THE YEAR IN REVIEW Group's recourse to the Argentinian judiciary amounted to a waiver of Argentin... more THE YEAR IN REVIEW Group's recourse to the Argentinian judiciary amounted to a waiver of Argentina's right to object to BG Group's failure to comply with the local litigation requirement. 4 Argentina sought to vacate the eventual award, in part because of BG Group's non-compliance with the local litigation precondition. The U.S. Supreme Court upheld the validity of the arbitral award. The Court first examined the issue under regular contract principles,' which presume, unless otherwise specified, that the parties intend courts to decide arbitrability, and arbitrators to decide the meaning and application of procedural preconditions for arbitration. 6 The Court held the local litigation requirement was akin to a procedural precondition, because it determined "when the contractual duty to arbitrate arises, not whether there is a contractual duty to arbitrate." 7 Second, the Court reasoned that the status of the contract as a treaty between sovereigns did not render inapplicable principles of contract interpretation, particularly where, as here, there is an "absence of explicit language in [the] treaty demonstrating that the parties intended a different delegation of authority." The Court concluded that the arbitrators' determination with respect to the need for BG Group to comply with the local litigation requirement was entitled to considerable deference,9 and did not warrant vacatur.1

In addition to the relatively structured format used for preparing the listing, the report is supposed to have been audited by highly reputable accounting conglomerates. In the new millennium, misinformation and improper relationships between companies and auditing firms created a shock in the financial world. To remedy the problem, the Sarbanes-Oxley Act was passed. One of the stipulated provisions required executives to certify that the publicly released information was correct. This study examines the compliance of executives with the information certification provision. Specifically, this research reports on the proportion of companies that are able to meet the deadlines, their auditing firms, and auditing firm switches. The results of this study should be of interest to law enforcement individuals, accountants, financial auditors, and information systems experts. Computing educators will find the outcomes reported in this study especially useful because complying with governing standards and generating accurate reports affects all types of information systems.
