Pós-Doutor em Direito Ambiental e Direito dos Desastres pela University of California, Berkeley, CA, USA (2013), sob a orientação de Daniel A. Farber. Atualmente é Professor Adjunto I no Programa de Pós-Graduação em Direito - PPGD da Universidade do Vale do Rio dos Sinos. Membro da Associação Brasileira dos Professores de Direito Ambiental APRODAB e do Instituto o Direito por um Planeta Verde. ABSTRACT: This work shows the constitutional protection of environment and its special function of enforcing the ecological risk management by Law. First, this study observes the Risk Theory approaching concrete and abstract risks to the Prevention and the Precautionary principles as ecological risks management programs. In order to situate the right to a healthy environment as a fundamental right, this paper demonstrates the existence of two dimensions of environmental rights in the content of the federal constitucional article 225. The discription of the Intergenerational Equity here demonstrates an important function in developing to insert the future in the present legal decisions in Environmental Law. Along a social context of risks production and the institutionalization of a obrigational structure with the scope of the protection of the present and the future generations, there is a textual semantic, simultaneously, open to technique irritation in Risk Society and closed in its own intergenerational regulation.

The Climate Change, and its scientific diagnosis, has not only the function of legitimize global political agreements to deal with the global warming, but it also trigger off changes in the legal decision making.
This essay reflects the role of Master or Sectorial Plan and their integration. On this way, we present a special reflection on the influence of constant diagnoses in the Watershed Plans, its power to produce urban planning restrictions and also how it reduces the discretion in planning land using cases. This subject has got a lack of reflection in Brazilian legal doctrine, although it's huge empirical relevance. These Watershed Plans' indirect functions, as territorial planning instruments and disaster risks prevention is enhanced due to the recent increase in the occurrence of extreme weather events, especially the urban flood processes. The legal complexity of this subject is boosted by the lack of regulation of the new management system for susceptible areas of disaster risk (called) "natural". Despite the legal uncertainty brought by the lack of regulation, a general duty of mapping and prevention of occupation on areas of risk remains, based more on empirical knowledge of risks (by environmental diagnosis) than in the desirable internalization of restricted measures able to reconcile Urbanistic Master Plans to inserts provisions of Watershed Plans.
The present work has the scope of analyze the issue involving forest protection and the property rights. It is known that the relationship between forest protection and property rights is extremely complex, since the fundamental right to property gives rise to the exercise of prerogatives inherent in subjective law, but this must be exercised while respecting other fundamental rights of the same constitutional hierarchy, such as the right to an ecologically balanced environment. In this sense, the constitutional structure of the property right, in its subjective and objective face will be analyzed. After that, the environmental function of the property will be verified. It conditions the property right to guarantee the modulatory character of the conflicts between the fundamental dimensions of the right to the ecologically balanced environment and the right to private property. The analysis of the semantic and conceptual elements of the environmental function provides interpretative criteria for weighing the interests at stake, always remembering that they must respect the structural premises of the Constitutional State.
