Proche des intérêts de cette région, il a fortement soutenu ses entreprises, au Canada comme à l'étranger. Son appui au secteur privé s'est traduit par la restructuration de certains services du gouvernement, comme Exportation et développement Canada (EDC) pour soutenir l'activité minière de ces entreprises à l'étranger. Le budget fédéral a été modifié également pour les épauler. Cet article examine divers aspect de cette politique : le retrait du gouvernement du protocole de Kyoto ; la stratégie d'ouverture des ressources naturelles du Canada et donc de son territoire, impliquant la transformation des Territoires du Nord-est, du Yukon, et du Nord du Québec ; la reformulation de l'aide au développement, maintenant destinée aux entreprises canadiennes; la création d'un discours officiel qui voudrait concilier les activités des entreprises d'extraction avec la politique internationale du Canada, à travers la certification « entreprises socialement responsables » et pour finir la promotion du Canada comme paradis fiscal pour les entreprises minières. It is often said that Harper brought his Western views and some Western vested interests to the federal office. Canadian mining companies and mineral processing industries are close to his heart and he has defended their economic interest at home and supported their investments abroad. This implied a restructuration of government agencies and ministries' policies to serve and support the mining sector. For instance the federal budget has been revised to support mining companies' exploration investments at home, and Export Development Canada a public institution operating on commercial principles, with a mandate to support and develop Canada´s international trade and to enable Canadian companies to participate in, and respond to, international business opportunities, is helping Canadian mining companies to develop internationally. This article examines several aspects of Harper's economic and industrial policies and their impact on Canada: the government's withdrawal from the Kyoto protocole ; plans for the opening of Canada's natural resources to business and mining which imply a new governance for the NorthWest Territories, the Yukon, and Northern Quebec ; the revision of the ACDI's missions dealing in the administration of foreign aid programs for developing countries which can now be granted to Canadian businesses and mining companies who demonstrate their will to invest in foreign mining development (not NGOs only); and the new branding of Canada as a tax haven for foreign companies.

This chapter focuses on a contemporary analysis of the rule of law, one that has strayed from its original purpose: to ensure that the equality of any individual or government prevails, before the law. By this, we mean a rule of law that is increasingly being used selectively to favor the interests of certain governments and companies over others. This analysis examines how the original subject of the rule of law, that is, the individual, has been replaced by economic entities personified in corporations and how the agreements for the protection of foreign investment are the most useful instrument for companies to discipline the self-determination of governments. Mar ıa Teresa Guti errez Haces This article examines the changes in the Mexican mining sector ove... more Mar ıa Teresa Guti errez Haces This article examines the changes in the Mexican mining sector over the past 20 years resulting from the implementation of more than 19 economic agreements endorsed by the Mexican government. The analysis highlights how the protection that these instruments have provided to the movement of North American capital has facilitated the positioning of Canadian mining companies through direct investment or co-investment projects with Mexican and foreign companies. Unlike in other Latin American countries with an important extractive industry and a clear dominance of foreign investment, since 1994, Mexican and Canadian capitals have been relatively complementary, although Mexican mining companies continue to dominate the mining industry. Finally, the article examines the 2013 constitutional energy reform and its effects on the mining activity. Este articulo analiza los cambios que se han dado en el sector minero en M exico desde hace m as de 20 años como resultado de la instrumentaci on por parte del gobierno de m as de 19 acuerdos de car acter econ omico. El an alisis señala c omo la protecci on proporcionada mediante estos acuerdos al flujo de inversi on extranjera ha facilitado el posicionamiento de mineras canadienses en el sector extractivo mediante las inversiones directas o de coinversi on con empresas mexicanas y extranjeras. A diferencia de otros pa ıses latinoamericanos con una fuerte industria minera y un dominio claro de inversi on extranjera, desde 1994, el capital mexicano y canadiense se han complementado de forma relativa, aunque las empresas con capital mayoritariamente mexicano siguen predominando. El art ıculo concluye con un an alisis del impacto de la reforma energ etica de 2013 sobre las empresas extractivas extranjeras.

Dicho régimen internacional ha transitado por diferentes etapas y se encuentra en un punto crucial para su desarrollo, ya que está enfrentando una crítica muy fuerte a sus principales pilares, con una particular participación de los países en desarrollo.
During the global crisis, Foreign Direct Investment (FDI) has withdrawn from developed economies ... more During the global crisis, Foreign Direct Investment (FDI) has withdrawn from developed economies and has substantially increased in emerging and transitional economies. In this scenario, Mexican MNEs have been spreading during the last four years, after starting their internationalization two decades ago. In this paper, we show that the relationship between two factors— economic sector and geographical location of FDI — explains the difference in outcome of corporate operations during the crisis. While positive results have been found regarding investments in Latin America and Asia, less favorable results are registered in investments in Europe and the United States. These findings modify the theoretical approach on the “location determinants” of FDI. Our sources are enterprise's websites and direct surveys applied during the last four years for a sample of 20 of the largest MNEs in Mexico.
