Terms and conditions

General Terms and Conditions of Participation

    These terms and conditions govern the relationship between you (the member) and the STRKNG platform, as well as the handling of your photographs and information. By the STRKNG platform (hereinafter referred to as “STRKNG”), we mean the website and, where applicable, other media formats, such as special apps for mobile devices.
    STRKNG is a project by norm-4 - norm-4 is the legal contracting party.

Please also take note of our Guidelines, so that we can all enjoy STRKNG.

  1. Membership

    1. Participation is open to persons who have reached the age of 18. Minors under the age of 18 require the consent of their legal guardians.
    2. You agree to register using a valid email address, to provide all personal data truthfully, and to keep both your personal data and account information up to date.
    3. Membership is free of charge and begins with the informal confirmation by STRKNG after successful registration. Optionally, an extended VIP account with additional features can be purchased as a paid annual subscription.
    4. You may operate only one member account on STRKNG. If your account has been suspended or you are unable to log in for other reasons, creating a new account without the written consent of STRKNG is prohibited.

  2. Grant of License

    1. STRKNG is granted the right to display and store the photos you upload in various sizes. All image rights remain with you. You will always be credited as the rights holder, as well as any other parties involved in the rights.
    2. STRKNG is entitled to make your images shareable via social networks (e.g. X, Tumblr, Facebook). For this purpose, so-called “share buttons” are displayed. (Note: These allow for optimized presentation of shared content.)
      The scope of sharing features can be adjusted via the “PromoteMe” settings.
    3. STRKNG may promote your profile and images via social networks as well as other digital or analogue channels in the context of STRKNG. Publication will always include your name and, where possible, a link to your profile.
      You may deactivate this feature at any time in the settings (“PromoteMe”). Content already published cannot be removed retrospectively.
    4. STRKNG is a public online gallery. Uploaded images are generally indexable by search engines and publicly accessible.
      Using the VIP feature “Sponsors Only”, images can be published in a restricted area that is not publicly accessible.
      In general: if you do not want your images on the internet, do not upload them.
      STRKNG assumes no liability for unauthorized use by third parties.

  3. Content

    1. Images are permitted only within the designated categories. Inappropriate content may be moved or deleted at any time without stating reasons.
    2. Content with offensive, pornographic, racist, glorifying violence, discriminatory, or otherwise unlawful material is not permitted and will be removed. Repeated violations may result in permanent exclusion.
    3. We reserve the right to review, edit, block, or delete content if it violates these terms and conditions or applicable law, or if there is a reasonable suspicion of such a violation. There is no entitlement to publication.

  4. Warranties and Indemnification

    1. You warrant that you hold all necessary rights and permissions required to publish the content on STRKNG.
    2. You indemnify STRKNG against all third-party claims arising from the content you submit, including legal defense costs.
    3. If individuals are depicted, you warrant that all required model releases are in place.
    4. Any required property releases (e.g. architecture, artworks) are also in place.
    5. The content contains no illegal material and does not violate personal rights or the privacy of third parties.
    6. In the event of violations of these terms and conditions, your account may be temporarily or permanently suspended or deleted. Any fees already paid will not be refunded.

  5. Scope of Functions

    1. STRKNG reserves the right to change the scope of its features at any time, provided such changes are reasonable for users.
    2. Users will be informed of any material changes in due time.
    3. If no objection is raised, the changes shall be deemed accepted.

  6. Contract Duration / Termination

    1. The contract is concluded for an indefinite period.
    2. It may be terminated by either party.
    3. A paid account is concluded for a fixed period and automatically converts into a free account upon expiry.
    4. In the event of violations of these terms and conditions, the contract may be terminated without notice.
    5. Inactive accounts without content will be downgraded or deleted automatically after prior notice.
