Intelligence Issues For Congress (OpenCRS.org)

US Intelligence Community SealImage via WikipediaOne of my favorite sites for finding interesting new documents, Docuticker, recently highlighted an October, 2010 Congressional Research Service (CRS) report, Intelligence Issues For Congress

With a new Congress about to be sworn in and the balance of power shifting in the House, this list of issues is worth examining by anyone interested in the direction of the US national security intelligence community.

For those of you unfamiliar with the CRS, it is one of the most reputable sources of information and informed analysis currently available on the planet.

Unfortunately, it is exclusively for the use of members of Congress and, unless a member of Congress releases a report, the CRS's analysis does not see the light of day.  Organizations like the Federation Of American Scientists and OpenCRS.org pick up on any reports that are made public and host them (which is how Docuticker got this one).

Below is my edited version of the summary (You can download the full PDF here).  I cut out the stuff that I thought would be familiar to SAM's readers and have highlighted those parts (in bold) that I thought would most interesting.  Other than that, the words below are direct quotes:

  • Making cooperation effective presents substantial leadership and managerial challenges. The needs of intelligence “consumers”—ranging from the White House to Cabinet agencies to military commanders—must all be met, using the same systems and personnel. Intelligence collection systems are expensive and some critics suggest there have been elements of waste and unneeded duplication of effort while some intelligence “targets” have been neglected.
  • The DNI has substantial statutory authorities to address these issues, but the organizational relationships remain complex, especially for Defense Department agencies. Members of Congress will be seeking to observe the extent to which effective coordination is accomplished.
  • International terrorism, a major threat facing the United States in the 21st century, presents a difficult analytical challenge, vividly demonstrated by the attempted bombing of a commercial aircraft approaching Detroit on December 25, 2009. Counterterrorism requires the close coordination of intelligence and law enforcement agencies, but there remain many institutional and procedural issues that complicate cooperation between the two sets of agencies.
  • Techniques for acquiring and analyzing information on small groups of plotters differ significantly from those used to evaluate the military capabilities of other countries. U.S. intelligence efforts are complicated by unfilled requirements for foreign language expertise. Whether all terrorist surveillance efforts have been consistent with the Foreign Intelligence Surveillance Act of 1978 (FISA) has been a matter of controversy.
  • Intelligence on Iraqi weapons of mass destruction was inaccurate and Members have criticized the performance of the intelligence community in regard to current conditions in Iraq, Iran, and other areas. Improved analysis, while difficult to mandate, remains a key goal. Better human intelligence, it is widely agreed, is also essential.
  • Intelligence support to military operations continues to be a major responsibility of intelligence agencies. The use of precision guided munitions depends on accurate, real-time targeting data; integrating intelligence data into military operations challenges traditional organizational relationships and requires innovative technological approaches. Stability operations now underway in Afghanistan may require very different sets of intelligence skills.

Intelligence Estimates: How Useful To Congress? (CRS)

The CRS recently released a report (now available here in full text through the FAS) on NIEs and their increasing importance to Congress. The thing that interested me most was the discussion of the role of Congress in the recent spate of public NIE releases (including ones on Iran's Nuclear Intentions, Prospects For Iraq's Stability, the original and the update, the Terrorist Threat To The Homeland and Trends in Global Terrorism). Here are some of the other highlights from the Conclusion (I have separated the findings in order to make it easier to read and, as always, the boldface and italics are mine):

  • "Congress is and will continue to be an important consumer of national intelligence, but there are concerns that heavy emphasis on mandating NIEs may not assist the legislative process to the extent that some anticipate. NIEs can provide the Intelligence Community’s best evidence and analysis on major issues of national security and can highlight areas where information is lacking, but they usually require lengthy preparation and coordination before they can be disseminated."
  • "The example of the NIE on Iraqi WMD suggests that compressing the production schedule can be counterproductive."
  • "Moreover, conclusions of NIEs may not be informed by knowledge of initiatives planned or underway by others in the executive or legislative branches."
  • "A more public role for NIEs in debates on national security policy issues could obscure their inherent limitations and distort the discussion of the policy issues."
  • "In some cases, Congress may find intelligence assessments or briefings prepared in a less structured way and within tighter time constraints better serve its legislative needs than formal NIEs."
  • "The creation of the Office of the DNI provides a focal point from which the analytical capabilities of all intelligence agencies can be brought to bear on given issues, even ones that are narrowly focused. It is considered likely that a combination of NIEs on some topics, supplemented by more limited assessments supported by an ongoing dialogue with intelligence analysts, may provide the most effective support to the legislative process." (Historically, of course, the Executive Branch has been the primary consumer of intelligence. While this is unlikely to change, an increased interest by Congress -- the branch that controls the purse strings -- coupled with the DNI as the primary POC, is likely to lead to a more independent intel community and a stronger DNI.)

