La palabra matrimonio deriva de la frase
matrem muniens, significando la idea de
defensa y protección de la madre. Lo anterior
tiene por función que el matrimonio garantizara
el cumplimiento de los deberes del hombre
hacía la madre de sus hijos.
A la palabra matrimonio suele tomársela en
dos sentidos: como acto, rito o solemnidad, y
como estado permanente resultante de ese
acto.

En Colombia, los matrimonios in extremis
son considerados matrimonios
especiales que se celebran cuando uno o
ambos cónyuges están en inminente
peligro de muerte. En estos casos, el
matrimonio es válido y tiene plenos
efectos si la muerte ocurre antes de los
40 días de la celebración. Si la muerte no
ocurre, el matrimonio también es válido
si se revalida después de los 40 días.
ART 136 – CÓDIGO CIVIL.
MATRIMONIO EN PAÍS EXTRANJERO
En Colombia, la legislación permite que dos extranjeros
contraigan matrimonio en el país, siempre que se
cumplan ciertos requisitos:
• La ley nacional de los contrayentes debe permitir este
tipo de matrimonio.
• Ninguno de los contrayentes debe ser colombiano.
• El matrimonio no debe contravenir las disposiciones
del Código Civil y el Código General del Proceso.
Para validar un matrimonio celebrado en el extranjero en
Colombia, se debe presentar:
• Cédulas de ciudadanía original y fotocopia.
• Copia original del certificado o registro de matrimonio,
con una antigüedad no mayor a tres meses.
• El registro civil extranjero apostillado o legalizado, y
traducido al español si es necesario.

Para contraer nupcias en Colombia se debe cumplir con ciertos
requisitos como:
- Estar debidamente divorciado con sentencia juridical o
acuerdo notarial que así lo ceritfique, junto con su respective
registro en el registro civil de los contrayentes.
- En caso de ser viudo haber registrado tal condición.
Además, el C.C. en su artículo 169 establece que, la persona que teniendo hijos bajo su patria
potestad, o bajo su tutela o curatela, quisiere casarse, deberá proceder al inventario solemne
de los bienes que esté administrando.
Para la confección de este inventario se dará a dichos hijos un curador especial.

El matrimonio canónico es un
matrimonio celebrado de acuerdo a la
Iglesia Católica, y en Colombia se
reconoce como un matrimonio
religioso. Para que un matrimonio
canónico sea válido ante la ley en
Colombia, debe ser registrado en una
notaría.
En Colombia, se reconocen los efectos
civiles de los matrimonios religiosos, lo
que significa que se les otorga plena
validez legal. Sin embargo, la ley civil
rige los aspectos formales del
matrimonio, así como las relaciones
jurídicas entre los cónyuges y la

Un concordato es un tipo de acuerdo entre la Santa Sede
(como representante de la Iglesia católica) y un Estado para

descendientes o son hermanos.
● Cuando se ha contraído entre el padre adoptante y la hija adoptiva, o
viceversa.
● Cuando respecto del hombre o de la mujer, o de ambos estuviere
subsistente el vínculo de un matrimonio anterior.
