Introducción

Hacer un trabajo sobre el Derecho del mar, el Derecho pesquero y el Derecho


marítimo es interesante. Primero, porque el Derecho del mar es una de las
ramas más recientes que tenemos, sin embargo, para saber el área a la que
se dedica, debemos investigar el funcionamiento de la Convención de las
Naciones Unidas sobre el Derecho del Mar, (CONVEMAR).
Este documento revolucionó la costumbre que se tenía antes, toda vez
que era implantada por las grandes potencias marítimas. Por lo tanto nos
dimos a la tarea de investigar el funcionamiento práctico, hasta el año 2006
de dicha convención. Asimismo, su distinción con el Derecho marítimo, la
importancia del buque de guerra en tiempo de paz, la importancia de los
océanos, así como averiguar el alcance de la Ley Federal del Mar (vigente) que
se estableció en nuestro país con base en la CONVEMAR.
Segundo, porque el Derecho pesquero, como parte del Derecho del
mar, va adquiriendo gran valor en virtud de las necesidades de los pueblos
por lograr el mejor aprovechamiento social de los productos llamados
hidrobiológicos, investigamos su definición, su relación con el “derecho
administrativo”, la importancia de la enseñanza del Derecho pesquero, los
sujetos del mismo y las otras áreas de las que se ocupa este derecho; un
glosario de términos jurídicos en materia pesquera, la problemática de
algunos productos pesqueros y también entramos a estudiar la Ley de Pesca
vigente en México.
Tercero y último, porque al estudiar la definición del Derecho marí-
timo, nos enteramos de que al dedicarse a la navegación, a la industria y al
tráfico de mercancías y pasajeros por mar, nos damos cuenta de la importan-
cia económica que tiene en nuestros días. Además, estudiamos la historia del
Derecho marítimo, sus diferencias con el “derecho mercantil”, las diferencias
que tiene con el “derecho público” y el “derecho privado”, su relación con
otras ramas del derecho; la Ley de Navegación y Comercio Marítimos de junio
de 2006 y la Ley de Puertos y Marina Mercante.
No podíamos dejar pasar esta oportunidad para rendir un pequeño
homenaje a dos hombres que nos legaron sus luces en cuanto a estos temas
tan necesarios y nunca suficientemente estudiados por los expertos. El
maltés, doctor Arvid Pardo y el mexicano, doctor Raúl Cervantes Ahumada.
