THE RELATIONS BETWEEN THE EUROPEAN COURT OF HUMAN RIGHTS AND THE NATIONAL AUTHORITIES: SHARED RESPONSIBILITY
The European Court of Human Rights operates a process of judicial dialogue to achieve a common ideal by reducing the possible tensions that may lead to confrontation with national authorities and adopts the "shared responsibility" method to effectively protect and promote human rights. It can be said that this concept has been used frequently in the recent period and in this way, the delicate balance between the concerns of the states' sovereignty and obligation to respect human rights is tried to be established by ECtHR. In the context of this study, the mutual and dual character of the shared responsibility with the national authorities will be argued by examining the responsibilities of the ECtHR with the national authorities in the light of the judicial tools that provide judicial dialogue with the national authorities. Thus, the national authorities are obliged by their primary responsibility for the obligation to respect human rights, and the ECtHR reviews under its jurisdiction whether national authorities fulfills its obligation.

THE COUNCIL OF EUROPE COMMISSIONER FOR HUMAN RIGHTS AND WRITTEN COMMENTS ABOUT TURKEY
The Council of Europe Commissioner for Human Rights has mandate for submitting written comments and taking part in hearings in all cases under article 36, paragraph 3 of the European Convention on Human Rights. In this context, the Commissioner has submitted three separate written comments to individual applications against Turkey concerning counterterrorism operations, arrested journalist and arrested deputy in Turkey. It has been evaluated that the relationship between the European Court of Human Rights and the Commissioner and also the Commissioner’s written comments about Turkey.
