Se pretende, igualmente, investigar el estado actual acerca de la calificación penal de la suplantación de identidad así como indagar si la reforma del Código penal que actualmente se tramita en las Cortes Generales pretende introducir alguna modificación al respecto. For this study which has been based on a more or less accepted view of price fixing, we analyze w... more For this study which has been based on a more or less accepted view of price fixing, we analyze whether the behaviors normally considered as such may or may not constitute an offense under the present criminal code, for example: the offense of altering prices in competitions and public auctions, the crime of creating a deficiency of essential commodities in order to alter prices, the crime of personal or operational alteration of crime rates. They also establish a future progression of deliberations about the criminalization of companies that price fix. Along this same line we will have to examine whether it is necessary or not to prosecute companies that price fix, whether or not to establish specific criminal penalties as regulatory guidelines in the future are proposed. In any case, future regulation should not be over looked.
The present work consists of 2 differentiated parts: In the first, after some conceptual precisio... more The present work consists of 2 differentiated parts: In the first, after some conceptual precisions, adult criminal mediation in Portuguese law is analyzed; in the second part, we see different pilot experiences carried out in distinct regions in Spain: Catalonia, Basque Country, Valencia, Castile Leon and Madrid. All this with the aim of making contributions for a future regulation of Adult Criminal Mediation in Spain, in view of correctness, errors, imperfections, and deficiencies found in both Portuguese legal experience and Spanish pilot experiences.
This paper aims to analyze what should be the legal assessment and determination of the offence o... more This paper aims to analyze what should be the legal assessment and determination of the offence of certain behaviors consisting in the publication of sexting without consent of parties in the image. More specifically, whether such behaviors can be classified as crimes of disclosure and revelation of secrets (Article 197 et seq. of the Penal Code). Once stated the problem and the behavioral hypothesis that are intended to determine, we will study the legally-protected interests in these crimes, which will serve as an interpretive guide. We will continue with the exposure of caselaw and academic opinion on the subject. Next, we will position ourselves in the light of the results derived from our research. Finally, we will offer proposals for future due to the dearth of current regulation.
