This article reviews the law and practice relating to renewable energy in Ireland having regard t... more This article reviews the law and practice relating to renewable energy in Ireland having regard to the State’s obligation to comply with European Union (EU) energy legislation and Ireland’s obligations under the Kyoto Protocol. Particular attention is paid to the current success of Ireland’s onshore wind energy policy and to new developments in offshore and geothermal energy, which have recently been identified as potential solutions to the State’s excessive dependence on imported energy and as having the potential to make Ireland an exporter of renewable energy to the EU mainland. Problems in implementing alternative energy policies are described and future challenges identified.

This article reviews EU law relating to the regulation of mining and mining waste, liability for ... more This article reviews EU law relating to the regulation of mining and mining waste, liability for environmental damage caused by mining, remedies for environmental damage caused by mining, mine closure obligations and the nature of financial guarantees required to ensure the proper performance of environmental obligations, as well as developments in EU law which have resulted in the elucidation of human rights available at a supranational level to those subjected to severe pollution from mining activities. It notes that much of the world’s mineral resources are located in developing countries which have less sophisticated environmental regulations and greater potential to experience environmental and social disasters from mining activities than the EU, proposes the regulation of mines of international significance on a more global scale, and speculates whether the relatively sophisticated EU mining regulatory system can provide an embryonic model for this.

The global banking crisis in 2008 had dire consequences for the relatively small open Irish econo... more The global banking crisis in 2008 had dire consequences for the relatively small open Irish economy. Ireland faced the problems of a sharp decline in construction-related taxes and enormous banking losses. To deal with this crisis, the Government agreed a Programme with the EU Commission, the European Central Bank and International Monetary Fund to stabilise the financial sector, restore sustainable public finances, reform the public sector , grow the economy and restore the country to financial market funding for 2010-2013. This Programme, although it demanded many sacrifices from the workforce, was successful and Ireland is now the fastest growing economy in the EU. There was a remarkable degree of social cohesion and a notable absence of constitutional challenges to reforming legislation.
