From a purely political point-of-view they touch a raw nerve of liberal democracies: the tension existing between the adherence to the universal values of liberalism and the democratic sovereign's discretion concerning admission policies.Such tension seems to make any commitment in favour of migrant's human rights unrealistic.The present article supports the argument that only the harmonization of migration policies that implies a cooperative and multilateral approach between the involved states can make the mobility practices carried out by they who try to cross their boundaries less dramatic.

It is difficult therefore to avoid an unilateral and unquestioned approach to the subject. In particular, what is difficult to explain is the relationship between populism and liberal democracy. Some scholars sustain that neopopulism could subvert the rules of democratic constitutional State, some others are convinced that neopopulism is capable to hand back power to people. An important starting point for a not biased approach could be represented by Robert Dahl’s theory of democracy, that allows us to point out the circumstances under which neopopulism could become a danger to democracy or, on the contrary, a corrective for it.

Indeed, in the measures of economic policy promoted by the European authorities, the basic idea driving ordoliberalism shows through: to make of competition the first principle of social coordination by developing the institutional and regulatory framework necessary to ensure its proper functioning. According to the author, this happens through structural «reforms» that gradually dismantle state regulations, the faculties of intervention and the margins of discretion of the public administration, thus circumventing the game of forces that characterizes democracy.

The apparently unrelenting building of walls meant to protect the geopolitical borders of soverei... more The apparently unrelenting building of walls meant to protect the geopolitical borders of sovereign states from undesirable foreign nationals is undoubtedly source of discomfort and embarrassment for the democratic states observing the rule of law. A democratic state surely needs political borders and therefore a demos can establish itself as sovereign of a well-defined area only if the representative system is expected to stand on its own feet. But nevertheless, the thesis of the present article is that the will to defend a spatially limited "we" by lines of division defended by cement flows and barbed wire fences may perhaps foster fantasies of containment policies or recreate fictional image of national self-sufficiency, but it is indeed empirically ineffective and illegitimate in legal terms.

The idea that citizenship is the fundamental expression of the right of membership in a territori... more The idea that citizenship is the fundamental expression of the right of membership in a territorially defined political system is usually taken for granted, both from common sense and academic theories. In political and social theory, however, is beginning to emerge the idea that citizenship can be projected beyond the borders of the nation-state. This alternative conception has taken different classification: "global citizenship", "transnational citizenship", "postnational citizenship". The thesis of this article is that the proposals of deterritorialization of citizenship represent an aspiration or a goal to reach rather than a fact that is simply to record. Essentially, it is a way to defy the nation-state perspective, according to which the boundaries of the civic community necessarily coincide whit the geographic boundaries of the State.
