Untuk itu perlu ada batasan dan kategorisasi yang tegas dalam proses penegakan hukum yang dapat ditempuh yaitu antara tindakan hukum pidana dengan tindakan hukum administratif, sehingga tidak lagi digantungkan pada penilaian pejabat imigrasi tetapi didasarkan sistem atau peraturan perundang-undangan dengan memperhatikan proses penyelesaian perkara keimigrasian secara cepat, efektif dan efisien. Untuk melaksanakan tugasnya, yaitu pengawasan dan penindakan keimigrasian terhadap orang asing, Kantor Wilayah Kementerian Hukum dan HAM Jawa Tengah berkoordinasi dengan Unit Pelaksana Teknis (UPT), yaitu Kantor Imigrasi (Kanim). Kantor Imigrasi di propinsi Jawa Tengah terdiri dari 6 (enam) Kanim, diantaranya Kanim Semarang, Kanim Surakarta, Kanim Cilacap, Kanim Pemalang, Kanim Pati, Kanim Wonosobo. Tiap-tiap Kanim mewakili beberapa Kabupaten dan Kota. Apabila kita melihat fakta yang terjadi mobilitas orang asing di Jawa Tengah semakin banyak. Seperti orang indonesia dapat bekerja di malaysia dan sebaliknya.Semua kebijakan memiliki dampak, entah itu dampak baik maupun dampak buruk. Dampak baik indonesia dapat mencapai tujuannya yaitu internasionalisasi disegala bidang. Dan salah satu dampak buruknya dapat mengancam kedaulatan negara dan penyerbuan pekerja asing yang mencari pekerjaan dan tinggal di indonesia. Penegakan Hukum yang dilakukan Kantor Imigrasi Klas II Cirebon terhadap Penyalahgunan Izin tinggal oleh 3 orang asing adalah salah satu bentuk penegakan kedaulatan negara dimana imigrasi menjaga kedaulatan dengan meneggakan peraturan yang berlaku sesuai dengan Undang-Undang Nomor 6 Tahun 2011 tentang keimigrasian.Tetapi penegakan hukumnya dirasa kurang Maksimal karena pada faktanya walaupun telah merujuk pada undang-undang Nomor 6 Tahun 2011 tentang Keimigrasian, mengenai tata cara pelaksanaan penegakan Hukum melalui tindakan keimigrasian, belum sepenuhnya dilaksanakan. Didalam proses Penindakan Keimigrasian terdapat dua cara jika warga Negara asing tersebut menyalahgunakan Izin Tinggal, pertama tindakan Administratif dan kedua tindakan Projustitia.
