This Basic Plan offers commercial drivers a comprehensive set of services that will help them navigate the traffic citation process and enhance the likelihood of reaching a fair and efficient resolution. The plan offers access to FCP’s Legal Network of experienced attorneys who specialize in CDL and personal vehicle citations, along with full case management and coordination services. The attorneys will handle negotiations with courts and law enforcement, and provide guidance on plea bargains and other options. A $50.00 case management fee applies per citation handled, and attorney fees are passed through at cost with no markup — full payment is required before FCP engages a provider attorney on your behalf. The Basic Plan includes citation-related DataQs submissions at no additional charge, as well as Motor Vehicle Record (MVR) requests for $30.00 each. The plan also includes a convenient web application for submitting and tracking cases, allowing drivers to have a clear and transparent view of the status of their cases virtually anytime.

WHAT SUBSCRIPTION PLANS DOES FCP OFFER?

We offer two subscription plans, the Basic Plan ($10.00/month) and the Flex Plan ($25.00/month). Both plans grant subscribers access to our expansive legal network of provider attorneys and case management services.

WHAT BENEFITS ARE INCLUDED IN EACH TYPE OF PLAN?

Basic Plan subscribers have access to our network of attorneys and case management services. A $50.00 case management fee applies per citation handled. Attorney fees are passed through at cost and must be paid in full before we engage a provider attorney. Additional services include:
- Citation-Related DataQs Submissions — Included
- Motor Vehicle Record (MVR) Requests — $30.00 per request
Flex Plan subscribers receive everything in the Basic Plan, plus the following enhanced benefits (subject to the exclusions, terms, and conditions set forth in our Subscription Agreement):
- Case Management Fee — Waived
- Attorney Fee Installments — Split into 4 monthly payments, no interest (25% due upfront)
- Non-Citation DataQs Submissions — $50.00 per request
- MVR Requests — 2 free per year, $25.00 each after
- DMV Communication Services — 10 requests per year included, $50.00 each after

For both plans, if a subscriber’s legal matter results in a CSA challengeable reduction, at that subscriber’s request, we will assist with addressing his/her PSP Report by performing a DataQs challenge for any challengeable reductions identified in the corresponding inspection report at no additional charge.

WHAT ABOUT PRE-EXISTING CITATIONS?

Both plans include case management services for pre-existing citations (citations received before your subscription began), provided that FCP receives the citation at least ten (10) business days prior to your first court date. Standard plan terms apply — including the case management fee for Basic Plan subscribers and installment terms for Flex Plan subscribers. Pre-existing citations involving serious traffic violations (such as vehicular manslaughter, vehicular homicide, or negligent homicide) are excluded.

HOW DO FLEX PLAN INSTALLMENTS WORK?

Flex Plan subscribers can split their attorney fees into four (4) equal monthly payments at no interest. The first payment (25% of the attorney fee) is due before we engage the provider attorney on your behalf. The remaining three payments are automatically charged monthly to your payment method on file. Please note:

Only one active installment plan may be in effect at a time — a new citation cannot be placed on installment terms until the prior plan is paid in full
If a payment is missed, the entire remaining balance becomes due immediately, and benefits may be suspended until the outstanding amount is paid
FCP reserves the right to decline the installment option for any particular matter at its sole discretion

CAN I SWITCH PLANS?

Yes. You may upgrade from Basic to Flex or downgrade from Flex to Basic at any time. Plan changes take effect at the start of your next billing cycle. If you are downgrading from Flex to Basic and have an active installment plan, the remaining balance must be paid in full before the downgrade takes effect. If you are upgrading from Basic to Flex, the enhanced Flex benefits (including installment terms and waived case management fee) will apply only to new citations filed after the upgrade — any open matters initiated under the Basic Plan will remain on Basic Plan terms.

WHAT HAPPENS IF I HAVE AN OPEN CASE WHEN MY SUBSCRIPTION ENDS?

If your subscription expires or is terminated while you have an open legal matter, FCP’s case management services for that matter will end as of the expiration or termination date. Your relationship with your provider attorney is independent of FCP, and you may continue working with them directly at your own expense. FCP will make reasonable efforts to facilitate a smooth transition of your case information before the end of your subscription. Any outstanding balances owed to FCP, including unpaid installments, remain due regardless of whether the subscription has ended.

WHAT HAPPENS IF I GET A SECOND CITATION WHILE I’M STILL PAYING OFF THE FIRST ON INSTALLMENTS?

Only one installment plan may be active at a time. If you receive a second citation while an installment plan is still in progress, FCP will still provide case management services for the new matter — but the full attorney fee must be paid in full upfront. The installment option will not be available for the new citation until your existing installment plan has been paid off.

WHAT IS FCP’S POLICY ON CHARGEBACKS?

All charges under your Subscription Agreement — including subscription fees, case management fees, and installment payments — are pre-authorized. If you have a billing question or believe a charge was made in error, please contact us directly so we can resolve it. Filing a chargeback or payment dispute with your bank or credit card company for an authorized charge is considered a material breach of the Subscription Agreement, and may result in immediate suspension of benefits and termination of your subscription.

WHAT HAPPENS IF FCP CANNOT REACH ME DURING MY CASE?

It is your responsibility to stay responsive and cooperate with FCP throughout your legal matter. If FCP is unable to reach you after multiple attempts over a period of five (5) business days and your case has a pending deadline or court date, FCP may close the case. FCP will not be responsible for any negative outcomes resulting from such closure, including missed court dates, default judgments, or fines. Any fees previously paid for the matter are non-refundable. You may request that FCP reopen a closed case, subject to FCP’s discretion and any additional fees that may apply.

