Society's Violation of State Laws on the Establishment of Private Universities in Nigeria

In spite of establishment of many federal and state universities in Nigeria, the demand for unive... more In spite of establishment of many federal and state universities in Nigeria, the demand for university education in the last 20 years is far greater than the supply. There has been unsatisfied supply of university education in Nigeria since the 1971/72 academic year when over 70% of candidates demanding for university education failed to secure admissions. The existing universities capacity usually absorbs less than 30% of the applicants. To take care of about 70% others, the establishment of private universities would go a long way. The Federal Government of Nigeria has approved guidelines for the establishment of higher institutions of learning in Nigeria which are contained in the Education (National Minimum Standards and Establishment of Institutions (Amendment Decree No. 9 of 1993). There is also the Education (National Minimum Standards etc) Act CAP E3 Law of the Federation of Nigeria, 2004. Some of the guidelines are that: An institution of Higher Education may be sponsored or owned by the Government of the Federation or of a State or Local Government or by a Company incorporated in Nigeria or by an individual or association of individuals who are citizens of Nigeria, and who satisfy the criteria set out in the Schedule to the law for establishment of institutions. In 2001, the National Assembly of Nigeria passed a law permitting private organisations and individuals to establish universities and polytechnics. The same law mandates the National Universities Commission (NUC) to regulate and undertake quality control of the content and curricula of academic programmes. It is surprising to note that some sectors of the society are contravening the Federal Government's laws in establishing private universities in Nigeria. This has led to the announcement by the Executive Secretary of the NUC on the 22 nd of January, 2009 that 36 illegal universities have been closed down in Nigeria. There are three broad categories of unrecognised institutions according to the NUC. First, there is a preponderance of satellite or offshore campuses whose parent bodies are mostly based in the US, Canada and UK. The second category comprises private institutions established by rich individuals and religious organisations. They conduct their own admission examinations outside those organised by Joint Admission Matriculation Board for universities accredited by NUC. In the third category are private universities in the neighbouring Republic of Benin: Houndegbe North American University in Cotonou, and the University of Applied Sciences and Management in Porto Novo. This paper traces the historical development of private universities, laws governing the establishment of private universities, how some sectors of the society are violating the laws and steps taken by the government to penalize those violating the laws on establishment of private universities in Nigeria.

Western education was introduced into Nigeria in 1842 through private initiative of Christian Mis... more Western education was introduced into Nigeria in 1842 through private initiative of Christian Missionaries who were fully in charge until 1882 when the first Education Ordinance was promulgated to improve the education system. The huge investment involved in the provision of education makes the government to allow continual participation of private individuals and institutions. However, there is a trend of event in the private participation that calls for urgent attention; substandard schools that are not even supposed to exist are being approved as 'International Schools' or 'Group of Schools' and this does not augur well for our system. The researcher visited some of these schools and discovered that, there is no standard put in place or enforced by the approving authorities at all. It is therefore recommended among others that government should put in place a standard as a matter of urgency to prevent further rot in the education system.

This paper discusses the problems and prospects of incorporating traditional vocational education... more This paper discusses the problems and prospects of incorporating traditional vocational education into the Nigeria educational system. It looks at the traditional education with functionalism as its main guiding principle before the introduction of western education which was purely theoretical because its aim was religious. It examines how functionalism cave-in, in the face of new education that provides white-collar jobs thereby eroding the economic value of the traditional vocations. The paper also looks at the relevance of the 1969 Curriculum Conference, which was convened to overhaul the education system and make it more relevant to the need of the society. The outcome of the conference was the 6-3-3-4 system of education which incidentally included some traditional vocations and raised peoples’ hope that children will become self-reliant. This paper examined Home Grown School Feeding and Health Programme (HGSFHP) as an innovative appr... more This paper examined Home Grown School Feeding and Health Programme (HGSFHP) as an innovative approach to boosting enrolment in the public primary schools in Nigeria. It examined how its implementation in Osun State has activated confidence in the public primary schools again. Because the research is historical and descriptive, both primary and secondary sources were used to elicit information. The findings show that since its inception in 2006, there has been a gradual and progressive increase in the enrolment of pupils in public primary schools. This paper, therefore, recommends among others, that the Federal Government should make the programme national so as to boost the literacy level in the country.

