Welcome to electfontes.com (the “Site”), operated by Fontes for AZ (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site. Please read them carefully.

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Site.

Eligibility

The Site is intended for use by individuals who are at least 13 years of age. Certain features, including making a contribution, are available only to individuals who are at least 18 years of age or who have obtained parental or guardian consent as permitted by applicable law. By using the Site, you represent that you meet these requirements.

Contributions

If you make a contribution through the Site, you certify that each of the following statements is true and accurate as of the date of your contribution:

You are a United States citizen or a lawfully admitted permanent resident of the United States.
The contribution is made from your own funds, and not from the funds of another person or entity.
The contribution is made on a personal credit or debit card for which you have the legal obligation to pay, or from a personal account for which you have signature authority, and is not made on a corporate or business entity card or account except as expressly permitted by applicable Arizona law.
You are not being reimbursed by another person or entity for the contribution, and you are not making this contribution in the name of another.
You are not a foreign national who lacks permanent resident status in the United States.
You are at least 18 years of age, or you are a minor contributing knowingly and voluntarily from your own funds as permitted by applicable law.

Contributions are subject to the limits and reporting requirements established by Arizona law. Contributions to Fontes for AZ are not tax-deductible as charitable contributions for federal income tax purposes.

We are required by law to collect and report the name, address, occupation, and employer of contributors, along with the date and amount of each contribution, in accordance with applicable thresholds. This information is filed with and made publicly available by the applicable government agencies.

Refunds. If you believe a contribution was made in error, contact us at electfontes.com/contact. We reserve the right to refuse, refund, or return any contribution at our sole discretion, including any contribution that does not comply with applicable law.

Recurring contributions. If you elect to make a recurring contribution, you authorize us to charge your payment method on the schedule you selected until you cancel. You may cancel at any time by contacting us at the address above or by following the instructions provided in your contribution receipt.

Acceptable Use

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms
Post or transmit content that is defamatory, harassing, threatening, obscene, hateful, or that infringes the rights of any third party
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Upload or transmit viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to the Site or any related systems
Use any automated means—including bots, scrapers, or spiders—to access, monitor, or copy the Site or its content without our prior written permission
Attempt to probe, scan, or test the vulnerability of the Site, or breach any security or authentication measure
Interfere with or disrupt the Site, its servers, or networks, including by imposing an unreasonable load on our infrastructure
Harvest or collect information about other users of the Site
Use the Site to send unsolicited commercial or political communications

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms, including removing content, suspending or terminating access, and reporting conduct to law enforcement.

User Submissions

The Site may allow you to submit comments, photographs, videos, or other content (“User Submissions”). You retain ownership of your User Submissions.

By submitting content to the Site, you grant Fontes for AZ a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media, in connection with the campaign and its activities, without compensation to you.

You represent and warrant that you own or otherwise control all rights to your User Submissions, and that your User Submissions do not infringe the rights of any third party or violate any applicable law.

We do not endorse and are not responsible for any User Submission. We reserve the right, but assume no obligation, to monitor, edit, or remove any User Submission at any time and for any reason, without notice.

Intellectual Property

The Site and its contents—including text, graphics, logos, images, video, audio, and software—are the property of Fontes for AZ or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, download, and print content from the Site for your own personal, non-commercial use, provided you do not remove any copyright or proprietary notices. Any other use, including reproduction, modification, distribution, republication, or public display, requires our prior written permission.

Nothing in these Terms grants you any right to use the name, logo, trademarks, or service marks of Fontes for AZ.

Email. By providing your email address, you consent to receive email communications from Fontes for AZ. You may unsubscribe at any time using the link provided at the bottom of each email.

Text messages. See the Text Message Terms section below.

Phone. By providing your telephone number, you consent to receive calls from Fontes for AZ regarding the campaign, which may be placed using automated technology.

Text Message Terms

These Text Message Terms apply to the SMS/MMS messaging program operated by Fontes for AZ.

Program description. Fontes for AZ sends recurring text messages containing campaign updates, event and volunteer information, get-out-the-vote reminders, and fundraising requests.

Consent. By providing your mobile number, you consent to receive recurring automated marketing text messages from Fontes for AZ at that number, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase or contribution.

Message frequency. Message frequency varies.

Cost. Msg and data rates may apply. Fontes for AZ does not charge for these messages, but your mobile carrier’s standard rates apply.

Opting out. Text STOP to unsubscribe at any time. After you send STOP, we will send one message confirming your opt-out, after which you will receive no further messages unless you re-subscribe.

Help. Text HELP for help, or contact us at electfontes.com/contact.

Carriers. Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, U.S. Cellular, MetroPCS, Virgin Mobile, Cricket, and others. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.

Eligibility. You must be the account holder of, or have permission from the account holder of, the mobile number you provide. You must be at least 18 years of age, or have parental or guardian consent, to enroll.

Privacy. Information collected through this program is handled in accordance with our Privacy Policy. Mobile opt-in data and consent are not shared with any third parties for their own marketing purposes.

Third-Party Links and Services

The Site may contain links to third-party websites, services, and resources, including payment processors and social media platforms. These links are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of a third-party site or service is governed by that party’s terms and privacy policy.

Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components. We make no warranty regarding the accuracy, completeness, reliability, or currency of any content on the Site.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FONTES FOR AZ AND ITS OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS, CONTRACTORS, AND VENDORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF—OR INABILITY TO ACCESS OR USE—THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Fontes for AZ and its officers, employees, agents, volunteers, contractors, and vendors from and against any claims, liabilities, damages, losses, and expenses—including reasonable attorneys’ fees—arising out of or in any way connected with your access to or use of the Site, your User Submissions, or your violation of these Terms or any applicable law.

Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice or liability. The provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, and indemnification.

Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may modify these Terms at any time. If we do, we will post the revised Terms on the Site and update the “Last Updated” date above. Your continued use of the Site after any change constitutes your acceptance of the revised Terms. Please review these Terms periodically.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fontes for AZ regarding the Site, and supersede any prior agreements on that subject.
