Toch zijn er nog de nodige kwesties die om opheldering vragen. Zo is het, ten eerste, niet duidelijk welke gedragingen wel en welke gedragingen niet onder het begrip ¿belaging' vallen. Algemeen wordt het jarenlang posten bij de woning van het slachtoffer als stalking gezien, maar is het incidenteel versturen van een liefdesbrief, het herhaaldelijk indringend aankijken of het dreigen met geweld dat ook? Ten tweede doet zich de vraag voor wat men wat onder ¿vrijheid' en ¿privacy' verstaat, wanneer men zoals de indieners van het genoemde wetsvoorstel belaging opvat als een ernstige aantasting van de persoonlijke levenssfeer. Waarom mogen er eigenlijk grenzen worden gesteld aan het morele en/of juridische recht van iemand om liefdesbrieven te schrijven of om zich op bepaalde plekken in de openbare ruimte te bevinden? Ten slotte kan men zich afvragen...

De auteurs zijn van mening dat stalking in het algemeen het beste kan worden aangepakt door bemiddeling tussen belager en belaagde. Vaan de bestaande en voorgestelde juridische middelen gaat hun voorkeur uit naar een civielrechtelijk contactverbod, dat via kort geding kan worden afgedwongen. Ten aanzien van cyberstalking geldt dat het recht weinig kan uitrichten vanwege de problematiek rond de jurisdictie en de anonimiteit van de belager. Zelfregulering via netiquette en algemene voorwaarden biedt in de meeste gevallen weinig soelaas. Tegen e-mail-stalking kan het Internet eigen technische middelen inzetten, zoals het laten 'blokken van ongewenste e-mails.

This article presents the formalisation of the weak and strong permission in deontic logic based ... more This article presents the formalisation of the weak and strong permission in deontic logic based o n t h e l o gic of enactment. A permission that follows from the absence o f a p r ohibition, we call a weak permission this permission is not enacted. A strong permission is always enacted (implicitly or explicitly), and implies a giving choice. The distinction between these two types of permission is a consequent of the universality of a normative system by the closure rule:`whatever is not forbidden, is permitted'. Further we present a modication of the logic of enactment with local reasoning. The basic idea b ehind this treatment is that authorities may enact con icting normative rules, depending on the frame of reference. The main strength of the presented theory is that we are now able to reason consistently in the presence o f i n c onsistent enacted norms.
Over the last few years several defeasible deontic reasoning formalisms have been developed to so... more Over the last few years several defeasible deontic reasoning formalisms have been developed to solve the problem of deontic inconsistency. H o wever, these formalisms are unable to deal with some very common forms of deontic reasoning since, e.g., their expressiveness is restricted. In this paper, which is based on Royakkers and Dignum (1996), we will establish a priority hierarchy of legal rules to solve the problem of deontic con icts, and we will present a mechanism to reason about nonmonotonicity o f l egal rules over the priority hierarchy. The theory presented here, based on default logic, and being a modi cation and extension of Prakken's argumentation framework, adequately deals with some shortcomings of other defeasible deontic reasoning approaches.

Collective obligations are analysed and formalised in a deontic logic framework. The notions of individual and collective commitment are de ned to specify which individual has the responsibility to ful ll an`internal' obligation as part of the collective obligation. In DAI theories of organisations ( 6]), it is emphasized that commitment' is a crucial notion to analyse a collective activity or the structure of an organisation. In this paper we g a ve a rst attempt to formalise the notion of commitment to determine which plan has to be followed to achieve a joint goal, i.e. the ful llment of a collective obligation.