At the 1969 National Curriculum Conference and the eventual emergence of the National Policy on Education (NPE) in 1977, TVET was given prominence but, unfortunately, in theory only. However, the imperative of TVET for national development is no longer arguable, especially in the face of a dwindling economy, mass unemployment and the irrelevance of some academic content to societal needs. In the conceptual framework of globalization of education, this paper discusses the gaps between the TVET policy document and practice. Nigeria as a nation came into being in the year 1914 through the amalgamation of the Southern and... more Nigeria as a nation came into being in the year 1914 through the amalgamation of the Southern and Northern Protectorates by Sir Frederick Lugard. After this amalgamation, and prior to independence, there was no education policy clearly defined by the colonial government; instead, several educational ordinances were promulgated. However, the 1920 Phelps-Stokes Commission awakened the colonial government to the need for improvement. The 1951 regionalisation of education laws that later emerged and their implementation also focused on mass literacy and theoretical education. The exposure to higher education by few Nigerians, however, led to the agitation for independence, which was eventually granted on October 1, 1960. This position, indeed this narrative, was challenged and contested by Nigerian nationalists even before 1960. Therefore, the need to overhaul the curriculum content arose after independence in October 1960 which led tothe organisation of the 1969 Curriculum Conference. This paper focuses the administration of basic education in Nigeria under different administrativ... more This paper focuses the administration of basic education in Nigeria under different administrative bodies from 1914 to 2014. It identifies the various bodies that were responsible for managing basic education at different dispensations and why they were established. This study is historical, and historical method is employed. Both primary and secondary sources of information were explored to get relevant materials for the study. It was discovered in the course of the study that the bodies were just changing names as the output continues to degenerate in Basic Education. Therefore, it is recommended among others that; basic education should be devoid of politics for effective planning, community participation should be incorporated and, more and adequate infrastructural facilities should be provided in the primary schools.

The paper discusses teacher education curriculum as the bedrock of the profession and therefore needs proper planning and execution by competent hands, and professionalising teaching starts from here. The imperativeness of making teacher training process a specialised one is stressed and, the situation of employing "cheaters" as teachers and admitting the 'dregs' into training institutions must be stopped. The Teachers' Registration Council is therefore challenged to be up and doing in her task of registering qualified teachers through qualifying examinations like other professions.

The importance of education to human beings cannot be overemphasized. It is seen, regarded and ac... more The importance of education to human beings cannot be overemphasized. It is seen, regarded and accepted to some extent, as the quickest way to eradicate poverty and ills in the society. There are a lot of international human rights instruments that provide for education as a fundamental right. These include the Universal Declaration of Human Rights (1948), the International Covenant of Economic, Social and Cultural Rights (1966) and the African Charter on Human and Peoples Rights (1981). To this end, various nations have given priority to education and have developed mechanisms to operate the system for effective impartation and acquisition of knowledge and skills that will help the learners to be useful for themselves and to the society at large. Pre-Primary and Primary levels of education are the most crucial because they form the foundation upon which all other levels depend to thrive. It could be seen as the proverbial "ketekete" (donkey-the burden bearer). However, several political dispensations had affected these levels of education in Nigeria. This paper, therefore, highlights the various political dispensations/phases of early childhood and primary education in Nigeria from 1842 to 2011. It discusses the various programmes at various dispensations, how they were developed, operated, managed, sustained and the outcome or the effects of each dispensation on the general development and quality of education in Nigeria. Some hindrances to qualitative pre-primary and primary education were also discussed. The paper also suggests among others, that education sector should be a zone for professionals.
