Jennifer Moore, PhD is the 2015-2016 Harkness Fellow in Healthcare Policy and Practice, working at Stanford Law School on a health law project. Jennifer is also a Senior Lecturer in the Department of Preventive and Social Medicine, and an Affiliate Senior Research Fellow in Law at the University of Otago in New Zealand. Jennifer is a lawyer, social scientist and health scientist with a PhD in Public Health from the University of Melbourne. She is a barrister and solicitor of the NZ High Court.

When must a death that occurs in a healthcare setting be reported to the coroner? This article ex... more When must a death that occurs in a healthcare setting be reported to the coroner? This article explores this question by analysing the New Zealand (NZ) Coroners Act 2006 and the amendments to the healthcare-related deaths provisions in the Coroners Amendment Bill 2014 (NZ). At the time of writing, the Bill was at the Select Committee stage. We examine whether the amendments may improve the inconsistent clinical and coronial practices with respect to reportable healthcare-related deaths. We conclude that while the proposed amendments are an improvement on the current legislative drafting, doubt remains about whether they will solve the challenges presented by healthcare-related reportable deaths. The second and third readings of the Bill should give serious consideration to the submissions received by the NZ Law Commission that express the view that the QLD or VIC legislation should be used as models.

The purpose of this study was to examine disciplinary proceedings in the New Zealand Lawyers and ... more The purpose of this study was to examine disciplinary proceedings in the New Zealand Lawyers and Conveyancers Disciplinary Tribunal (NZLCDT) which involved lawyers with physical or mental impairments. International research has documented the high rates of depression, anxiety and substance misuse in the legal profession. Australian and American research has found that disciplinary cases often involve lawyers who are impaired by medical conditions, or substance misuse. Their impairment either contributed to, or was responsible for, their misconduct. In the present study, the disciplined lawyers’ demographics, and the nature of the impairments, were described for NZLCDT cases from 2009 to 2013. Twenty one of the 74 decisions involved impaired lawyers. The main types of impairment were depression, anxiety, substance misuse, and stress. This study reinforces the importance of the NZ Law Society’s 2009 initiative “Practising Well”, which aims to minimise the adverse impact that impaired lawyers have on themselves, their families, clients, and the profession. © 2015 The Australian and New Zealand Association of Psychiatry, Psychology and Law.

Traumatised Bodies: Towards Corporeality in NZ's Privacy Tort Law Involving Accident Survivors

This article combines several different literatures (legal, medical and theoretical) in order to ... more This article combines several different literatures (legal, medical and theoretical) in order to explore privacy law cases which involve accident survivors. I adopt an inductive methodology which emphasises the accident survivors' experiences. Their accounts demonstrate their position of special vulnerability. However, accident survivors currently receive inadequate protection because the New Zealand privacy tort does not recognise their special vulnerable status. The accident survivors' privacy claim in Andrews v TVNZ, for example, failed because the Court held that the publication was not highly offensive. The legal status quo is problematic because accident survivors whose privacy has been breached expect the law to provide protection at a time when they are vulnerable and unable to protect themselves. The privacy intrusions experienced by accident survivors cause adverse health outcomes. Alternative perspectives from theoretical and empirical medicine reveal the extent of the problem and help to suggest necessary reforms. This literature justifies recognising accident survivors as a special class of plaintiffs. New Zealand's privacy tort could be reformed by presuming that they have a reasonable expectation of privacy and that images of accidents are distressing and humiliating.