Good News In Iraq... (Report To Congress)

The DOD issued its tenth quarterly report on "Measuring Security and Stability In Iraq" (Download the full text here). The news seems pretty good on this front. Highlights include:

  • "There has been significant security progress, momentum in reconciliation at the local and provincial levels and economic progress. However substantial the security progress made since the last report, sustained and durable progress depends on further progress in attaining political and economic objectives."
  • "The “tribal awakening” movement has grown as an increasing number of sheikhs—Sunni and Shi’a—have chosen to stop resisting the Coalition."
  • "The number of security incidents has fallen significantly and is now at levels last seen in the summer of 2005. Although ethno-sectarian violence continues to be a concern, overall civilian casualties, enemy attacks and total improvised explosive device attacks have decreased markedly over the reporting period. For example, the number of high-profile attacks in Iraq declined by over 50% since March 2007."
  • "While the GoI’s lack of progress on key legislation has been disappointing and has hindered “top-down” reconciliation, “bottom-up” reconciliation initiatives gained momentum as tribal and local outreach efforts expanded during this quarter."
  • "The Iraqi economy continues to improve and overcome many challenges to stability and growth. Estimated nominal gross domestic product (GDP) is US$60.9 billion. Real GDP will increase by an estimated 6.3% in 2007 as growth in the non-oil sector continues. The inflation rate has continued to decline due to the Central Bank of Iraq’s tight monetary policy implemented through appreciation of the Iraqi dinar. Year-on-year headline inflation as of October 2007 is 20.4%, which is down from 52.8% one year ago and year-to-date inflation is 4.2%."
  • "The key to long-term success will be the GoI’s ability to capitalize upon local gains, pass key legislation and promote national reconciliation."

Open Source Intelligence: Issues For Congress (CRS)

The good people at OpenCRS have made a December 5, 2007 report on OSINT available to the public on their website. The report contains quite a bit of good background info including a summary of the debate on the value of open source to the intelligence community. According to the report, while "Intelligence professionals generally agree that open source information is useful", there are three main positions within the community with regard to the true value of open source information:

  • "The first holds that policymakers simply derive less value from such information than from clandestinely-collected secrets."
  • "The second view asserts that open source information should be viewed not only as an important contextual supplement to classified data, but also as a potential source of valuable intelligence, in and of itself."
  • "Proponents of the third view adopt a “middle-ground” position, arguing that open source information probably will never provide the “smoking gun” about some issue or threat, but that it can be instrumental in helping analysts to better focus or “drive” clandestine collection activities by first identifying what is truly secret. Open sources therefore should be viewed as an analyst’s “source of first resort.”
Also of interest are the laundry list of current obstacles to analysts trying to using open source and the recent history of criticism of the community's failure to use open source more extensively (it is a lengthy parade of horribles...). Probably of most interest is the list of things the CRS mentions that Congress could do to help the open source movement. These include, according to the report:
  • "One way is to examine specific budget areas in which spending on open source currently can be identified."
  • "Another opportunity occurs when the DNI submits to congressional intelligence committees an annual report reviewing analytical products. Arguably, these annual reports should address the use of open source information. However, oversight committees could ask for additional information on open source utilization if needed."
  • "...an approach that might be considered in some situations would be a request for an alternative analysis of a specified topic solely based on open sources in order to compare it with all-source analyses." (Note: I'll do it!)
  • "Some may argue that Congress should consider an amendment to copyright law that would cover the open source efforts of intelligence agencies. Removing uncertainty of the extent of copyright would facilitate open source efforts and facilitate the widest possible use of the information by public officials."
  • "Some have proposed making the Open Source Center a component of the Office of the Director of National Intelligence (ODNI) while essentially retaining its current roles and missions."
    • "The advantage of placing the NOSC directly under the DNI would be to enhance the prestige of the open source discipline by raising its profile, fencing the funding, and ensuring its independence from shifting priorities within the CIA where human intelligence collection inevitably makes heavy and continuing demands on senior officials."
    • "Placing the NOSC within the ODNI could also facilitate the NOSC’s ability to support law enforcement agencies and state, local, and tribal entities." (Note: Good point.)
  • "A more radical, approach would be to establish an Open Source Agency completely outside the Intelligence Community (in addition to the existing Open Source Center). The goal would be to provide open source information not just to intelligence analysts but to all elements of the Federal Government including congressional committees." (Note: The basis for the PIA -- Public Intelligence Agency. Where do I sign up?)
