The method used in this research is normative and uses qualitative analysis techniques. State protection for citizens applies wherever they are in the world because it is the right of every citizen in accordance with the Body of the 1945 Constitution of the Republic of Indonesia Article 28D paragraph (1) which states that "Everyone has the right to recognition, guarantee, protection and certainty." fair law and equal treatment before the law" apart from that, to protect Indonesian workers in foreign countries, the United Nations General Assembly ratified Case No. 45/158 in New York on December 18 1990 which became the legal umbrella with its issuance. International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families. The problem of migrant workers residing abroad is currently of particular concern to the Indonesian government as a guarantee that the state's goal of protecting the entire nation is being implemented.

Perlindungan negara terhadap warga negaraya berlaku dimanapun dia berada di seluruh dunia karena hal itu merupakan hak setiap warga sesuai dengan Batang Tubuh UUD NRI Tahun 1945 Pasal 28D ayat (1) yang menyatakan bahwa "Setiap orang berhak atas pengakuan, jaminan, perlindungan, dan kepastian hukum yang adil serta perlakuan yang sama di hadapan hukum" selain itu untuk meindungi para pekerja Indonesia di Negara asing, Majelis Umum Perserikatan Bangsa-Bangsa mengesahkan Kasus No. 45/158 di New York pada tanggal 18 Desember 1990 yang menjadi payung hukum dengan dikeluarkannya. International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families. Permasalahan tenaga kerja migran yang berada di luar negeri saat ini menjadi perhatian khusus dari pemerintah Indonesia sebagai jaminan bahwa tujuan negara untuk melindungi segenap bangsa terlaksanakan.
