International Law Treaty Developments Affecting the Bio-Based Economy

<b>English Abstract:</b> Recent years have brought developments in international law ... more <b>English Abstract:</b> Recent years have brought developments in international law with direct bearing on the bio-based economy. The primary development has been the entry into force of the Nagoya Protocol on Access and Benefit Sharing to the Convention on Biological Diversity. Other relevant developments have occurred at the World Intellectual Property Organisation (WIPO), the United Nations Educational, Scientific and Cultural Organisation (UNESCO) and Canada’s adoption of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). This article surveys the various developments, and posits that changes in Canada’s approach to genetic resources and traditional knowledge may evolve given changes in Government policy towards Indigenous Peoples. <b>French Abstract:</b> Les évolutions des dernières années en droit international ont eu une incidence directe sur la bioéconomie. La plus notable est l’entrée en vigueur du Protocole de Nagoya sur l’accès aux ressources génétiques et le partage juste et équitable des avantages découlant de leur utilisation à la Convention sur la diversité biologique, mais d’autres développements ont notamment eu lieu du côté de l’Organisation mondiale de la propriété intellectuelle, de l’UNESCO et du Canada, qui a ratifié la Déclaration des Nations Unies sur les droits des peuples autochtones. L’article survole les diverses nouveautés et suggère, à la lumière de la nouvelle orientation politique du gouvernement à l’égard des peuples autochtones, que le Canada pourrait changer d’orientation quant à ses ressources génétiques et aux savoirs ancestraux.

The main goal of this Explanatory Guide is to facilitate the understanding of the legal obligatio... more The main goal of this Explanatory Guide is to facilitate the understanding of the legal obligations of the Parties under the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization (ABS) to the Convention on Biological Diversity. This guide is the product of a fruitful, constructive, and harmonious collaboration with ABS experts from different regions and international institutions who engaged with IUCN in the writing and reviewing of this Guide. This publication serves as an adaptable tool for future ABS capacity-building and awareness raising initiatives, as well as an important reference for countries in their efforts to implement the Nagoya Protocol and operationalize ABS in practice.

El objetivo principal de esta Guia Explicativa es facilitar la comprension de las obligaciones le... more El objetivo principal de esta Guia Explicativa es facilitar la comprension de las obligaciones legales de las Partes en el Protocolo de Nagoya sobre Acceso a los Recursos Geneticos y Participacion Justa y Equitativa en los Beneficios que se Deriven de su Utilizacion (ABS, por sus siglas en ingles) al Convenio sobre la Diversidad Biologica. Es el producto de una colaboracion fructifera, constructiva y armoniosa con los expertos en ABS de diferentes regiones e instituciones internacionales que se comprometieron con la UICN en la redaccion y revision de esta Guia. La UICN espera ofrecer a traves de esta Guia una herramienta adaptable para la futura creacion de capacidad y campanas de sensibilizacion sobre ABS, asi como una referencia importante para los paises en sus esfuerzos para aplicar el Protocolo de Nagoya y poner en funcionamiento el ABS en la practica.

This chapter evaluates the potential for the governance of access and benefitsharing in Canada th... more This chapter evaluates the potential for the governance of access and benefitsharing in Canada through the lens of different layers of government: federal, provincial, territorial and Indigenous. The emphasis of the chapter is on how the nation-to-nation approach could be an effective way to integrate Indigenous peoples' claim to genetic resources (GR) and their traditional knowledge (TK) as aspects of their self-determination. A nation-to-nation approach recognizes Indigenous peoples as stakeholders in access and benefitsharing (ABS) in ways that advance the pursuit of justice and reconciliation in Canada. With the backdrop of ongoing policy initiatives and multifaceted attempts at renewing Canadian-Indigenous relations, the chapter underscores the federal government's role in driving the charge. It will also require a commitment on the part of provincial governments, and overall political will across Canada, to draw in Indigenous peoples as genuine partners in order to fully integrate their legal traditions. Before Canada can implement the Nagoya Protocol, and any other ABS vision for that matter, all governments need to take the nation-to-nation mantra seriously and to articulate the legal status of GR and TK in Canada. introduction After 150 years of Confederation, 35 years since the repatriation of the Constitution, and 20 years after the Report of the Royal Commission on Aboriginal Peoples (RCAP), the relationship between Canada's three orders of governmentfederal, provincial and territorial, and Indigenouscontinues to evolve. This paper describes the interface between the treaties in international law and implications that countries should take into account to implement the treaties in a synergistic way. The paper also highlights issues for consideration at the national level to implement these treaties in a mutually supportive manner through legal, administrative or policy measures.
