RESPONSABILIDADES
La víctima y las demás personas a quienes el accidente o
RESPONSABILIDAD CIVIL DEL EMPRESARIO,
enfermedad cause daño podrán reclamar al empleador o
EL ART. 69 DE LA LEY Nº 16.744
terceros responsables del accidente.
Puede ser de pena de presidio menor en sus grados mínimo
RESPONSABILIDAD PENAL a medio cuando el hecho sea declarado crimen, o pena de
presidio menor en su grado mínimo o multa cuando el
hecho sea declarado simple delito.
El Reglamento Interno de la empresa recogerá las
RESPONSABILIDAD DEL TRABAJADOR sanciones que se aplicarán a los trabajadores que no
respeten sus contenidos

CONCLUSIONES
● En Chile el sistema de prevención de riesgos y de salud laboral es bastante
eficiente en comparación a otros países cercanos
● Se debería regularizar con más exigencia a las mutualidades de seguridad
● Es una buena medida agrupar las leyes y decretos (actualizaciones) en un
manual diferenciado en capítulos.
● En la evaluación de los años 2013 al 2021 entre las actividades
económicas correspondientes a servicios, industria, agrario y
construcción hemos concluido que representan el 75% de la totalidad
de accidentes elaborados.
● El número de fallecidos en el sector construcción tiene una tendencia
al incremento año tras año a pesar de las mejoras implementadas.
● Debe existir mayor control en los procesos implementados por las
empresas de cada sector para evitar accidentes mortales.
