The development of Islamic economic conceptually and practically is so dynamic. In response to su... more The development of Islamic economic conceptually and practically is so dynamic. In response to such condition, the presence of apt law becomes important to regulate or manage Islamic economic activities. Even though Al-Quran and Hadith already become main source and basic for all activities, but business actors still need several guidelines in doing Islamic economic activities. In this point, ijtihad could be such kind of instruments to help business actors run and involve in Islamic economic activities with its recent development. One of the forms of ijtihad is fatwa. In Indonesia, Indonesian Council of Ulama (Majelis Ulama Indonesia or MUI) is one of the formal institution who has authority to issue fatwa, and it also has special body, namely National Sharia Council (Dewan Syariah Nasional), to issue sharia economic activities fatwa. This paper will focus on several aspects of fatwa as form of ijtihad related to Islamic economic activities, including its dynamics and problems, such as binding capacity of the fatwa and readiness of the court to settle sharia business dispute

The Collaborative Economy has been understood to be in condition when products, services, and mar... more The Collaborative Economy has been understood to be in condition when products, services, and market relationships have changed as sharing startups impact business models. It is growing fast in various subjects including in financial needs where people called as crowdfundings. To avoid disruption, companies must adopt the Collaborative Economy Value Chain, which in sharia business can be taken from Islamic teachings. In the history of Islam at the early 7 th century, the Islamic state has found a "social security system" which they call as takaful ijtima'i. The Social security in Islam (takaful ijtima'i) is a social obligation (fardhu kifayah), which brings responsibility for muslims, as far they are able, to help each other, and state, as public entity, has a duty to ensure that such responsibility is implemented properly in any aspect including in private business. Inside at-takaful institution contained the spirit to help each other as part of whole society. Then, the spirit to help each other was made become a basic principle in sharia insurance institution (at-takaful al-ijtima'i). In its concept and practice, takaful ijtima'i system, for Indonesia context, could potentially be developed further. How the takaful ijtima'i can be as an alternative insurance system to reconstructing collaborative economy in Indonesia, is the problem that will be elaborated in this paper. This paper will focus on takaful ijtima'i with wakaf and musyarakah model, and it will be seen and placed as alternative sharia insurance system in the future, especially in Indonesia context. With the protecting each other characteristic has been used as basic principles in institutions, can be seen that the system called sharia insurance or at-takaful al-ijtima'i.or Takaful Ijtima'i can be used as an alternative insurance system to reconstructing collaborative economy in Indonesia.

Selain itu, pada level masyarakat muslim Indonesia, Majelis Ulama Indonesia telah menerbitkan Fatwa Majelis Ulama Indonesia mengenai kerukunan antarumat beragama. Partai politik memiliki beberapa fungsi, dan lazimnya berhubungan erat dengan kegiatan pemilihan ... more Partai politik memiliki beberapa fungsi, dan lazimnya berhubungan erat dengan kegiatan pemilihan umum. Dinamika selanjutnya memperlihatkan bahwa partai politik juga memiliki fungsi yang berkaitan dengan upaya memperjuangkan hak-hak kelompok minoritas. Bahkan, secara teoretis dan praktik, partai politik ini telah menjadi salah satu sarana kelembagaan yang dapat dimanfaatkan atau dibentuk oleh kelompok-kelompok minoritas untuk melindungi hak-hak mereka sebagai warga negara. Bagaimanakah dengan praktik di Indonesia? Permasalahan perlindungan kaum minoritas masih menjadi problem yang belum terselesaikan secara tuntas, misalnya saja untuk kasus diskriroinasi yang dialami oleh para penganut mazhab Syiah di Indonesia. Namun demikian, permasalahan ini tampaknya belum menjadi perhatian yang serius dari partai-partai politik peserta pemilihan umum di Indonesia. Padahal, isu diskriminasi terhadap kaum minoritas ialah salah satu problem yang jika tidak bisa diselesaikan, potensial untuk meruntuhkan bangunan Negara Kesatuan Republik Indonesia . Hal ini mengingat Negara Indonesia dibangun di atas kondisi masyarakat Indonesia yang plural, baik dari sisi suku, agama, bahkan mazhab (aliran dalam agama). Sebenarnya "Para Pendiri Negara (The Founding Fathers and Mothers)" sejak awal telah menaruh perhatian yang serius terhadap kondisi masyarakat Indonesia yang plural tersebut, sehingga merekapun akhirnya juga memilih Pancasila sebagai dasar negara yang mereka anggap mampu untuk "mempersatukan" seluruh masyarakat yang beragam latar belakangnya . Paper ini akan berfokus pada pembahasan mengkaji potensi beberapa partai politik peserta pemilihan umum tahun 2014 dalam menjalankan fungsinya sebagai agen perlindungan kaum minoritas di Indonesia . Hal tersebut tentunya dapat dijadikan pula sebagai semacam "indikator awal" untuk menilai sejauh mana partai politik mengupayakan nilai-nilai keadilan yang terkandung di dalam Pancasila. Kajian akan didasarkan pada data yang bersumber dari dokumen yang diterbitkan oleh beberapa partai politik dan data wawancara yang berasal dari narasumber yang relevan.

Perkawinan merupakan ikatan lahir batin antara seorang laki-laki dan seorang perempuan untuk memb... more Perkawinan merupakan ikatan lahir batin antara seorang laki-laki dan seorang perempuan untuk membentuk rumah tangga yang kekal dan abadi sebagaimana diatur dalam Undang-Undang tentang Perkawinan dan Kompilasi Hukum Islam. Namun, fenomena yang ada di Desa Tugu Utara, Cisarua Puncak, Bogor, ialah terjadinya perkawinan untuk waktu tertentu atau perkawinan kontrak, dan masyarakat Desa Tugu Utara menyebutnya dengan istilah perkawin mut'ah. Tentunya hal itu menarik untuk dikaji karena tampak ada kekeliruan dalam memahami konsep perkawinan mut'ah. Dengan melakukan penelitian non doktrinal di daerah Puncak, Bogor, akan diperlihatkan bahwa perkawinan kontrak yang mereka sebut sebagai perkawinan mut'ah adalah tidak tepat. Ketidaktepatan tersebut dikarenakan, antara lain, mengingat mereka yang mempraktikkannya bukanlah pemeluk mazhab Islam Syiah, dan juga perkawinan kontrak itu faktanya sangat berbeda dengan konsep perkawinan mut'ah yang sebenarnya. Selain itu, perkawinan kontrak yang dilakukan di Desa Tugu Utara, dalam banyak aspek bertentangan dengan hukum positif yang berlaku. Kata kunci: kawin kontrak, kawin mut'ah, penyelundupan hukum.
