２　第二十二条に規定する受入受刑者が有期の共助刑についての仮釈放後、その処分を取り消されないで仮釈放前に共助刑の執行を受けた期間（裁判国において受入移送犯罪に係る確定裁判において言い渡された外国刑の執行としての拘禁をしたとされる日数を含む。）と同一の期間又は共助刑の刑期を経過したときは、そのいずれか早い時期において、共助刑の執行を受け終わったものとする。ただし、共助刑の刑期が三年に満たないときは、この限りでない。 - 日本法令外国語訳データベースシステム
