1. By enrolling with erobits.com (the "Website"), you become a Customer and agree to be bound by this Agreement (the "Agreement"). This agreement is subject to change by erobits.com, at any time, and changes are effective upon notice to each Customer.

2. Unless and until this agreement is cancelled in accordance with the terms hereof, the Customer hereby authorizes the "Website" to charge customer's credit card (or other approved facility) to pay for the cost of digital product(s). The Customer hereby further authorizes the "Website" to charge Customer's credit card (or other approved facility) for any and all purchases of products, services and entertainment provided by erobits.com. Customership may NOT be assigned or transferred to any other person or entity. Customer must promptly inform erobits.com of the following: changes in home or billing address; and apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID or password. Until erobits.com is notified by E-MAIL of a breach in security, the Customer will remain liable for any unauthorized use of the Website. Upon request, Customers will be given access to billing records that support charges for use of the Website.

3. Erobits.com is able to process credit cards, debit cards, and prepaid debit or gift cards bearing the Visa or Mastercard logo via our payment processor Verotel. The Erobits.com does not collect and store credit card details, although customers do have the option of storing their credit card details with one of our payment processors, Verotel. For more information on how card information is stored with Verotel, please refer to their terms and conditions. Please note that charges for Verotel's services may appear on your bank or card statements as 'vtsup.com'.

4. Customers are responsible for providing all personal computer and communications equipment necessary to gain access to the Website. Access to and use of the Website is through a combination of an email and a password. Each Customer must keep his password STRICTLY CONFIDENTIAL. Remember your password! For security reasons, erobits.com will not release passwords for any reason, except as may be specifically required by law or court order. Unauthorized access to the Website is a breach of this Agreement and a violation of law.

5. Any liability of erobits.com including without limitation any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause or action, shall be strictly limited to the amount paid by or on behalf of the Customer to erobits.com for the preceding 1 month. Some US states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

6. No warranty is made by erobits.com regarding any information, services, or products provided through or in connection with the Website, and erobits.com hereby expressly disclaims any and all warranties, including without limitation: 1) any warranties as to the availability, accuracy, or content of information, products or services; 2) any warranties of merchantability or fitness for a particular purpose. Some states/provinces do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

7. Except for public domain material and electronic messages, all material displayed on the Website is copyrighted and licensed by erobits.com and may not be copied, redistributed, or downloaded, in whole or in part, without the prior written consent of erobits.com, unless otherwise clearly stated in this Agreement.

8. The material on the Website is for the private, non-commercial enjoyment of Customers only. Any other use is prohibited.

9. The Website enables Customers to share information with other Customers. Customers agree not to submit, publish, or display on the Website any defamatory, inaccurate, abusive, threatening, racially offensive, or illegal material. Transmission of such material that bangs any federal, state, or local law, is prohibited and is a breach of this Agreement.

10. Customers agree not to engage in advertising to, or solicitation of other Customers to buy or sell any products or services through the Website without prior written consent. Customers are responsible for information they send, or display through the Website even if a claim should arise after termination of service.

11. There are no facilities provided by the Website for sending or receiving private or confidential electronic communications. All messages shall be deemed to be readily accessible to the general public. Do not use the Website for any communication for which the sender intends only the sender and the intended recipient(s) to read. Notice is hereby given that all messages entered into this Website can and may be read by the operators of the Website, whether or not they are the intended recipient(s).

12. Notices by erobits.com to Customers may be given by means of electronic messages through the Website, by a general posting on the website, or by electronic or regular mail. Notices by Customers to erobits.com may be given by electronic messages or mail, unless otherwise specified in the Agreement. All questions, complaints, or notices to erobits.com, by means of electronic message must be sent to Customer Service. All questions regarding new erobits.com products, by means of electronic message should be sent to Customer Service.

13. The Customer hereby warrants and represents that he or she is over the age of 18 (21 years in some locales), and in all respects is qualified and competent to enter into this agreement and consents to the viewing of adult material without being in violation of any local laws.

14. This Agreement contains the entire agreement between the Customer and erobits.com regarding the use of the Website, and supersedes all prior written and oral understandings and writings, and may only be amended upon notice by erobits.com to Customers. Unless otherwise explicitly stated, the provisions of this Agreement shall survive its terminations.

15. Erobits.com Customers agree upon registering to have their Email address added to our newsletter mailing list, and may possibly receive special offers from us. This information will not be shared with or sold any other entity. However we do have a strict policy against all types of unsolicited email.

16. Billing Errors. If You believe that You have been erroneously billed, please notify Us immediately of such error. If We do not hear from You within thirty (30) days after such billing error first appears on any account statement, such fee will be deemed acceptable by You for all purposes, including resolution of inquiries made by your credit card issuer. You release Us from all liabilities and claims of loss resulting from any error or discrepancy that is not reported to Us within thirty (30) days of its publication.

17. Refund policy. If you are unsatisfied with our service or are experiencing irresolvable technical difficulties, please contact Customer Service. Due to the nature of downloadable products, we only offer refunds under special circumstances. 19. Governing Law. All legal issues arising under these terms will be governed by United Kingdom law.

20. Change of Use. The Content Reporting and Appeal Procedure

Purpose

The Content Reporting and Appeal Procedure (the ‘Procedure’) sets out the process adopted by EroBits for the reasonable and prompt handling of complaints.

If you are dissatisfied with our services, or if you have a query regarding your account or activity with us, you may contact the Customer Support Department. Our Customer Support will determine if your query can be resolved immediately; if your query cannot be resolved immediately, we remain committed to addressing and/or resolving it in a prompt manner.

Content reporting

If you become aware of any illegal or non-consensual content on our website, you should contact the Customer Support Department immediately by submitting a notification here. Complaints regarding illegal content or non-consensual content will be reviewed and resolved within 24 hours. The assigned Customer Support Manager will acknowledge the receipt of the complaint, investigate it and remove the illegal or non-consensual content within the above timeframe. All complaints will be logged for record-keeping and reporting purposes.

Appeal Procedure

Any person depicted in a video or any other content available through our website without his/her consent has the right to appeal to remove such content. Such requests should be submitted here, along with all the information necessary to identify the relevant content, including the specific URL containing such content. Following the submission of your appeal, the relevant department will evaluate and determine whether such consent was obtained. If it appears that such content was uploaded without the consent of the person depicted in it, EroBits will immediately and permanently remove the content.

Escalation Procedure

Where possible we will attempt to resolve your complaint at the first point of contact. If we are unable to resolve your complaint at the first point of contact, we will undertake an investigation of your complaint and provide you with our findings. If you are still not satisfied with the way that your complaint was handled or resolved, you have the right to request the escalation of your complaint to our Legal Department. The Legal Department will investigate the complaint and the relevant facts and try to establish a common ground.

Where to submit the complaint and what to include

Complaints need to be sent via the contact form to the Customer Support Department.

Complaints communicated to the Customer Support Department must include all the necessary evidence proving that the content belongs to the person submitting the complaint. EroBits reserves the right to request additional information required to identify the person submitting the complaint such as a government-issued identification document.
