JUSTIFICATIVA: O presente projeto de pesquisa visa orientar a compreensão no âmbito acadêmico/m... more JUSTIFICATIVA: O presente projeto de pesquisa visa orientar a compreensão no âmbito acadêmico/metodológico na esfera contratual dentro da relação existente no tocante à autonomia privada em face do contrato de consumo. É sabido que nos tempos atuais, as relações consumeristas estão seguindo em direção a um caminho e ritmo crescente, onde, por diversas vezes, fica o consumidor, parte hipossuficiente na relação, desamparado no principal momento da selagem dentro do vínculo "consumidor x vendedor/empresa/fornecedor", ou seja, no momento da celebração contratual. O liame existente entre o contrato de consumo e a autonomia privada será o foco do presente projeto. FUNDAMENTAÇÃO TEÓRICA: O já referido tema foi alvo de grandes debates e artigos científicos no que diz respeito ao Direito do Consumidor e seus Contratos, somado com o principio do Direito Civil, qual seja, a Autonomia Privada. Miguel Lobato Gómez analisa a simetria existente entre autonomia e liberdade de contratação, alegando que com o Novo Código Civil Brasileiro, vigente desde 2002, houve uma grande transformação nas relações jurídicas, trazendo consigo os princípios de boa-fé e função social da propriedade. Vejamos: "O novo Código colocou as bases de uma importante transformação no regime jurídico do contrato, trazendo a função social do contrato e os princípios de probidade e de boa-fé, destinadas a criar relações contratuais mais equânimes e justas."

The present study will analyse the Right to Identity using conceptualizations within the areas of... more The present study will analyse the Right to Identity using conceptualizations within the areas of sociology, anthropology, psychology and law. Will initially be analyzed the emergence of the state of rights from the modernity and the subsequent construction of identity in the national Brazilian State since the proclamation of independence and their reflections in the Federal Constitution of 1988. Then, will be made brief explanatory about modernity and its effects in the construction of personal identity. After, it will be given to the construction of the right to identity and its offshoot from the rights of personality and its historical bias, practical and legal, as well as consideration will be given to the principle of the dignity of the human person and as their existence is able to influence the promulgation of sparse laws, the adoption of affirmative actions and public policies in Brazil with the objective of reducing cases of racial discrimination and the international sphere, the Declarations of the UN, which have the purpose of eradication of all forms of discrimination.
