
Bjarne Melkevik
Dr. Bjarne Melkevik received his Candidatis Juris from the University of Oslo (Norway) and his Doctorat d’État in Legal Science (Thesis granted with Award of Excellence) from the University of Law, Social and Economical Science (Paris 2) in France. He has taught General Legal Theory and Philosophy of Law at the University of Tromsö (Norway), and General Legal Theory and Comparative Law at the University of Quebec in Montréal (Canada), and he is now Titular Professor at the University Laval in Quebec (Canada) where he teaches and conducts research at both the undergraduate and graduate schools. His mains research and teaching area are Legal Philosophy (Philosophy of Law), Legal Methodology, Legal Epistemology and Legal Science, and Legal Policy. In recent years he has published “Philosophie du droit. Volume 1” (2010); “Droit, mémoire et littérature” (2010); “Marxisme et philosophie du droit: le cas Pasukanis” (2010), “Habermas, droit et démocratie délibérative” (2010) and « Philosophie du jugement juridique » (2010). He has published (in spanish translation) : «Rawls o Habermas. Un debate de filosofía del derecho » (2006).

Il faut sans ambages se pencher sur la conception de modernité du droit que nous propose le philosophe allemand Jürgen Habermas. Il faut aborder, analyser et réfléchir sur la signification que nous pouvons accorder aux contributions philosophiques et théoriques qu’il nous offre tant sur le droit, la démocratie, la délibération politique que sur d’autres thèmes touchant encore la question juridique. Dans le paysage intellectuel, philosophique ou encore juridique de notre contemporanéité, Habermas est indubitablement un penseur incontournable et certainement le plus prometteur pour mettre les pendules à l’heure en ce qui concerne notre projet moderne et la possibilité de droit qui doit l’accompagner.
Именно над такими вопросами рассуждает в этой работе профессор Университета Лаваля Бъярн Мелкевик. Он помещает данные вопросы в характерный для них географический и в постсоветский политический контекст: коммунизм и человек: революционный дух, диссетентство, репрессии, травля и фанатизм. Автор исследует идеологические источники и работы, посвященные Пашуканису, для того, чтобы дать им критику или использовать их в целях формулирования правильной интерпретации марксизма. Речь идет о явном марксизме, а также о марксизме Энгельса, Ленина и Сталина. Может ли юридическая современность оставить себе что-то из всех этих произведений, относящихся к тому смутному периоду, - в которых описывается вечный конфликт пролетариата и буржуазии, капитализма и коммунизма, идеалом демократии и всеми проявлениями этатизма - для конструирования философии права?
А точнее, сделала ли идеология социализма, осмысленная бывшим советским гражданином, которым являлся Пашуканис, важный вклад в философию права, юридический позитивизм или в социологию права?
This book includes a series of works written by an outstanding Canadian legal scholar Bjarne Melkevik on a wide scope of theoretical and practical issues that are discussed in the contemporary science of law. Approaching law from the vantage point of legal communication, from the existential horizon of human being, and from the point of view of critical legal studies allows the author developing an original legal philosophy that integrates elements of various legal conceptions. This book can be used in such teaching courses as philosophy of law, theory of law and of state, comparative law. It will also be important for all those who are interested in contemporary legal philosophy and in theoretical questions of science of law.
In all settings, Csaba Varga was always a gentleman and a good friend to me and to all of us. He has shown himself to be an eminently learned fellow in legal thinking, legal philosophising and legal culture, as demonstrated by the insights in his many valuable works. As a colleague and friend, and foremost as a collaborator in this fascinating intertwining between legal thought, legal philosophy and legal cultures, I have had numerous opportunities to experience this commonly-held appreciation. Csaba himself, and his works, have been a source of inspiration and knowledge to us all. We can only be grateful to him for such a tremendous contribution to scholarly legal thought. Maybe, even more than what has already been done, what matters is what is hopefully waiting for us. We wish him good health in the years to come and that our colleague and friend in common thinking will offer us even more papers and books to help us and others through these intriguing puzzles or labyrinths, which indubitably are legal thinking, legal philosophy and legal cultures. La philosophie du droit moderne se révèle aujourd’hui un acteur de première importance dans les grands débats se rapportant à l’autolégislation moderne (et démocratique) et au choix qu’il convient d’effectuer quant à ce qui doit compter pour nous mutuellement sous le mode du " bien " et du " juste ", et en tant qu’assurance (textuelle et potentielle) pour nos cosociétaires qu`il existe toujours une possibilité de faire appel au " droit " devant la violence, l’oppression, la discrimination, le crime.
