In contested environments, the importance of water transcends its status as a mere resource to co... more In contested environments, the importance of water transcends its status as a mere resource to comprise the ecosystem and the watershed. Farmers and ronderos in Santa Cruz, Cajamarca, who face the brunt of deleterious environmental impacts from mining in their territories emphasize the relevance of ecosystems and watersheds for water provision. The interdependency of water and ecosystems is demonstrated through their local water rights. As water sources are threatened, the scope of local water rights is reconceptualized to guarantee water as both resource and nature. In analysing the transformation of water rights in the midst of socioenvironmental conflicts, the article shows how the residents of Santa Cruz take an unconventional approach assembling local understandings of water and global environmental discourses to protect the entirety of the environment where water flows.

El libro explora la construcción del derecho humano al agua en tres ámbitos: el del derecho inter... more El libro explora la construcción del derecho humano al agua en tres ámbitos: el del derecho internacional, el ámbito nacional (peruano), y el ámbito local. La contribución más importante de este libro es el análisis de la situación del derecho humano al agua en dos ámbitos locales: la comunidad Kichwa de Vista Alegre de la cuenca del río Tigre y la comunidad Kukama de Cuninico de la cuenca baja del río Marañón. El libro recoge la visión de los pueblos indígenas sobre el agua y el significado simbólico que le asignan en contraste con la visión economicista que el Estado tiene sobre dicho recurso. Las autoras ofrecen una descripción del impacto de larga data que han sufrido estas cuencas y sus habitantes por la actividad de extracción de hidrocarburos, que ha contaminado sus fuentes de agua y degradado su medio ambiente. Finalmente, se señala la necesidad de un enfoque de cuenca e intercultural en el tratamiento de la afectación al derecho humano al agua por la contaminación de petróleo en cuencas amazónicas.

This chapter explores the relationship between the Peruvian state, multinational corporations (MN... more This chapter explores the relationship between the Peruvian state, multinational corporations (MNCs), the Inter-American Development Bank (IDB), and indigenous communities affected by the development of the Camisea Gas Project. The analysis of Camisea is illustrative of new forms of transnational governance that have reconfigured the relationship between multilateral banks, transnational corporations, and the state. In Peru, neoliberal restructuring contributed to the creation of a broker state that facilitated the financing, approval, and eventual development of the Camisea project. The fluid movement of key individuals between private corporations, international financial institutions (IFIs), and government offices contributed to the formation of alliances across these different sectors, enabling highranking state officials to directly intervene to secure loans from the IDB for the Camisea Project. This ‘revolving door’ between the public and private sectors shaped state officials’ understanding of governance and ‘development’ in ways that influenced their handling of the Camisea project. Reaffirming the state’s role as ‘broker’, state officials intent on securing public acceptance directed an aggressive campaign that portrayed the Camisea project as inevitable.
