September 11, 2001 changed more than the landscape of downtown Manhattan when the
Twin Towers of the World Trade Center collapsed after al-Queda terrorist flew two jetliners into
the buildings, killing over 3,000 people. While the buildings are gone, new towers have been
built, and nine-eleven is only a fading memory for most Americans, a change occurred in the
way our system of law enforcement collected evidence while investigating terrorist activity. Just
one month following this terrorist attack, the USAPATRIOT Act, an Act of Congress, was
signed into law by President George W. Bush on October 26, 2001.
The USAPATRIOT Act, is an acronym for the words, āUniting and Strengthening
America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of
2001, (Pub. L. 107-56, 107th Congress). Is this Act really the tools required to intercept and
obstruct terrorism, or is it an infringement and overreach of the federal government into the lives
of innocent Americans, thus perpetrating violations upon Fourth Amendment rights of all U.S.
citizens?
This paper will examine the USAPATRIOT Act, two sections in particular; Sections 213
and Sections 215 to determine if there is reason for concern from the American public.

When a serial killer goes on a rampage-killing innocent victims in multiple states, the initial c... more When a serial killer goes on a rampage-killing innocent victims in multiple states, the initial conviction in one state will often be followed by prosecution in other states. If one state involved in prosecuting a multi-state serial killer is a death penalty state, often the death penalty state will request custody of the prisoner, thereby hoping to get a death penalty sentencing. To accomplish a transfer of custody by jurisdictions, two legal instruments are employed; the Interstate on Detainers Act ("IAD" or "Agreement") or a writ of habeas corpus ad prosequendum ("Writ"). This paper examines three cases of IAD and Writ controversy regarding death penalty sentencing. They are: State of Rhode Island and Unites States verses Jason Pleau; the D.C. Beltway Sniper case of 17 year old Lee Boyd Malvo, entailing a request for a juvenile to face prosecution in a death penalty state; and the case of Stephen Howard Oken who attempted to fight an IAD on the grounds that he was provided constitutionally deficient legal assistance when he plead guilty to murder charges. This paper looks at these controversial cases and questions if long incarceration periods-waiting as state's volley for jurisdictional prosecution-jeopardizes a prisoner's rights to a speedy trial under the Sixth Amendment, and if any concern exists violating the Eighth Amendment right from cruel and unusual punishment?

Department of Justice (DOJ) statistics report nearly three million incidents of domestic violence... more Department of Justice (DOJ) statistics report nearly three million incidents of domestic violence (DV) per year. These figures represent those incidents which are reported to police and domestic violence advocates. The actual statistics are certainly far greater when taking into account those cases which go unreported. This paper reviews DV as it affects women and examines briefly, Americaās specialized domestic violence courts. In an effort to make greater strides in protecting women from violent abuse, current specialized domestic violence courts have been established throughout the country. Government funding, education and research for domestic violence projects, police procedures, and court programs have been in the forefront of the criminal justice debate since the 1980ās. Despite policy and programs designed to get a handle on one of the nationās most pressing crime issues, domestic violence continues to report staggering statistics, meaning that there is still a great deal of room for further policy and program initiatives and improvements in the current system. A Fordham Law Review article outlines model domestic violence court programs. Two models taken from that article are reviewed in this paper.

This paper explores some of the data and research on the topic of child molestation, offenders and/or resiliency to a life of crime for those who were victims of childhood molestation. The current research data pertaining to the effects of child molestation reported by The Child Abuse Prevention and Treatment Act (CAPTA), the AdministraĀ¬tion on Children, Youth and Families, Childrenās Bureau (ACYFCB) and the Uniform Crime Report (UCR) along with other criminal justice studies provide astounding statistics. Some studies have found Post-traumatic stress disorder (PTSD) and repressed memory of the childhood victimization supports ongoing PTSD symptomology and may play a significant role in the lives of adult offenders. The legal community has questioned recovered memory (RCMP) and false memory syndrome (FMS) arguing for their accused clients that recovered memories can be falsified by suggestion. This paper questions if these repressed memories play a significant role in the lives of adults who were victimized as children?

Levels of corruption within a police force vary from only a few unsavory officers to departments that experience systematic corruption that pervades the entire department. This paper defines police corruption, citing examples of such and discusses theories to explain said corruption. This paper will look at internal and external corruption forces at work both internally and externally that promote corruption within. Lastly, this paper will look at the relevance of policy pertinent to police corruption.

This paper examines prisons and cost reduction affecting government budgets as well as income and... more This paper examines prisons and cost reduction affecting government budgets as well as income and profit for corporate run facilities. It will also address some issues of increasing budgetary concerns regarding the management of prison and jail facilities, the problems with escalating costs, budget constraints and overcrowding, an ethical concern, as presented by the Bureau of Justice Statistics (BJS). Included, is an example of one of the pioneering companies to provide contractual services in a for-profit operation. The Corrections Corporation of America, (CCA) won a federal bid to run an immigration facility at the Houston Processing Center in 1984 in Houston, Texas. Lastly, this paper will examine ethical concerns over prison mismanagement by both governmental leaders and private corporate executives.