WHAT VEHICLES ARE ELIGIBLE FOR BENEFITS?

To be eligible for benefits, a subscriber’s vehicle(s), whether commercial or passenger in nature, must be registered with the appropriate state or governmental agency and comply with all applicable laws and regulations governing the operation of such vehicle(s) throughout the subscription’s term.

WHAT EXCLUSIONS APPLY?

For a comprehensive list of exclusions, terms, and conditions, please see our Subscription Agreement. Generally speaking, benefits will not be provided for any claim that results directly or indirectly from drug or alcohol-related matters; failure to appear on a prior traffic violation; driving on a suspended, revoked, or invalid driver’s license; leaving the scene of an accident; felonies; past due citations; red light camera violations; warrants, acts, or omissions performed in the commission of a crime under a municipal ordinance or state and/or federal statute; civil cases; criminal cases; boat or watercraft violations; appeals; and more.

WHAT IS FCP’S REFUND POLICY?

All payments are final, non-refundable, and non-creditable, except as expressly provided in our Subscription Agreement.

FALSE OR FRAUDULENT CLAIMS MADE BY SUBSCRIBER

If a subscriber makes a claim for benefits that he/she knows to be false or fraudulent, we may withhold benefits and/or terminate the Subscription Agreement. In such a case, coverage will no longer apply to that subscriber, and all claims made by said subscriber will be forfeited.

ENROLLING IN A SUBSCRIPTION IS NO GUARANTEE OF RESULTS

While our legal network of provider attorneys is highly successful in getting citations dismissed or reduced, enrollment in a subscription is not a guarantee of results. All legal matters are evaluated on their own merit by provider attorneys on a case-by-case basis to determine whether certain claims or defenses pertaining to a subscriber’s situation are supported by applicable laws and regulations.

Серьезные нарушения ПДД
Существующие на момент начала подписки штрафы, при условии оплаты комиссии за обработку в размере $250.000 за каждое существующее дело
Кроме того, если юридическое дело подписчика приводит к возможности обжалования снижения CSA, по запросу подписчика, мы поможем в решении его/ее PSP-отчета, проводя проверку DataQ для любых обжалуемых снижений, указанных в соответствующем инспекционном отчете. Для подписчиков плана Basic эта услуга стоит $25.00 за подачу, а подписчики плана Pro получают неограниченное количество подач в рамках их подписки.

КАКИЕ ТРАНСПОРТНЫЕ СРЕДСТВА ВХОДЯТ В ПЛАН?
Для получения сервисов транспортное средство(-а) подписчика, будь то коммерческое или легковое, должно быть зарегистрировано в соответствующем государственном или правительственном органе и соответствовать всем применимым законам и нормативам, регулирующим эксплуатацию такого транспортного средства(-ов) на протяжении срока действия подписки.

КАКИЕ ИСКЛЮЧЕНИЯ ПРИМЕНЯЮТСЯ?
Для получения полного списка исключений, условий и положений, пожалуйста, обратитесь к нашему Соглашению о подписке. В общих чертах, преимущества не будут предоставлены для любых претензий, которые прямо или косвенно вытекают из вопросов, связанных с наркотиками или алкоголем; неявки на судебные слушания связанные с предыдущими нарушениями ПДД; вождения на аннулированных, отозванных или недействительных водительских правах; покидания места аварии; тяжких преступлений; просроченных штрафов; нарушений красного света камеры; ордеров, действий или бездействий, совершенных при совершении преступления по муниципальной норме или государственному и/или федеральному закону; гражданских дел; уголовных дел; нарушений на водном транспорте; апелляций и т.д.

КАКОВА ПОЛИТИКА ВОЗВРАТА FCP?
Все платежи являются окончательными, не подлежат возврату и не могут быть зачтены в счет будущих платежей, кроме случаев, прямо предусмотренных в нашем Соглашении о подписке.

ЛОЖНЫЕ ИЛИ МОШЕННИЧЕСКИЕ ЗАЯВЛЕНИЯ, СДЕЛАННЫЕ ПОДПИСЧИКОМ
Если подписчик делает заявку на получение сервиса, содержащие заведомо ложную или мошенническую информацию, мы можем удержать сервис и/или расторгнуть Соглашение о подписке. В таком случае, покрытие больше не будет применяться к этому подписчику, и все заявки, сделанные данным подписчиком, будут аннулированы.

ПОДПИСКА НЕ ГАРАНТИРУЕТ РЕЗУЛЬТАТОВ
Несмотря на то, что наша юридическая сеть поставщиков-адвокатов успешно добивается отмены или снижения штрафов, подписка не гарантирует результатов. Все юридические вопросы оцениваются поставщиками-адвокатами на индивидуальной основе для определения, поддерживаются ли определенные иски или защита, относящиеся к ситуации подписчика, применимыми законами и нормами.

This means drivers can get the representation they need without a large upfront cost. The Flex Plan also includes citation-related DataQs submissions at no additional charge, non-citation DataQs submissions for $50.00 per request, two free Motor Vehicle Record (MVR) requests per year ($25.00 each after), and up to ten DMV communication requests per year for CDL-related administrative matters such as reinstatement and endorsement inquiries ($50.00 each after). The plan also includes a convenient web application for submitting and tracking cases, allowing drivers to have a clear and transparent view of the status of their cases virtually anytime.
