The reflection originates from a recent ruling of the Italian State Counsel in its most authoritative composition, that brings light to a very controversial question, concerning the compatibility between the non- application of the tacit consent in presence of relevant interests (art. 20, c.4. L. 241/90) and Section 13 of Law 394/1991, that provides the mechanism of the tacit consent in a procedure in which the interest of environment is clearly concerned.
Additionally this paper focuses his attention on a recent legislative
innovation, introduced by the s.c. «riforma Madia», which provides the
mechanism of tacit consent between administrations, expressly applicable when the administration has to deal with procedure which includesrelevant interest.
