle risorse; allo stesso tempo le prime 25 città del pianeta producono metà della ricchezza dell'umanità. Le aree urbane europee consumano il 70% dell'energia dell'intera Europa, che genera il 75% delle emissioni di gas serra. Globalmente stiamo consumando in 282 giorni le risorse che il pianeta produce in 365. La soluzione di questi problemi richiede l'adozione di un "nuovo modello di città", di comunità locale, di fruizione della città e dei suoi servizi, che sappia coniugare innovazione, efficienza, sostenibilità, inclusione e sviluppo.

In a period of hyper-competition for resources, with perverse incentives that lead to academic capitalism and a “publish or perish” mentality, the lack of robust and cumulative research on approaches, models and practices of peer review can slow down efforts towards fostering research integrity and the credibility of scholarly communication.
